the sentence was ordered under that particular statute. If the terms and conditions <strong>of</strong><br />

s. 973.015 have been met, the record will indicate "successfully completed." If the<br />

subject was given probation or any other extended terms and conditions, a follow-up<br />

letter will be sent to the court indicating that the CIB is aware <strong>of</strong> the "special<br />

disposition" and requesting that the court notify the CIB <strong>of</strong> any status change. When<br />

the CIB receives follow-up information from the court, the record will be modified<br />

to indicate "successfully completed" or "special disposition revoked" as directed by<br />

the court. If the special disposition is revoked, the associated sentence will be<br />

appended to the record.<br />

The computer currently flags any record that has a "special disposition" and when<br />

the date <strong>of</strong> any special terms is reached, that "flag" is removed prior to the release <strong>of</strong><br />

the record. If an agency inquires on a record that has an adjudication under s.<br />

973.015 and the term has been reached, the computer will route the inquiry to a<br />

clearinghouse terminal. If the date <strong>of</strong> the terms has been reached without any<br />

subsequent notification from the court, CIB will assume that the terms have been met<br />

and annotate the record with a "successfully completed" for release. If CIB receives<br />

notification after the fact that the terms were not "successfully completed," the<br />

Bureau will change the "successful completion" to "special disposition revoked" and<br />

append the associated sentence.<br />

All Clerks <strong>of</strong> Court should be aware <strong>of</strong> the definition <strong>of</strong> "expunction" as clarified in<br />

this case. Records should be "sealed" and not destroyed to be in conformance with s.<br />

973.015.<br />

This form will be used to return dispositions relating to 973.015/961.47 (1) and<br />

juvenile waivers if they do not pass the quality control check process at CIB.<br />

Death Notice<br />

This form is used by law enforcement agencies to notify the CIB that an individual<br />

whose fingerprints are on file, is deceased. Upon receipt <strong>of</strong> this notice the CIB<br />

properly annotates the criminal history database to reflect this information.<br />

Agencies who become aware <strong>of</strong> the death <strong>of</strong> any person having a State <strong>Identification</strong><br />

Number (SID) must complete the form and send it to the CIB. Accuracy is essential<br />

and the SID must be included. If possible, an inked rolled fingerprint impression<br />

from the deceased can be placed on the form to provide positive identification.<br />

Agencies investigating a death should obtain all ten inked impressions on a regular<br />

fingerprint card and the death notification should be forwarded to the CIB.<br />

In cases where an unidentified corpse is found, all ten inked impressions must be<br />

obtained on a fingerprint card and submitted to the CIB, where a technical search<br />

will be made in an effort to determine an identification.<br />

Expungement <strong>of</strong> Records<br />

<strong>Wisconsin</strong> Statute 165.84 (1) states in part "any person arrested or taken into<br />

custody and subsequently released without charge, or cleared <strong>of</strong> the <strong>of</strong>fense through<br />

court proceedings, shall have any fingerprint record taken in connection therewith<br />

returned upon request." An individual must be cleared <strong>of</strong> ALL <strong>of</strong>fenses on a given<br />

arrest event in order to qualify for an expungement. The Crime Information Bureau<br />
