In many instances, criminal complaints include statute citations for both the <strong>of</strong>fense<br />

and penalty sections. Fingerprint cards should be submitted using the <strong>of</strong>fense statute<br />

rather than the penalty statute. Penalty statutes <strong>of</strong>ten state penalties for more than<br />

one specific <strong>of</strong>fense. By including the <strong>of</strong>fense statute the precise elements <strong>of</strong> the<br />

<strong>of</strong>fense are reported and available. The severity <strong>of</strong> the <strong>of</strong>fense will be indicated in<br />

the elsewhere on the fingerprint card. If the criminal complaint indicates the<br />

defendant is charged with Theft under 943.20(1)(a) and 943.20(3)(a), only the<br />

<strong>of</strong>fense section; 943.20(1)(a) need be reported. 943.20(3)(a) identifies the <strong>of</strong>fense as<br />

a class A misdemeanor.<br />

Offense Charged by Prosecutor/District Attorney<br />

This area is to be completed when the prosecutor or district attorney changes the<br />

charge the arresting agency originally filed against the individual this document<br />

relates to. The literal description <strong>of</strong> the <strong>of</strong>fense is to be included, along with the<br />

Statute/Ordinance No. and NCIC Code.<br />

Literal<br />

List the literal <strong>of</strong>fense for which the subject is being charged if other than the<br />

original arrest charge.<br />

Statute/ORD. Citation<br />

List the corresponding statute number for the <strong>of</strong>fense now being charged. If an<br />

ordinance violation, the word “ORD” should be used.<br />

NCIC Code<br />

List the NCIC code appropriate for the <strong>of</strong>fense being charged.<br />

Court Case/Docket #<br />

This space is for the Clerk <strong>of</strong> Court to record the case number that has been assigned<br />

to the person and case related to the arrest data furnished on the Final Disposition<br />

Report and corresponding to the arrest fingerprint card.<br />

Final Disposition<br />

REQUIRED This space is for reporting the final action the court or prosecutor is<br />

taking against the individual who this document relates to.<br />
