1. s. 51.20(13)(cv)4 - When committed involuntarily by a court and<br />

ordered not to possess a firearm.<br />

2. s. 938.396(8) - When adjudicated delinquent for an act that would<br />

be a felony if committed by an adult. This information may only<br />

be used as part <strong>of</strong> a firearms restriction search under s.<br />

175.35(2g)(c).<br />

3. s. 938.396(9) - When adjudicated delinquent for committing a<br />

serious crime as defined in s. 48.685(1)(c). This information may<br />

only be disclosed as part <strong>of</strong> a criminal history record search under<br />

48.685(2)(am)1. or (b)1.a (daycare background check).<br />

Other than these exceptions, no juvenile disposition information should be<br />

contributed to CIB. When required, juvenile disposition information for these<br />

exceptions should be submitted using for DJ-LE-FH9. This form is to be completed<br />

by the court and the green copy mailed to:<br />

Any juvenile disposition information not meeting this criteria will not be retained by<br />

CIB.<br />

Juvenile Waivers<br />

Final Disposition Description<br />

A fingerprint card submitted to CIB indicating the subject is a juvenile but is<br />

checked treat as an adult will cause the disposition to be left open waiting for a<br />

disposition from the court.<br />

A fingerprint card submitted to CIB indicating the subject is a juvenile without an<br />

indicator to treat as an adult will automatically default to a disposition <strong>of</strong> turned<br />

over to juvenile authorities. The booking agency should still obtain and complete a<br />

disposition form, including the ATN, at the time <strong>of</strong> booking should the juvenile be<br />

subject to waiver at a later time. Local policy between the booking agency,<br />

prosecutor and court should determine whether the booking agency hold the<br />

disposition pending waiver or forward with the case file. If the subject is waived, the<br />

disposition should follow the case through court to eventually be reported to CIB.<br />

When the court submitted disposition is received by CIB, the submitted court<br />

disposition will be used to overwrite the automatically applied juvenile disposition.<br />

If the juvenile is not waived the disposition should be destroyed. This process<br />

eliminates the need for the booking agency to notify CIB independently that a<br />

juvenile has been waived.<br />

The Final Disposition Report (DJ-LE-249) is a single copy white form, 8" x 8", with<br />

green colored printing. The left side <strong>of</strong> the Final Disposition Report provides blocks<br />

for descriptive information <strong>of</strong> the individual, the Contributing/Arresting Agency,<br />

their OCA number, State <strong>Identification</strong> Number and arrest data. The right side<br />

provides space for action taken by the Prosecutor or Clerk <strong>of</strong> Court, along with the<br />

Court Case Number. This includes Findings & Sentence information or any<br />

additional information that explains actions taken by the court.<br />
