Applicant Submissions<br />

General<br />

The Crime Information Bureau processes and checks applicant/licensee fingerprint<br />

cards for law enforcement positions, NCIC security clearance, watchman/guard<br />

(440.26), lottery positions, Indian gaming, and other employment requests that<br />

require fingerprinting as provided by State statute. These cards are processed,<br />

searched through the file, and returned to the law enforcement agency for filing<br />

along with any information obtained on whom the card was submitted. Prior to July<br />

1, 1987, applicant cards for purposes other than law enforcement were processed at<br />

no cost to the requesting agency. Statute 165.82 mandates that the Crime<br />

Information Bureau imposes a search fee for each search <strong>of</strong> the criminal history files<br />

for purposes unrelated to criminal justice. Upon submission <strong>of</strong> an applicant card the<br />

contributing agency will receive one <strong>of</strong> two types <strong>of</strong> return information.<br />

• NO RECORD: An applicant card received and processed that results<br />

in no discovery <strong>of</strong> a prior record in the CIB files will be stamped<br />

"APPLICANT" and returned to the contributing agency with the<br />

notation <strong>of</strong> "NO RECORD OUR FILES" stamped across the charge<br />

block <strong>of</strong> the fingerprint card.<br />

• RECORD ATTACHED: An applicant card received and processed<br />

that results in the disclosure <strong>of</strong> a prior record in the CIB files will be<br />

stamped "APPLICANT" and returned to the contributing agency with<br />

the notation <strong>of</strong> "IDENTIFICATION TRANSCRIPT ATTACHED"<br />

stamped across the charge block <strong>of</strong> the fingerprint card.<br />

Fingerprint-based background checks are also available from the FBI only when<br />

pursuant to a state statute approved by the United States Attorney General or by<br />

federal law.<br />

All applicant fingerprint requests may be submitted on FBI applicant fingerprint<br />

cards. CIB will process applicant requests whether received on FBI applicant cards<br />

or CIB fingerprint cards clearly marked “applicant”.<br />

Law Enforcement Applicant Card & NCIC Security<br />

Clearance<br />

The administrative rules <strong>of</strong> the Law Enforcement Standards Board Chapter LES2 list<br />

Recruitment Qualifications for law enforcement agencies. LES2.01(f) states "the<br />

applicant shall be <strong>of</strong> good character" and LES2.01(f)(1)(A) further states that "good<br />

character" shall be determined in part from "the fingerprinting <strong>of</strong> all applicants with<br />

a search <strong>of</strong> local, state, and national fingerprint records." Pursuant to the<br />

administrative rules, law enforcement agencies must obtain the fingerprints <strong>of</strong> all<br />

applicants prior to employment with their law enforcement agency. The "law<br />

enforcement applicant" must be printed and two fingerprint cards submitted. These<br />
