Probation and Parole Arrests<br />

<strong>Identification</strong> Photos<br />

State Penal and Correctional Institutions<br />

State penal and correctional institutions are required under Wis. Stats. 165.84(4) to<br />

"obtain fingerprints, according to the fingerprint system <strong>of</strong> identification established<br />

by the director <strong>of</strong> the FBI, and full face and pr<strong>of</strong>ile photographs <strong>of</strong> all persons<br />

received on commitment to these institutions. The prints and photographs so taken<br />

shall be forwarded to the division, together with any other identifying data requested,<br />

within 10 days after the arrival at the institution <strong>of</strong> the person committed."<br />

In these instances the only entry needed is "custody", the reason for the custody in<br />

the charge area, and in the disposition area the period <strong>of</strong> detention.<br />

When an individual is arrested or taken into custody for a parole or probation<br />

violation at the request <strong>of</strong> a probation/parole <strong>of</strong>ficer, the charge block must properly<br />

reflect the specific literal charge, statute number and NCIC code, e.g.:<br />

• Parole Violation, 304.06, NCIC 5011<br />

• Probation Violation, 973.10, NCIC 5012<br />

Do not indicate the <strong>of</strong>fense for which the person is on probation/parole or the <strong>of</strong>fense<br />

which necessarily caused the violation, (the <strong>of</strong>fense that caused the violation should<br />

be processed as a separate arrest transaction, if that was the case). The final<br />

disposition area should indicate that the individual was "turned over to"<br />

probation/parole.<br />

FINAL DISPOSITION REPORTS ARE NOT REQUIRED FOR<br />

PROBATION/PAROLE ARRESTS, THE FINAL DISPOSITION ON THESE<br />

ARRESTS IS ALWAYS, "TURNED OVER TO (TOT) PROBATION/PAROLE."<br />

<strong>Wisconsin</strong> Stats. 165.84(4) require that:<br />

"All persons in charge <strong>of</strong> state penal and correctional institutions shall obtain<br />

fingerprints, according to the fingerprint system <strong>of</strong> identification established by the<br />

director <strong>of</strong> the FBI, and full and pr<strong>of</strong>ile photographs <strong>of</strong> all persons received on<br />

commitment to these institutions. The prints and photographs so taken shall be<br />

forwarded to the division, together with any other identifying data requested, within<br />

10 days after the arrival at the institution <strong>of</strong> the person committed. Full length<br />

photographs in release dress shall be taken immediately prior to the release <strong>of</strong> such<br />

persons from these institutions. Immediately after release, these photographs shall<br />

be forwarded to the division."<br />

When photographs are submitted it is essential that the contributing institution<br />

identify the photograph by printing legibly on the back <strong>of</strong> the photo the individual's<br />

name, sex, race, date <strong>of</strong> birth, and SID number (if known). This procedure will<br />

ensure placement <strong>of</strong> the photograph in the correct identification file.<br />
