It is my opinion that sec. 48.26, Stats., would not prohibit the local agency or the<br />

Law Enforcement Services Division from utilizing the information contained therein<br />

in reporting statistical information to the public which does not disclosed the identity<br />

<strong>of</strong> the child or children involved.<br />

A fingerprint card submitted to CIB indicating the subject is a juvenile but is<br />

checked treat as an adult will cause the disposition to be left open waiting for a<br />

disposition from the court.<br />

A fingerprint card submitted to CIB indicating the subject is a juvenile without an<br />

indicator to treat as an adult will automatically default to a disposition <strong>of</strong> turned<br />

over to juvenile authorities. The booking agency should still obtain and complete a<br />

disposition form, including the ATN, at the time <strong>of</strong> booking should the juvenile be<br />

subject to waiver at a later time. Local policy between the booking agency,<br />

prosecutor and court should determine whether the booking agency hold the<br />

disposition pending waiver or forward with the case file. If the subject is waived, the<br />

disposition should follow the case through court to eventually be reported to CIB.<br />

When the court submitted disposition is received by CIB, the submitted court<br />

disposition will be used to overwrite the automatically applied juvenile disposition.<br />

If the juvenile is not waived the disposition should be destroyed. This process<br />

eliminates the need for the booking agency to notify CIB independently that a<br />

juvenile has been waived.<br />

<strong>Wisconsin</strong> law does not permit the submission <strong>of</strong> juvenile fingerprint cards to the<br />

FBI unless the juvenile has been waived.<br />

Jail intake fingerprint cards are accepted through electronic submissions using live<br />

scan or card scan equipment. The submission type that should be used is “JL” and<br />

not “AR” for arrest. The intake card should include the charge statute and literal,<br />

and the length <strong>of</strong> sentence to be served.<br />

Jail intake cards that are contributed by mail should indicate “JAIL INTAKE” in the<br />

“additional information” or “disposition” field. The intake card should include the<br />

Jail intake cards for individuals that are being held for or turned over to another<br />

<strong>Wisconsin</strong> agency should not be submitted. The originating agency should be<br />

contributing the arrest record.<br />

Those agencies booking subjects arrested on warrants for other states (UCEA), or on<br />

federal charges should contribute a fingerprint card to CIB as a jail intake<br />

(submission type “JL”) Please include the charge, and the agency the individual is<br />

being turned over to.<br />

Individuals being housed temporarily or in transit for federal agencies may also be<br />

contributed to the Crime Information Bureau.<br />

When submitting disposition or sentencing information on jail intake cards, it is<br />

important to remember that the disposition date reported cannot occur prior to the<br />

arrest date. Either the original arrest date should be reported with the date <strong>of</strong> the<br />

court sentence or the disposition date reported on the submission should be the same<br />

as the date <strong>of</strong> jail intake as indicated in the date <strong>of</strong> arrest field.<br />
