It is my opinion that sec. 48.26, Stats., would not prohibit the local agency or the
Law Enforcement Services Division from utilizing the information contained therein
in reporting statistical information to the public which does not disclosed the identity
of the child or children involved.

A fingerprint card submitted to CIB indicating the subject is a juvenile but is
checked treat as an adult will cause the disposition to be left open waiting for a
disposition from the court.
A fingerprint card submitted to CIB indicating the subject is a juvenile without an
indicator to treat as an adult will automatically default to a disposition of turned
over to juvenile authorities. The booking agency should still obtain and complete a
disposition form, including the ATN, at the time of booking should the juvenile be
subject to waiver at a later time. Local policy between the booking agency,
prosecutor and court should determine whether the booking agency hold the
disposition pending waiver or forward with the case file. If the subject is waived, the
disposition should follow the case through court to eventually be reported to CIB.
When the court submitted disposition is received by CIB, the submitted court
disposition will be used to overwrite the automatically applied juvenile disposition.
If the juvenile is not waived the disposition should be destroyed. This process
eliminates the need for the booking agency to notify CIB independently that a
juvenile has been waived.
Wisconsin law does not permit the submission of juvenile fingerprint cards to the
FBI unless the juvenile has been waived.
Jail intake fingerprint cards are accepted through electronic submissions using live
scan or card scan equipment. The submission type that should be used is “JL” and
not “AR” for arrest. The intake card should include the charge statute and literal,
and the length of sentence to be served.
Jail intake cards that are contributed by mail should indicate “JAIL INTAKE” in the
“additional information” or “disposition” field. The intake card should include the

Jail intake cards for individuals that are being held for or turned over to another
Wisconsin agency should not be submitted. The originating agency should be
contributing the arrest record.
Those agencies booking subjects arrested on warrants for other states (UCEA), or on
federal charges should contribute a fingerprint card to CIB as a jail intake
(submission type “JL”) Please include the charge, and the agency the individual is
being turned over to.
Individuals being housed temporarily or in transit for federal agencies may also be
contributed to the Crime Information Bureau.
When submitting disposition or sentencing information on jail intake cards, it is
important to remember that the disposition date reported cannot occur prior to the
arrest date. Either the original arrest date should be reported with the date of the
court sentence or the disposition date reported on the submission should be the same
as the date of jail intake as indicated in the date of arrest field.
