Literal wording that indicates domestic abuse should be included with the <strong>of</strong>fense<br />

literal. The following abbreviations can be used to indicate domestic abuse:<br />

CIB has created an in-house modifier statute that equals domestic abuse - 968. That<br />

statute may also be included with the primary <strong>of</strong>fense statute.<br />

Examples <strong>of</strong> <strong>of</strong>fenses including domestic abuse:<br />

• Batt/DV 940.19 (1) / 968.<br />

• DC-DAC 947.01/968.<br />

• Dom Abuse/DC 968./947.01<br />

Statute 968.075 (5) (a)<br />

There is only one arrest statute within the Domestic Abuse Law. Statute 968.075 (5)<br />

(a) is indicated for an arrest when an individual has violated the 72 hour no contact<br />

provision. Under this circumstance, the <strong>of</strong>fender should have been fingerprinted for<br />

the original charge which included domestic violence. The additional information<br />

block on the card should indicate that this new charge is a violation <strong>of</strong> the 72 hour no<br />

contact provision. Without an explanation to verify that this <strong>of</strong>fense is a violation<br />

under the 72 hour no contact provision, the card will be returned to the contributing<br />

agency for clarification <strong>of</strong> the arrest charge. When an individual is in violation <strong>of</strong><br />

the 72 hour no contact violation, complete the <strong>of</strong>fense section <strong>of</strong> the arrest card as<br />

follows:<br />

• Domestic Abuse Contact Vio 968.075 (5) (a)<br />

The additional information block should indicate that this arrest is in violation <strong>of</strong> the<br />

72 hour no contact provision.<br />

Traffic Arrests<br />

Crime Information Bureau will accept fingerprint cards for both felony and nonfelony<br />

traffic <strong>of</strong>fenses. Final disposition reports for non-felony traffic <strong>of</strong>fense are<br />

not accepted. Disposition information for these <strong>of</strong>fenses is available from the<br />

<strong>Department</strong> <strong>of</strong> Transportation.<br />

Fingerprinting Juveniles<br />

Section 165.83(2), Stats., requires the Law Enforcement Services Division (Crime<br />

Information Bureau) <strong>of</strong> the <strong>Department</strong> <strong>of</strong> <strong>Justice</strong> to obtain and file fingerprints,<br />

descriptions, photographs, and other available identifying data on "persons" who<br />

have been arrested or taken into custody in this state for violation <strong>of</strong> <strong>of</strong>fenses set<br />

forth in subsection (2)(a). Local law enforcement agencies are to cooperate and<br />
