Only those officers that have successfully completed a PIT training course at<br />

OPOTA and are certified may use the technique. The considerations used in<br />

determining if PIT shall be used are as follows:<br />

The fleeing vehicle must be stopped to preserve life or for the safety of<br />

the public.<br />

The need to apprehend the suspect outweighs the specific risks<br />

involved. Consider the risk to everyone involved. Officers need to<br />

understand that a deliberate contact to another vehicle does constitute a<br />

Fourth Amendment seizure.<br />

The officer(s) involved need to constantly evaluate the existing<br />

circumstances to determine if the use of PIT or any other technique is<br />

reasonable.<br />

The <strong>New</strong> <strong>Albany</strong> Police Department considers the use of PIT to be a less than<br />

lethal maneuver, equal to that of the use of a baton. Therefore, the Police<br />

Department will allow certified officers to make individual decisions on its use<br />

given the circumstances at the time and approval from the on duty supervisor.<br />

The PIT should not be performed at speeds above 45 mph. Factors to consider<br />

should always include:<br />

Time of day<br />

Traffic<br />

Environment<br />

Innocent occupants<br />

Roadway contour<br />

Type of violator vehicle<br />

Need for immediate apprehension<br />

Officer’s training and skill level.<br />

After the PIT has been deployed and the pursuit has ended, the scene shall be<br />

secured. All the events of the pursuit shall be documented on the appropriate<br />

pursuit report (PD-99-109) (Addendum C).<br />

The PIT maneuver shall not be used on the following vehicles unless deadly<br />

force is justified:<br />

Hi-ride pick-up trucks<br />

Full size vans<br />

Busses<br />

Motorcycles<br />

Vehicles with a high center of gravity<br />

Vehicles significantly out-sizing or out-weighing the cruiser used<br />

4. Use of Deadly Force/Firearms<br />

a. Police officers will only use deadly force in the following circumstances<br />

(see Directives 1.1.2 and 1.1.3):<br />
