Members of the <strong>Ohio</strong> General Assembly, the Executive Secretary of the House, the<br />

Legislative Clerk of the House, Clerks, Sergeants at Arms, Doorkeepers, and<br />

Messengers of the Senate and House of Representatives of the State of <strong>Ohio</strong> are<br />

immune from arrest during sessions of the General Assembly and while traveling to and<br />

from such sessions.<br />

D. Foreign Diplomats/Consular Officials<br />

Diplomatic immunity, a principle of international law, is broadly defined as the freedom<br />

from local jurisdictional laws/ordinances accorded to duly accredited foreign diplomats. A<br />

foreign diplomat includes diplomatic officers, their families, official staff, and servants who<br />

are not nationals of, nor permanently residing in, the receiving state. Ambassadors and<br />

Ministers are the highest ranking diplomatic representatives of a foreign government.<br />

Foreign diplomats are immune from arrest. However, foreign diplomats may be issued<br />

traffic citations for minor violations because these do not constitute a detention.<br />

Additionally, a foreign diplomat’s operator’s license may be revoked by the United States<br />

Department of State for continuous/multiple traffic violations. A foreign diplomat may be<br />

temporarily detained in situations endangering the public health and safety. For example,<br />

a foreign diplomat observed driving under the influence of alcohol may be stopped. The<br />

officer may find an alternate means of transportation but may not arrest this individual.<br />

Foreign nationals are unnaturalized citizens currently residing in the United States on a<br />

long term basis. Foreign nationals have no diplomatic immunity and may be cited,<br />

detained or arrested by officers of the Police Department. However, if a foreign national<br />

is taken into custody and requests that his/her government be notified, the on duty<br />

supervisor shall make arrangements to notify the respective Consulate or Embassy.<br />

Consular officials are foreign nationals sent by a government to perform consular<br />

functions. The notification procedures/rules that apply to a foreign national also apply<br />

to any consular official.<br />

E. Military Personnel<br />

Military personnel include members of the Army, Navy, Air Force, Marine Corp.,<br />

Coast Guard, National Guard, and Reservists who are on active duty.<br />

Military personnel may be subject to the issuance of a citation for traffic law violations.<br />

These situations do not constitute an arrest or detention.<br />

When a civilian or active duty member of the armed forces is involved in a traffic crash<br />

which results in hospitalization or death of the member, the on duty shift supervisor or<br />

his/her designee will notify the appropriate military service branch or the American Red<br />

Cross.<br />

When a physical arrest of an active duty member of the armed forces is made, the on<br />

duty shift supervisor or his/her designee will notify the liaison officer of the nearest<br />

military service branch.<br />

In any situation where United States Government property is seized, towed, impounded,<br />

or confiscated, the appropriate branch of government will be notified by the on duty shift<br />

supervisor or his/her designee.<br />

2.1.3 Informing the Violator<br />

A. When a motorist is charged with a traffic violation, the officer issuing the citation shall<br />

provide the violator with a copy of the Uniform Traffic Citation. The citation shall indicate<br />

the date, time, and location for the scheduled court appearance. In addition, each<br />

violator shall be given a fine schedule/court information envelope from the <strong>New</strong> <strong>Albany</strong><br />

Mayor’s Court (as applicable).<br />
