additional personnel for riot, insurrection, disasters, or other emergencies upon request of<br />

the Mayor or City Manager of the City of <strong>New</strong> <strong>Albany</strong>.<br />

B. Agencies providing personnel have the legal authority to act within the receiving agency's<br />

jurisdiction under a Mutual Aid Compact pursuant to one or more of the following <strong>Ohio</strong><br />

Revised Codes: §311.29, §505.43, §737.04, and §3345.041.<br />

C. The on-duty supervisor (usually a Sergeant) has the authority in requesting and approving<br />

matters of mutual aid on behalf of the Chief of Police. The supervisor may request<br />

mutual aid from or grant mutual aid to any compact agency.<br />

D. The supervisor will assess the extent of manpower and/or equipment available before<br />

committing resources to the requesting agency. This authority is extended to short-term,<br />

emergency situations which require immediate action on the part of law enforcement.<br />

E. In the event a compact agency requests resources that are later found to require<br />

extensive overtime, personnel, or equipment, the Chief of Police shall be notified to<br />

authorize such requests. This section does not prevent a supervisor from initially sending<br />

personnel, resources, and/or equipment to a mutual aid scene when requested.<br />

F. Per the Mutual Aid Compact, responding outside agencies will report to the on-duty<br />

supervisor or his/her designee.<br />

G. Where mutual aid is utilized, radio communication shall be established through the use of<br />

LEERN radio or other commonly shared frequencies such as suburban talk groups on the<br />

MARCS system.<br />

H. Per the Mutual Aid Compact, there shall be no reimbursement for loss or damaged<br />

equipment while participating in mutual aid activities, nor shall there be any<br />

reimbursement by the requesting agency for Worker's Compensation for injury or death to<br />

a member of the <strong>New</strong> <strong>Albany</strong> Police Department. Said benefits or reimbursements shall<br />

be the responsibility of the City of <strong>New</strong> <strong>Albany</strong>.<br />

I. Per the Mutual Aid Compact, the agreement shall be in effect for a period of three years<br />

and shall be automatically renewed for successive three year periods. Mutual Aid<br />

Compacts may be withdrawn by either party upon written notice as established in the<br />

contract.<br />

16.1.4 Requesting Federal Assistance<br />

Upon request and approval by the Chief of Police (or his/her designee), the Mayor or City<br />

Manager will appeal to the Governor's Office to request National Guard assistance in case of<br />

disaster and/or emergency.<br />

In the event of an emergency that requires Federal law enforcement assistance, the Chief of<br />

Police or the highest ranking on-duty supervisor is authorized to solicit aid from the appropriate<br />

Federal agency. This section does not preclude the <strong>New</strong> <strong>Albany</strong> Police Department from utilizing<br />

Federal services in the normal course of interagency cooperation and joint functional<br />

responsibilities.<br />

16.1.5 Private, Non-governmental Security Agencies – Cooperation/Assistance<br />

Due to the demographics of <strong>New</strong> <strong>Albany</strong>, several private security agencies operate within the City<br />

limits. Examples of private security agencies operating within <strong>New</strong> <strong>Albany</strong> include The Limited<br />

Office of Protective Operations, <strong>New</strong> <strong>Albany</strong> Properties Security, private building security forces of<br />

large area businesses (Aetna Insurance, Novus Discover Card, Abercrombie and Fitch, etc.), and<br />

private personal security for high profile residents who live in the City. The <strong>New</strong> <strong>Albany</strong> Police<br />
