The responding supervisor will also notify the Chief of Police as soon as<br />

possible. The Chief of Police will be responsible for following up with the<br />

accused officer’s Chief of Police, as necessary.<br />

C. Post-Incident Administrative and Criminal Decisions and Investigations<br />

The Police Department will observe all necessary protocols to ensure an accused<br />

officer’s departmental, union, and legal rights are upheld during the administrative and/or<br />

criminal investigations.<br />

1. Administrative Decisions and Investigations<br />

The responsibility to complete the administrative investigation of a police officer<br />

domestic violence incident shall rest with the accused officer’s supervisor or an<br />

investigator designated by the Chief of Police.<br />

The investigating official shall conduct the administrative investigation<br />

utilizing standard elements of criminal investigations. Witness(es) shall<br />

be contacted, re-interviewed, and statements recorded; crime scene<br />

evidence, photographs and medical records assessed; emergency call<br />

recordings requested; and all information fully documented.<br />

Where sufficient information exists, the Police Department shall take<br />

immediate administrative action, which may include removal of badge,<br />

removal of weapon, reassignment and/or administrative leave (with or<br />

without pay).<br />

Where an arrest was not made, but sufficient cause to believe an<br />

employee violated a directive or code of conduct, the Chief of Police may<br />

initiate an administrative investigation to determine if disciplinary action is<br />

warranted.<br />

2. Criminal Decisions and Investigations<br />

The responsibility to complete a criminal investigation of an incident of police<br />

officer domestic violence shall rest with the assigned officer or detective.<br />

The investigating official shall conduct the criminal investigation utilizing<br />

standard elements of any criminal investigation. Witnesses shall be<br />

contacted, re-interviewed, and statements recorded; crime scene<br />

evidence, photographs and medical records assessed; emergency call<br />

recordings requested; and all information fully documented.<br />

When appropriate, the investigating official shall conduct sufficient<br />

interviews (recorded) to support criminal charges, to include family<br />

members, friends, neighbors, colleagues, or others who may have<br />

information in accordance with the officer and victim’s privacy rights.<br />

Even though an initial report may already exist concerning a police<br />

officer, if the victim reports any subsequent or additional criminal activity,<br />

each incident shall be documented separately, assigned a case number,<br />

and investigated thoroughly.<br />

The department shall completely investigate the charges and where<br />

probable cause exists, seek prosecution, even if the victim recants the<br />

charges.<br />
