If a weapon was used, threatened, or brandished, that weapon will be<br />

treated as contraband and seized as evidence. The weapon will be<br />

released only pursuant to a court order.<br />

6. In cases where officers determine that domestic violence charges will be filed,<br />

the victim’s injuries will be photographed (digital). In addition, offender<br />

photographs are taken during the booking process.<br />

7. Furnish the victim with the following:<br />

Responding officers’ names and badge numbers<br />

The report number<br />

Copies of the Attorney General’s “Rights and Responsibilities as a Crime<br />

Victim” booklet and the “Misdemeanor Crime Victims Services” brochure<br />

The availability of filing a TPO or CPO<br />

8. If the offender has a previous domestic violence conviction or if the officer wants<br />

the incident investigated for possible upgrade to a felony, file a warrant charging<br />

the offender with misdemeanor domestic violence and submit a request to the<br />

prosecutor for an upgrade of the charges.<br />

9. Pursuant to <strong>Ohio</strong> Revised Code §1905.01(E1), a Mayor’s Court cannot hear<br />

domestic violence or TPO/CPO cases. All charges will be filed through Franklin<br />

County Municipal Court or Licking County Municipal Court, as appropriate.<br />

B. Domestic violence calls with only the victim at the scene<br />

14.2.5 Protection Orders<br />

When handling calls of this type, officers shall adhere to the procedures outlined in<br />

Directive 14.2.4 (A) 5-9. In addition:<br />

1. If probable cause is present, complete a complaint affidavit for the arrest of the<br />

offender. Promptly have the complaint notarized and charges filed.<br />

2. Air information to area law enforcement agencies concerning the offender,<br />

including his/her physical description, any possible destination or direction of<br />

travel, and vehicle information.<br />

A. When a domestic violence charge is filed, the complainant, or arresting officer if the<br />

victim is unable, may file a motion for a Criminal Temporary Protection Order (TPO). The<br />

victim, the officer filing the motion, witness advocate or other victim advocate must then<br />

appear for a hearing in Franklin County Municipal Court or Licking County Municipal<br />

Court (as appropriate) on the next court day. If the victim is unable to appear due to<br />

hospitalization or medical condition, another individual with information related to the<br />

filing may appear on the victim’s behalf.<br />

B. The victim may request a Civil Protection Order (CPO) through the Franklin County or<br />

Licking County Courts of Domestic Relations if a criminal charge is not filed. The victim<br />

may be advised to consult private legal counsel or may be referred to the Legal Aid<br />

Society.<br />

C. The Dispatch Center maintains a file of active TPOs, CPOs, and SPOs (Anti-Stalking<br />

Protection Orders). Officers must verify the existence and terms of Protection Orders by<br />

contacting the Dispatch Center before taking any enforcement action(s).<br />
