<strong>New</strong> <strong>Albany</strong> Police Department<br />

Directive 13.2 – Forfeiture of Property<br />

13.2.1 Purpose<br />

The <strong>New</strong> <strong>Albany</strong> Police Department, pursuant to law as required by Sections §2923.32 and 2925.42 of<br />

the <strong>Ohio</strong> Revised Code, has adopted the following Directive as the written Internal Control Policy for<br />

recording the custody of property subject to seizure and the receipt and expenditure of proceeds<br />

received from Court order forfeiture of criminal assets and mandatory drug fines.<br />

13.2.2 Custody of Property<br />

A. All items of property subject to forfeiture kept in the possession of the <strong>New</strong> <strong>Albany</strong> Police<br />

Department shall be recorded manually on a Property Record form (PD-99-163) and<br />

electronically in the Records Management System (CAD/RMS).<br />

B. Such entries shall list and include: Item(s) subject to forfeiture in the possession of the<br />

<strong>New</strong> <strong>Albany</strong> Police Department; Date that the item(s) came into possession; Manner of<br />

Disposition of item(s); and, if applicable, the Name of the person who received the<br />

item(s).<br />

C. Written receipts shall be required for all acceptance and transfers of property coming into<br />

or leaving the possession of the Police Department.<br />

D. Under no circumstances shall the Property Record reveal relevant information that may<br />

compromise an ongoing investigation.<br />

E. A cumulative record of all transactions of such property subject to forfeiture recorded in<br />

each calendar year shall be sent to the <strong>Ohio</strong> Attorney General no later than March 1 st of<br />

the next ensuing year. Such cumulative record shall include all information contained<br />

under “B” of this section.<br />

13.2.3 Receipts of Proceeds – Law Enforcement Fund (Seizure Fund)<br />

A. All monies ordered deposited or proceeds from the sale of forfeited assets directed by the Court<br />

for use by the <strong>New</strong> <strong>Albany</strong> Police Department shall be promptly recorded both manually and<br />

electronically by the property room custodian in a log reflecting deposits into the Law<br />

Enforcement Fund (Seizure Fund) established by the Finance Director.<br />

B. The log of deposits into the Law Enforcement Fund (Seizure Fund) shall be accurately kept and<br />

shall include the amount of the proceeds received and the date of receipt. All monies shall be<br />

deposited into the Law Enforcement Fund (Seizure Fund) as provided by law.<br />

13.2.4 Expenditures of Proceeds<br />

A. Proceeds used from the Law Enforcement Fund (Seizure Fund) shall not be used for operating<br />

costs but shall be expended in the furtherance of investigation and prosecution of criminal cases<br />

in <strong>New</strong> <strong>Albany</strong>, <strong>Ohio</strong> within the following general expenditure categories:<br />

Equipment, investigation and prosecution costs of criminal cases.<br />

Costs of training and providing technical expertise.<br />

Application toward Federal matching funds.<br />
