1.1.7 Reporting Uses of Force<br />

A. <strong>New</strong> <strong>Albany</strong> Police Department Officers will complete a Response to Resistance Report<br />

(PD-99-209) (Addendum C) and a Discharge of Firearms Report (PD-99-210) (Addendum<br />

D) when he/she has deliberately or accidentally discharged a firearm on or off duty.<br />

Officers are not required to complete a Discharge of Firearms Report during supervised<br />

training, target practice, or sport/recreational shooting. Discharge of Firearms Report will<br />

not be required if a firearm is used in the destruction of an animal. (See Directive 1.1.3<br />

(D)). Additional details of all incidents involving Response to Resistance and/or<br />

Discharge of Firearms reports shall be documented on an <strong>Ohio</strong> Uniform Incident Report<br />

(PD-03-100). This section is critical to the department’s standing in the community and<br />

aids the dynamics of policy and training needs.<br />

B. <strong>New</strong> <strong>Albany</strong> Police Department Officers will complete a Response to Resistance Report<br />

(PD-99-209) when:<br />

Action is taken resulting in or allegedly resulting in injury or death of another<br />

individual.<br />

Force is applied through the use of lethal or less-than-lethal weapons to include:<br />

kicking, knee strikes, punching, elbow strikes, wrestling with subject, joint<br />

manipulations, pressure points, balance displacement, chemical irritant, ASP<br />

Tactical Baton, or any weapon of opportunity.<br />

Physical force, as defined in Directive 1.1.1(A), is applied and results in an injury or<br />

claimed injury.<br />

C. Officers are required to complete a Response to Resistance Report and/or a Discharge<br />

of a Firearm Report by the end of the shift, or as soon as practical, depending on the<br />

physical and mental condition of the officer(s) after the incident. If the officer(s) is injured<br />

or unable to make the report, the officer’s supervisor will submit a written report within a<br />

reasonable length of time.<br />

D. The on-duty supervisor(s) shall be notified, as soon as practical, following the incident. In<br />

cases of serious injury or incidents involving the intentional discharge or use of a<br />

weapon, the on-duty supervisor will notify his/her immediate supervisor. The chain of<br />

command will be followed so that the Chief of Police and the City Manager are notified as<br />

soon as practical.<br />

E. A complete investigation will be conducted into any intentional or accidental discharge of<br />

a firearm or deadly response by an officer in the line of duty. This does not apply to<br />

supervised training, target practice, or sport/recreational shooting. Initial on-scene<br />

investigation by the on-duty supervisor will include (at a minimum) the following:<br />

The shift supervisor shall secure the scene and ascertain the facts and<br />

circumstances surrounding the incident.<br />

The supervisor at the scene shall secure the weapon(s) used in the incident and all<br />

ammunition, as soon as practical. The items should be handled as evidence and<br />

marked accordingly. If appropriate, arrangements should be made to issue the<br />

officer(s) involved another weapon.<br />
