Step 5: All records entered by the agency into the LEADS and NCIC files shall be<br />
cancelled and the agency will not be permitted entry capabilities. This shall<br />
remain in effect until recommendation by the LEADS steering committee and<br />
authorization of the CTO is obtained to reinstate access for the agency. If the<br />
situation is not corrected, including documentation to LEADS within thirty (30)<br />
days, step 6 will be initiated.<br />
Step 6: The agency's access to the <strong>Ohio</strong> Bureau of Motor Vehicles files shall be<br />
terminated. If the agency continues to fail to correct and document their actions<br />
with the LEADS within thirty days (30), step 7 will be initiated.<br />
Step 7: The agency shall no longer be permitted to participate in the LEADS. All terminal<br />
equipment will be removed. The agency shall remain responsible for any unpaid<br />
fees due LEADS to this date. The agency shall not be approved terminal access<br />
until reviewed by the LEADS steering committee and approval of the CTO. The<br />
agency may institute a non-terminal user agreement with LEADS, but this shall<br />
be limited to inquiry capabilities only and excludes access to the criminal history<br />
and NCIC III files.<br />
Exceptions to the progressive sanction process may be authorized by the LEADS steering<br />
committee chairperson if in his/her opinion, circumstances warrant such action. As with any<br />
sanction, there is a right of appeal to be heard by the LEADS steering committee. This process is<br />
not under adjudication procedures (Chapter 119 of the <strong>Ohio</strong> Revised Code).<br />
B. Employee Sanctions<br />
The <strong>New</strong> <strong>Albany</strong> Police Department has established the following progressive discipline<br />
process to enforce rules that comply with the LEADS.<br />
If an employee of the <strong>New</strong> <strong>Albany</strong> Police Department inadvertently runs incorrect<br />
information via the LEADS/NCIC computer (i.e.- accidentally ran wrong license plate or<br />
driver information, ran valid information for training, or inadvertently sent a TT to an<br />
unauthorized or wrong agency,) the ISO (Information Security Officer - TAC) will<br />
counsel the employee to correct the LEADS violation. If the employee continues these<br />
violations after being counseled, he/she will once again be counseled and shall receive<br />
progressive discipline (see Directive 5.1.2).<br />
If an employee of the <strong>New</strong> <strong>Albany</strong> Police Department intentionally runs information via<br />
the LEADS/NCIC computer for personal use (i.e.- driver’s license information, license<br />
plate information, warrant information, CCH, etc.,) it shall be recommended to the Chief<br />
of Police to place this employee under suspension (see Directive 5.1.2). The severity of<br />
the LEADS violation will determine the time length of the suggested suspension. The ISO<br />
will prepare an incident report on the event and forward to LEADS Security. LEADS<br />
Security will determine whether or not criminal charges will be filed against the employee.<br />
If an employee runs this illegal information for an officer (or other employee) and that<br />
employee is unaware the officer's (or other employee's) purpose, the employee will be<br />
counseled but will not be held fully accountable.<br />
If an employee of the <strong>New</strong> <strong>Albany</strong> Police Department intentionally runs information via<br />
the LEADS computer and sells or gives this information to non-police personnel for<br />
personal or business use, it will be the recommendation to the Chief of Police and City<br />
Manager for this employee to be terminated from his/her position. The ISO will prepare<br />
an incident report on the event and forward to LEADS Security. LEADS Security will<br />
determine whether or not criminal charges will be filed against the employee.<br />
If an employee of the <strong>New</strong> <strong>Albany</strong> Police Department intentionally modifies or destroys<br />
system data, causes loss of computer system processing capability, or causes loss of<br />
any computer system media including: chip ROM memory, optical or magnetic storage<br />
medium, hardcopy printout, etc., it will be recommended to the Chief of Police and City<br />
Manager to have the employee terminated from the department. The ISO will prepare an<br />
