5.3.29 Reporting for Duty/Tardiness<br />
An employee shall report for duty on time, properly prepared and equipped for his/her assignment<br />
so that he/she may immediately assume duties. Judicial subpoenas and special duty<br />
assignments shall constitute an order to report for duty under this section. It is the employee’s<br />
responsibility to report any anticipated tardiness to his/her immediate supervisor and/or the on<br />
duty supervisor prior to his/her reporting time, along with an estimated time of arrival. If a<br />
supervisor cannot be reached, a message may be left with department personnel who will<br />
forward the information to the appropriate supervisor as soon as possible. If circumstances<br />
prevent the employee from reporting his/her tardiness before the scheduled shift, it is the<br />
responsibility of the employee to make contact with the Department as soon as possible. If an<br />
employee has not reported for scheduled duty or has not reported that he/she will be tardy, the on<br />
duty supervisor will attempt to contact the employee as soon as practical and ascertain the<br />
reason for his/her failure to report for duty. Repeated acts of tardiness will be grounds for<br />
progressive disciplinary action(s).<br />
5.3.30 Reporting Misconduct<br />
Departmental personnel having knowledge of another employee’s misconduct shall report it to<br />
the Chief of Police through the chain of command. Misconduct includes any violation(s) of law,<br />
ordinance, directive, personnel rule, or the disobedience of orders.<br />
5.3.31 Requirement to Submit to Medical Exams, Line-Ups, Photographs, and<br />
Polygraphs<br />
Upon the order of the Chief of Police or his/her designee, employees of the Police Department<br />
shall submit to any medical, ballistic, chemical or other test(s), photographs, or line-ups.<br />
Pursuant to Codified Ordinance 155.28(h)(non-union employees) and CBA Article 9 (sworn<br />
members of the union), an employee may be required to submit to a polygraph examination or<br />
similar testing procedure. All procedures carried out under this section shall be directly related to<br />
an Internal Affairs investigation and shall conform to all federal and/or state laws.<br />
5.3.32 Sick/Injury Reporting<br />
Employees shall not feign illness or injury, falsely report or have themselves falsely reported ill<br />
or injured, or otherwise deceive or attempt to deceive any other employee regarding their health.<br />
5.3.33 Telephone/Address<br />
An employee shall maintain a telephone (residential and/or cellular) in his/her residence and shall<br />
report any change in telephone number(s) or address in writing to his/her supervisor within 48<br />
hours. Residential telephone numbers, cellular telephone numbers, and/or residential addresses<br />
of Departmental personnel are required to be on file with the Department and shall not be<br />
released to anyone outside the Department without the employee’s consent.<br />
5.3.34 Truthfulness<br />
Employees shall speak the truth at all times whether under oath or not. An exception would be if<br />
deception is necessitated as a result of an employee’s participation in an authorized undercover<br />
investigation or interview of a criminal suspect.<br />
5.3.35 Unbecoming Conduct<br />
Departmental personnel, both on and off duty, shall conduct themselves in such a manner as to<br />
reflect favorably on the Police Department. Unbecoming conduct includes behavior that brings<br />
the Police Department or City of <strong>New</strong> <strong>Albany</strong> into disrepute or reflects discredit upon the<br />
individual as a member of the <strong>New</strong> <strong>Albany</strong> Police Department or which impairs the operation or<br />
efficiency of the Police Department or the individual. This includes, but is not limited to,<br />
