impaired by prescribed or over-the-counter drugs. Departmental personnel are not to bring<br />

intoxicants or illegal drugs into police buildings, vehicles, or onto any City property except as<br />

required in the line of duty.<br />

Pursuant to CBA Article 18, sworn members of the union shall be tested for alcohol or illegal drug<br />

usage when there is reasonable belief that his/her work performance is adversely affected. Sworn<br />

members of the union may also be tested for alcohol or illegal drugs on a random basis or after<br />

an at fault traffic crash (see Directive 5.2.3).<br />

5.3.12 Endorsements and Referrals<br />

Departmental personnel are not to permit their photographs or names to be used to endorse<br />

products or services if their endorsement refers to their employment with the Police Department<br />

without the prior written permission from the Chief of Police. While on duty, employees shall<br />

not recommend or suggest the employment or procurement of a particular product,<br />

professional or commercial service.<br />

5.3.13 Ethics<br />

No employee shall conspire or knowingly engage in any activity which deprives any person of<br />

his/her civil rights, due process, equal opportunity for employment, advancement, job<br />

opportunities, or any constitutional or statutory right.<br />

5.3.14 Expenditures of Department Funds<br />

No expenditures of money or financial obligations are to be incurred in the name of the<br />

Department by Departmental personnel without prior authorization from the Chief of Police.<br />

All requests to expend money shall be made on a <strong>New</strong> <strong>Albany</strong> Requisition Form and approved by<br />

the Finance Director prior to the expenditure of funds.<br />

5.3.15 Gambling/Prohibited Establishments<br />

Employees of the Police Department shall not engage or participate in any form of illegal<br />

gambling as set forth in Chapter §2915 of the <strong>Ohio</strong> Revised Code, except in official departmental<br />

investigations. Department personnel are not to knowingly visit or enter a house of prostitution,<br />

gambling house, or establishment wherein the laws of the United States, the State, or local<br />

jurisdiction are regularly violated, except in official Departmental investigations.<br />

5.3.16 Gratuities<br />

Departmental personnel are prohibited from soliciting or accepting from any person, business, or<br />

organization, any tangible or intangible property, promise, or service, or in any way use their<br />

official position, if it may be reasonably inferred that such action benefits their private interests in<br />

conflict with their police duties and responsibilities. All unauthorized gifts, gratuities, loans, fees,<br />

or rewards coming into the possession of Departmental personnel will be placed in the property<br />

room. A letter of explanation will be forwarded to the Chief of Police who will determine the item’s<br />

appropriate disposition.<br />

5.3.17 Identifying Informants<br />

Departmental personnel are not to divulge the identity of persons giving confidential information<br />

to the Department except as directed by the Chief of Police.<br />

5.3.18 Immoral Conduct<br />

In keeping with the core values of the <strong>New</strong> <strong>Albany</strong> Police Department, personnel shall exhibit the<br />

highest standards of moral conduct in their personal and business affairs.<br />
