Directive 5.3 - Rules of Conduct<br />
In addition to those acts, behaviors, and/or conduct specifically listed in Codified Ordinance 155.26(a) and<br />
in the City’s Policy and Procedure Manual, the following Rules of Conduct have been developed for <strong>New</strong><br />
<strong>Albany</strong> Police Department personnel:<br />
5.3.1 Abuse of Position<br />
An employee shall not use his/her official position, identification card and/or badge for special<br />
privileges, personal benefit, or financial gain.<br />
5.3.2 Assistance to Fellow Officer<br />
Officers shall aid, assist and protect their fellow officers in times of danger, impending danger, or<br />
perceived danger.<br />
5.3.3 Associations/Organizational Memberships<br />
Employees of the Police Department shall not associate with any person(s) or organization(s)<br />
who is/are under felony criminal investigation or indictment. This includes association with<br />
persons/organizations who have reputations for ongoing involvement in a criminal enterprise.<br />
This does not apply to employees who are engaged in the performance of official duties or<br />
where this association is based upon familial relationships. No employee shall join or affiliate<br />
with any organization or society whose constitution, by-laws, beliefs, or organizational structure<br />
interfere with the employee’s conduct which could result in improper or inefficient service. No<br />
employee shall knowingly become a member or affiliate with any subversive organization, except<br />
when necessary in the performance of a police duty and then only under the direction of the Chief<br />
of Police.<br />
5.3.4 Attendance at Trials/Hearings<br />
Departmental personnel who have been subpoenaed, or have been otherwise notified by<br />
competent authority that their attendance is necessary at a trial or hearing, are to attend the trial<br />
or hearing except for good cause. Officers are encouraged to contact the prosecutor to be placed<br />
on “stand-by” or “on-call.” In those cases where absence is necessary, notification to the court<br />
will be made prior to the scheduled trial or hearing. Failure to honor a subpoena and/or failure to<br />
attend a required trial or hearing may result in disciplinary action.<br />
5.3.5 Carrying Badge, Firearm, and Identification<br />
A. Officers shall wear or carry their badge, identification card, and authorized firearm at all<br />
times while in an on-duty capacity, except when impractical or dangerous to their safety<br />
or to an investigation. Any officer, while acting in an official capacity, shall furnish<br />
his/her name and badge number to any person requesting it, unless withholding such<br />
information is necessary for the performance of his/her police duties.<br />
B. Civilian employees, while acting in an official capacity, shall furnish their name to any<br />
person requesting it, unless withholding such information is necessary for the<br />
performance of his/her duties.<br />
C. No employee shall lend their identification card or badge to another. Identification cards<br />
or badges shall not be reproduced without the approval of the Chief of Police. Officers<br />
and civilian employees may only use those business cards approved by the Chief of<br />
Police.<br />
