Dear Mr. Diesso and Mr. Cheliotes:<br />

Pursuant to law, reassignments from a lower level to a higher level are recognized as a<br />

managerial prerogative. However, in conformance with the Rules and Regulations ofthe Personnel<br />

Director, and in the interest oftreating employees fairly, the Employer shall consider the following<br />

criteria for such reassignment within the Agency:<br />

a. performance evaluations;<br />

b. training, experience and special skills which relate to the job;<br />

c. seniority in the title.<br />

It is understood that the posting requirements set forth in Article X, Section l.a. and b., ofthis<br />

Agreement are applicable to positions being filled pursuant to this letter.<br />

It is further understood that all reassignment decisions are not subject to the grievance procedure<br />

or arbitration. However, ifan employee covered by this Agreement feels aggrieved by a decision<br />

under this letter, the employee and/or the union shall present the complaint in writing to the agency<br />

head or the agency head's designee, who has not been a party to the previous decision, within fifteen<br />

(15) days ofthe action complained of.<br />
