<strong>in</strong>cluded <strong>the</strong> action aga<strong>in</strong>st <strong>the</strong> US BANCORP defendants and<br />

Unknown Healthcare Provider as a rel<strong>at</strong>ed appell<strong>at</strong>e case <strong>in</strong><br />

(10th C.C.A. 04-3075) and used <strong>the</strong> US BANCORP order as a<br />

basis for a cross appeal (10th C.C.A. 04-3102) challeng<strong>in</strong>g<br />

<strong>the</strong> failure <strong>of</strong> <strong>the</strong> trial <strong>court</strong> to grant sanctions aga<strong>in</strong>st<br />

<strong>the</strong>ir conscious commitment to a common scheme designed to<br />

achieve an unlawful objective <strong>of</strong> keep<strong>in</strong>g Medical Supply out<br />

<strong>of</strong> <strong>the</strong> market for hospital supplies by review<strong>in</strong>g <strong>the</strong> case<br />

aga<strong>in</strong>st US BANCORP and consult<strong>in</strong>g with represent<strong>at</strong>ives for<br />

<strong>the</strong> defendants US BANCORP and US BANK along with Jerry A.<br />

Grundh<strong>of</strong>fer, Andrew Cesere, <strong>the</strong> Piper Jaffray Companies and<br />

Andrew S. Duff.<br />
