all funds <strong>in</strong>vested <strong>in</strong> prepar<strong>at</strong>ion <strong>of</strong> tra<strong>in</strong><strong>in</strong>g.<br />

12. Medical Supply’s cause was controversial because it<br />

was an action to seek an <strong>in</strong>junction aga<strong>in</strong>st break<strong>in</strong>g a<br />

contract to provide escrow accounts <strong>in</strong> fur<strong>the</strong>rance <strong>of</strong> a<br />

boycott by US Bancorp and Piper Jaffray’s coconspir<strong>at</strong>or<br />

identified <strong>in</strong> <strong>the</strong> compla<strong>in</strong>t as Nov<strong>at</strong>ion, a healthcare group<br />

purchas<strong>in</strong>g organiz<strong>at</strong>ion (“GPO”) competitor <strong>of</strong> Medical<br />

Supply’s <strong>in</strong> <strong>the</strong> hospital supply market.<br />

13. Also identified <strong>in</strong> <strong>the</strong> compla<strong>in</strong>t was Nov<strong>at</strong>ion’s<br />

captive e-commerce marketplace Ne<strong>of</strong>orma, Inc. directly<br />

compet<strong>in</strong>g with Medical Supply on <strong>the</strong> Internet.<br />

14. Medical Supply sought an <strong>in</strong>terlocutory appeal on <strong>the</strong><br />

denial <strong>of</strong> <strong>in</strong>junctive relief without a memorandum and order<br />

or f<strong>in</strong>d<strong>in</strong>gs <strong>of</strong> law and fact Medical Supply Cha<strong>in</strong>, Inc. v.<br />

US Bancorp, NA et al 10th Cir. Case No.: 02-3443.<br />

15. Medical Supply also sought <strong>in</strong>terim pre-hear<strong>in</strong>g relief<br />

<strong>in</strong> <strong>the</strong> Tenth Circuit seek<strong>in</strong>g to prevent <strong>the</strong> defendants from<br />

fil<strong>in</strong>g a malicious USA PATRIOT Act Suspicious Activity<br />

Report th<strong>at</strong> would destroy <strong>the</strong> Medical Supply’s ability to<br />

obta<strong>in</strong> escrow arrangements, higher level bank<strong>in</strong>g and<br />

<strong>in</strong>tern<strong>at</strong>ional fund transfer services elsewhere to<br />

accomplish its capitaliz<strong>at</strong>ion and conduct hospital supply<br />
