will not risk a hundred million dollar company th<strong>at</strong><br />

requires high level bank<strong>in</strong>g services to future damage from<br />

a secret USA PATRIOT Act report th<strong>at</strong> has mis<strong>in</strong>form<strong>at</strong>ion <strong>in</strong><br />

it and would cre<strong>at</strong>e a black mark prevent<strong>in</strong>g <strong>the</strong>m from ever<br />

be<strong>in</strong>g able to do any bus<strong>in</strong>ess.<br />

185. US BANCORP’s counsel said it would not agree to even<br />

just <strong>the</strong> relief sought <strong>in</strong> paragraph 66 <strong>of</strong> <strong>the</strong> first federal<br />

compla<strong>in</strong>t.<br />

186. Medical Supply asked US BANCORP’s counsel if his firm<br />

would act as an escrow agent for accounts to be deposited<br />

<strong>in</strong> US BANK, s<strong>in</strong>ce Shook, Hardy and Bacon had decl<strong>in</strong>ed to do<br />

so.<br />

187. US BANCORP’s counsel refused to do so st<strong>at</strong><strong>in</strong>g th<strong>at</strong> US<br />

Bank did not owe any duty to Medical Supply.<br />

Defendants’ Intellectual Property Misappropri<strong>at</strong>ion<br />

188. Realiz<strong>in</strong>g <strong>the</strong>re was no immedi<strong>at</strong>e solution to this<br />

m<strong>at</strong>ter, and <strong>the</strong> fact th<strong>at</strong> a previous bus<strong>in</strong>ess model pric<strong>in</strong>g<br />

system developed by SAMUEL LIPARI <strong>in</strong> 1993-1995 was<br />

appropri<strong>at</strong>ed by HSCA, Medecon and Card<strong>in</strong>al Healthcares’<br />

subsidiary Owen Healthcare through exploit<strong>at</strong>ion <strong>of</strong> a<br />
