with US BANK regard<strong>in</strong>g its o<strong>the</strong>r bank bus<strong>in</strong>ess.<br />

170. Medical Supply contacted an <strong>at</strong>torney, familiar with<br />

<strong>the</strong> healthcare supply cha<strong>in</strong> research and development done<br />

by SAMUEL LIPARI <strong>at</strong> <strong>the</strong> law firm <strong>of</strong> Shook, Hardy and Bacon<br />

and asked if his firm could act as escrow agent for<br />

accounts to be set up <strong>in</strong> US Bank.<br />

171. The Shook, Hardy and Bacon <strong>at</strong>torney said <strong>the</strong> bank is<br />

better prepared to provide escrow services, fear<strong>in</strong>g <strong>the</strong><br />

liabilities and risks for an escrow agent where <strong>the</strong> USA<br />

PATRIOT Act had been <strong>in</strong>voked and decl<strong>in</strong>ed to act as escrow<br />

agent.<br />

172. On Thursday 10/24/02 Medical Supply filed for urgent<br />

<strong>in</strong>junctive relief aga<strong>in</strong>st US BANCORP NA, its subsidiaries<br />

and named employees.<br />

173. Medical Supply counsel contacted US BANK counsel<br />

Krist<strong>in</strong> Strong to clarify <strong>the</strong> clerk <strong>of</strong> <strong>the</strong> <strong>court</strong>’s<br />

question<strong>in</strong>g <strong>of</strong> service and to <strong>at</strong>tempt to schedule a<br />

hear<strong>in</strong>g.<br />

174. Ms. Strong said she would call <strong>the</strong> follow<strong>in</strong>g morn<strong>in</strong>g<br />

Friday 10/25/02 to answer <strong>the</strong> question about service. She<br />

did not call and took <strong>the</strong> day <strong>of</strong>f.<br />
