129. At 9 a.m. <strong>the</strong> follow<strong>in</strong>g morn<strong>in</strong>g on or about 10/16/02<br />

Ed Higg<strong>in</strong>s called, leav<strong>in</strong>g a tape-recorded message on<br />

Medical Supply’s answer<strong>in</strong>g system identify<strong>in</strong>g him as <strong>the</strong><br />

executive vice president <strong>of</strong> Midwest trusts for US BANK.<br />

130. SAMUEL LIPARI, believ<strong>in</strong>g th<strong>at</strong> <strong>the</strong> USA P<strong>at</strong>riot Act had<br />

probably been used to reject <strong>the</strong> escrow accounts because <strong>of</strong><br />

his family sir name which is also <strong>the</strong> name <strong>of</strong> a small group<br />

<strong>of</strong> Islands <strong>in</strong> <strong>the</strong> Mediterranean Sea and which ends <strong>in</strong> “ari”<br />

like many Moslem sir names <strong>of</strong> people <strong>of</strong> Arabic descent,<br />

activ<strong>at</strong>ed a tape recorder with a built <strong>in</strong> microphone and<br />

called Mr. Higg<strong>in</strong>s back on <strong>the</strong> speaker phone.<br />

131. Each subsequent call to US BANK <strong>in</strong> which Samuel Lipari<br />

particip<strong>at</strong>ed was also recorded by him to document wh<strong>at</strong> he<br />

suspected was discrim<strong>in</strong><strong>at</strong>ion based on his n<strong>at</strong>ional orig<strong>in</strong><br />

or ethnic descent. See Attachment 1 Transcript <strong>of</strong><br />

Record<strong>in</strong>gs.<br />

132. Ed Higg<strong>in</strong>s listened to SAMUEL LIPARI after st<strong>at</strong><strong>in</strong>g he<br />

was an <strong>at</strong>torney and how long he had been work<strong>in</strong>g <strong>in</strong> trust<br />

bank<strong>in</strong>g, agreed with him th<strong>at</strong> he saw no reason why <strong>the</strong> USA<br />

P<strong>at</strong>riot Act would apply to Medical Supply.<br />

133. SAMUEL LIPARI expla<strong>in</strong>ed th<strong>at</strong> Medical Supply needed<br />

additional US Bank services <strong>in</strong>clud<strong>in</strong>g credit facilities,<br />

receivables f<strong>in</strong>anc<strong>in</strong>g and clear<strong>in</strong>g and settlement services<br />
