AND ANY PLACE OUTSIDE THEREOF, CONDITIONS OF<br />

CARRIAGE, REGULATIONS AND TIMETABLES (BUT NOT<br />

THE TIMES OF DEPARTURE AND ARRIVAL THERE<strong>IN</strong><br />

SPECIFIED) OF CARRIER, WHICH MAY BE <strong>IN</strong>SPECTED<br />

AT ANY OF ITS OFFICES AND AT AIRPORTS FROM<br />

WHICH IT OPERATES REGULAR SERVICES.<br />

(4) (A) THE CARRIER SHALL NOT AVAIL ITSELF OF ANY<br />

DEFENSE UNDER ARTICLE 20(1) OF THE CONVENTION<br />

WITH RESPECT TO THAT PORTION OF SUCH CLAIM<br />

HEREOF, THE CARRIER RESERVES ALL DEFENSES<br />

AVAILABLE UNDER THE CONVENTION TO SUCH<br />

CLAIMS. WITH RESPECT TO THIRD PARTIES, THE<br />

CARRIER RESERVES ALL RIGHTS OF RECOURSE<br />

AGA<strong>IN</strong>ST ANY OTHER PERSON, <strong>IN</strong>CLUD<strong>IN</strong>G WITHOUT<br />

LIMITATION, RIGHTS OF CONTRIBUTION AND<br />

(C) THE CARRIER AGREES THAT SUBJECT TO APPLICABLE<br />

LAW RECOVERABLE COMPENSATORY DAMAGES FOR SUCH<br />

LAW OF THE DOMICILE OR PERMANENT RESIDENCE OF<br />

THE PASSENGER.<br />

REPLACED <strong>IN</strong> ACCORDANCE WITH ANY F<strong>IN</strong>AL<br />

(C) LIMITATION OF LIABILITY<br />

(1) CARRIER IS NOT LIABLE FOR ANY DEATH, <strong>IN</strong>JURY,<br />

DELAY, LOSS, OR OTHER DAMAGE OF WHATSOEVER NATURE<br />

(HERE<strong>IN</strong>AFTER <strong>IN</strong> THIS TARIFF COLLECTIVELY REFERRED<br />

TO AS "DAMAGE") TO PASSENGERS OR UNCHECKED BAGGAGE<br />

ARIS<strong>IN</strong>G OUT OF OR <strong>IN</strong> CONNECTION WITH CARRIAGE OR<br />

OTHER SERVICES PERFORMED BY CARRIER <strong>IN</strong>CIDENTAL<br />

THERETO, UNLESS SUCH DAMAGE IS CAUSED BY THE<br />

NEGLIGENCE OF CARRIER. ASSISTANCE RENDERED TO THE<br />

PASSENGER BY CARRIER'S EMPLOYEES <strong>IN</strong> LOAD<strong>IN</strong>G,<br />

UNLOAD<strong>IN</strong>G, OR TRANSSHIPP<strong>IN</strong>G BAGGAGE SHALL BE<br />

CONSIDERED AS GRATUITOUS SERVICE TO THE PASSENGER.<br />

AZ IS NOT LIABLE FOR DAMAGE TO SUCH<br />

UNCHECKED BAGGAGE <strong>IN</strong>CURRED DUR<strong>IN</strong>G, OR AS A RESULT<br />
