Now this agreement witnesses that <strong>in</strong> consideration of the premises and the<br />

payment to be made by the purchaser to the contractor provided for here<strong>in</strong> below the<br />

Contractor shall supply all equipment and materials and execute and perform all works<br />

for which the said Tender of the Contractor has been accepted strictly accord<strong>in</strong>g to the<br />

various provisions <strong>in</strong> Annexure-B and C hereto and upon such supply, execute and<br />

perform to the satisfaction of the purchaser and the purchaser shall pay to the Contractor<br />

at the rates accepted as per the said Annexure-C and <strong>in</strong> terms of provisions there<strong>in</strong>. In<br />

case if the Contractor is not a company <strong>in</strong>corporated under the Companies Act, 1956, the<br />

expression “Contractor” shall unless otherwise excluded by or repugnant to the subject or<br />

context mean and <strong>in</strong>clude each of the successors- <strong>in</strong>- <strong>in</strong>terest, agents, nom<strong>in</strong>ees, servants,<br />

beneficiaries etc. If it is a Sole Proprietorship bus<strong>in</strong>ess, <strong>in</strong> addition to this, such<br />

expression Contractor will also <strong>in</strong>clude, each of his heirs, executors, and legal<br />

representatives.<br />
