proprietary rights that may exist on such processes, draw<strong>in</strong>gs or patterns which he<br />

may use of his own accord.<br />

(b)<br />

In the case of patents taken out by the Contractor of the draw<strong>in</strong>gs or patterns<br />

registered by him, or of those patents, draw<strong>in</strong>gs or patterns for which he holds<br />

a license, the sign<strong>in</strong>g of the contract automatically gives the Purchaser the<br />

right to repair by himself the purchased articles covered by the patent or by<br />

any person or body chosen by him and to obta<strong>in</strong> from any sources he desires the<br />

component parts required by him for carry<strong>in</strong>g out the repair work. In the event<br />

of <strong>in</strong>fr<strong>in</strong>gement of any patent rights due to above action of the purchaser, he<br />

shall be entitled to claim damages from the contractor on the grounds of any<br />

loss of any nature which he may suffer.<br />

32. LICENSE AS PER GOVT. OF INDIA CONTRACT LABOUR ACT<br />

32.1 The contractors are required to produce license as enjo<strong>in</strong>ed <strong>in</strong> the Government of<br />

India Contract Labour (Regulation and Abolition) Act (1978). They shall not be<br />

allowed to undertake or execute any work through contract labour except under<br />

and <strong>in</strong> accordance with a license issued under the said Act <strong>in</strong> that behalf by<br />

the authorised licens<strong>in</strong>g Officer.<br />

33. DEFAULT & DELAYS<br />

The Contractor shall execute the work with due diligence and expedition, keep<strong>in</strong>g<br />

to the approved Time schedule. Should he refuse or neglect to comply with any<br />

reasonable orders given to him <strong>in</strong> writ<strong>in</strong>g by the Purchaser's Eng<strong>in</strong>eers <strong>in</strong><br />

connection with the work or contravene the provision of the contract or the<br />

progress of work lags persistently beh<strong>in</strong>d the time schedule due to his neglect,<br />

the Purchaser shall be at liberty to give seven days notice <strong>in</strong> writ<strong>in</strong>g to the<br />

Contractor requir<strong>in</strong>g him to make good the neglect or contravention compla<strong>in</strong>ed<br />

of and should the contractor fail to comply with the requisitions made <strong>in</strong> the<br />

notice with<strong>in</strong> seven days from the receipt thereof, it shall be lawful for the<br />

purchaser to take the work wholly or <strong>in</strong> part out of the Contractor's hands<br />

without any further reference and get the work or any part thereof, as the case<br />

may be, completed by other agencies at the expense of the contractor without<br />

prejudice to any other right or remedy of the Purchaser.<br />

34. LOSS SUSTAINED DUE TO DEFAULT AND DELAY<br />

In the event of any loss to the purchaser on account of execution and/or<br />

completion of the work or any part thereof by agencies other than the<br />

contractor, the contractor shall be liable to reimburse the loss to purchaser<br />

without prejudice to the other rights and remedies of the purchaser, and<br />
