or any of them may <strong>in</strong>cur or be put or be liable to, by reason or <strong>in</strong><br />

consequence of the operations of the contractor or his failure <strong>in</strong> any respect.<br />

25. ANNUAL MAINTENANCE CONTRACT<br />

Not applicable.<br />

26. CLEARANCE OF SITE<br />

26.1 Contractor at his own expenses clean the site, set out all works and provide all<br />

necessary labours, pegs, str<strong>in</strong>g, steel to enable the purchaser or any of his<br />

representatives to check all sett<strong>in</strong>g out and the contractor will correct all errors at<br />

his own expenses.<br />

26.2 At the end of the work <strong>in</strong> each section the contractor shall as a part of his<br />

contractual obligation leave the area completely cleared of rubbish and obstructions<br />

of all k<strong>in</strong>ds accord<strong>in</strong>g to the <strong>in</strong>structions of the Railway's representatives. Besides,<br />

he shall take execution of work to avoid the presence of loose earth and ballast on<br />

platforms, <strong>in</strong> dra<strong>in</strong>s, on the track formation and pathways <strong>in</strong> the vic<strong>in</strong>ity. If with<strong>in</strong><br />

fortnight of completion of the particular item of site work, the refuge is not cleared,<br />

the Railway will arrange to get them removed at the cost of the Contractor.<br />

However, before the Railway actually gets the site cleared, <strong>in</strong>timation <strong>in</strong> writ<strong>in</strong>g<br />

shall be sent to the Contractor.<br />

27. PROVISIONAL ACCEPTANCE<br />

27.1 Immediately after the completion of the work at each station or after<br />

completion of work <strong>in</strong> a block section here<strong>in</strong> after referred as sub-section, the<br />

contractor shall certify and advise the purchaser <strong>in</strong> writ<strong>in</strong>g that the <strong>in</strong>stallation<br />

is (i) complete, (ii) ready for satisfactory service and (iii) ready to be handed<br />

over. He will also place at the disposal of the purchaser the required staff for<br />

<strong>in</strong>spection, test<strong>in</strong>g and putt<strong>in</strong>g it <strong>in</strong>to operation.<br />

27.2 The test or tests specified <strong>in</strong> Technical specification will be conducted jo<strong>in</strong>tly by<br />

the purchaser and contractor as soon as possible after receipt of advice of<br />

completion of one sub-section by the purchaser from the contractor. The<br />

test schedule shall be furnished by the tenderer which will be modified by<br />

mutual discussion between the contractor and Railway before f<strong>in</strong>alisation.<br />

Any component, modules, sub-assemblies or equipment fail<strong>in</strong>g dur<strong>in</strong>g the<br />

commission<strong>in</strong>g test shall be replaced/repaired free of cost by the tenderer.<br />

27.3 Purchaser's Eng<strong>in</strong>eer shall issue a Provisional Acceptance certificate for<br />

successful commission<strong>in</strong>g of whole system cover<strong>in</strong>g all materials and services<br />

<strong>in</strong>cluded <strong>in</strong> the Schedule of works, after the f<strong>in</strong>al acceptance test as per the<br />
