All the work shall be executed <strong>in</strong> strict conformity to the provisions of the<br />

contract document and accord<strong>in</strong>g to detailed draw<strong>in</strong>gs, specifications and<br />

<strong>in</strong>structions as may be approved from time to time by Railway based on<br />

detailed design and eng<strong>in</strong>eer<strong>in</strong>g carried out by contractor <strong>in</strong> l<strong>in</strong>e with<br />

requirements as per contract document. The contractor shall be responsible for<br />

ensur<strong>in</strong>g that the work throughout are executed <strong>in</strong> the most substantial, proper<br />

and workman like manner with the quality of material and workmanship <strong>in</strong><br />

strict accordance with the specifications and as per sound <strong>in</strong>dustrial practices and<br />

to the entire satisfaction of the Railway. In case of any doubts regard<strong>in</strong>g any<br />

particulars of construction and any ambiguities <strong>in</strong> the plans, the decision of the<br />

purchaser’s eng<strong>in</strong>eer shall be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g on the contractor.<br />

23. PROGRESS REPORTING<br />

23.1 The contractor shall submit to Railways at his own cost periodic progress<br />

reports at regular <strong>in</strong>tervals regard<strong>in</strong>g the state and progress of work. The<br />

details and pro-forma of the report will mutually be agreed after award of the<br />

Contract. Such reports shall be for daily man power, equipment and plant<br />

development, weekly work progress and monthly progress review reports. All<br />

actions as directed by Railway pursuant to such reports shall be promptly<br />

attended to by Contractor.<br />

23.2 The purchaser's eng<strong>in</strong>eer shall also conduct monthly meet<strong>in</strong>gs with the<br />

contractor to assess and review the programme of works. The action proposed to<br />

progress the work as planned, difficulties, assistance required etc. shall be<br />

clearly brought out and remedial action taken. The m<strong>in</strong>utes of these meet<strong>in</strong>gs<br />

shall be jo<strong>in</strong>tly signed by Railways and contractor.<br />

24. MAINTENANCE OF WORKS<br />

24.1 The contractor shall at all times dur<strong>in</strong>g the progress and cont<strong>in</strong>uance of the works<br />

and also for the period of warranty after the date of pass<strong>in</strong>g of the certificate of<br />

completion by the Railway's representative or any other earlier date subsequent to<br />

the completion of the works that may be fixed by Railway's representative be<br />

responsible for and effectively ma<strong>in</strong>ta<strong>in</strong> and uphold <strong>in</strong> good, substantial, sound<br />

and perfect condition all and every part of the works executed by him as part of<br />

present contract and shall make good from time to time and at all times, as<br />

often as the Railway's representative shall require, any damage or defect that<br />

may dur<strong>in</strong>g the above period arise <strong>in</strong> or be discovered or be <strong>in</strong> any way<br />

connected with the works, provided that such damage or defect is not directly<br />

caused by errors <strong>in</strong> the contract documents, act of providence or <strong>in</strong>struction or<br />

civil riot, and the contractor shall be liable for and shall pay and make good to<br />

the Railways or other persons legally entitled thereto whenever required by the<br />

Railway's representative so to do, all losses, damages, costs and expenses they<br />
