20. ADDITION/REDUCTION OF QUANTITIES OF WORK<br />
If dur<strong>in</strong>g the execution of the work the contractor is called upon to carry out any<br />
new work not <strong>in</strong>cluded <strong>in</strong> orig<strong>in</strong>al scope of work, it should not be executed before<br />
a rate has been agreed to by the Railways <strong>in</strong> the manner as <strong>in</strong>dicated <strong>in</strong> General<br />
Conditions of Contract and Instructions for tenders of the Engg. Department of<br />
Railways.<br />
The successful tenders will, however, have no claims or right <strong>in</strong> the execution of<br />
any work which <strong>in</strong> the op<strong>in</strong>ion of the Eng<strong>in</strong>eer should be carried out<br />
departmentally or otherwise and the Railway reserves the right any time before or<br />
after the acceptance of the tender to keep back from the contract and carry out the<br />
work or portion of work through any other agent it may th<strong>in</strong>k fit without assign<strong>in</strong>g<br />
any reason. No claim for compensation / loss or what so ever on this account will<br />
be enterta<strong>in</strong>ed by the Railway.<br />
21. SUBLETTING AND ASSIGNMENT<br />
21.1 The contractor may sublet a part of the works under this contract and enter <strong>in</strong>to<br />
contract with suppliers for supply of materials only with the approval of the<br />
Railway adm<strong>in</strong>istration.<br />
21.2 The names of all sub contractors proposed to be employed for execution of work<br />
or any part thereof <strong>in</strong>clud<strong>in</strong>g manufactur<strong>in</strong>g of equipment and other materials<br />
shall be submitted by the contractor to the purchaser and got approved by him<br />
before the contractor enter <strong>in</strong>to a agreement with the sub contractor for the<br />
purpose.<br />
21.3 The contractor shall arrange for effective supervision of sub contractor's work and<br />
rema<strong>in</strong> solely responsible for materials supplied and for works carried out on his<br />
behalf by the sub contractor.<br />
21.4 The contractor shall not, save with the previous consent <strong>in</strong> writ<strong>in</strong>g of the<br />
Purchaser, sublet, transfer or assign the contract or any part thereof or <strong>in</strong>terest<br />
there<strong>in</strong> or benefit or advantage thereof any manner whatsoever.<br />
21.5 In the event of the Contractor's sublett<strong>in</strong>g or assign<strong>in</strong>g this contract or any part<br />
thereof without such permission, the purchaser shall be entitled to cancel the<br />
contract and to purchase the stores elsewhere on the contractor's account and risk<br />
and the contractor shall be liable for any loss or damage which the purchaser<br />
may susta<strong>in</strong> <strong>in</strong> consequence or aris<strong>in</strong>g out of such purpose.<br />
