15.1 The tenderer shall certify that they have <strong>in</strong> place a Quality management system to<br />

deliver the design conform<strong>in</strong>g to desired quality and safety norms.<br />

15.2 In the event of Railways wav<strong>in</strong>g off the <strong>in</strong>spection, all tests provided <strong>in</strong> the test<br />

schedules approved by Railway shall be carried out by the Quality Assurance<br />

Organization and proper record of all such tests and results thereof shall be<br />

ma<strong>in</strong>ta<strong>in</strong>ed and supplied to the Railway on demand.<br />

16. REJECTION<br />

16.1 INSPECTING OFFICER – POWER OF REJECTION<br />

a) Before any stores or part thereof are submitted for <strong>in</strong>spection, to certify that they<br />

are not <strong>in</strong> accordance with the contract/ow<strong>in</strong>g to the adoption of any unsatisfactory<br />

method of manufacture.<br />

b) To reject any stores submitted as not be<strong>in</strong>g <strong>in</strong> accordance with the particulars.<br />

c) To reject the whole of the <strong>in</strong>stallment tendered for <strong>in</strong>spection if after <strong>in</strong>spection of<br />

such portion thereof, as he may <strong>in</strong> his discretion th<strong>in</strong>k fit, he is satisfied that the<br />

same is unsatisfactory.<br />

d) To mark the rejected stores with a rejection mark, so that they may be easily<br />

identified if resubmitted.<br />

The Inspect<strong>in</strong>g officer’s decision as regards the rejection shall be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g<br />

on the contractor.<br />

16.2 CONSIGNEE’S RIGHT OF REJECTION<br />

Notwithstand<strong>in</strong>g any approval which the <strong>in</strong>spect<strong>in</strong>g Officer may have given <strong>in</strong><br />

respect of the stores or any materials or the work or workmanship <strong>in</strong>volved <strong>in</strong> the<br />

performance of the contract (whether with or without any test carried out by the<br />

contractor or the <strong>in</strong>spect<strong>in</strong>g officer or under the direction of the Inspect<strong>in</strong>g officer)<br />

and notwithstand<strong>in</strong>g delivery of the stores where so provided to the <strong>in</strong>terim<br />

consignee it shall be lawful for the consignee, on behalf of the purchaser, to reject<br />

the stores or any part, portion of consignment there of with<strong>in</strong> a reasonable time<br />

after actual delivery thereof to him at the place or dest<strong>in</strong>ation fixed <strong>in</strong> the contract if<br />

such stores or part, portion of consignment thereof is not <strong>in</strong> all respects <strong>in</strong><br />

conformity with the terms and conditions of the contract whether on account of any<br />

loss, deterioration or damage before dispatch or delivery or dur<strong>in</strong>g transit or<br />

otherwise howsoever.<br />
