change of price, or time schedule of delivery of stores shall be enterta<strong>in</strong>ed after the<br />

offer is accepted by the purchaser on account of any local condition or factor.<br />

3.2 In the event of the tenderer desir<strong>in</strong>g to have a field survey before furnish<strong>in</strong>g his<br />

quotations, he may apply to Railways for permission <strong>in</strong> this regard. Such<br />

permission will be given <strong>in</strong> writ<strong>in</strong>g by the Railways but the expenses <strong>in</strong> this regard<br />

will be borne by the tenderer completely.<br />

3. 3 The <strong>in</strong>tend<strong>in</strong>g tenderer is advised to study the tender papers carefully. Any<br />

submission of a quotation by the tenderer shall be deemed to have been done after a<br />

careful study and exam<strong>in</strong>ation of these documents with full understand<strong>in</strong>g of the<br />

implication thereof. These conditions and specifications shall be deemed to have<br />

been accepted unless otherwise, specifically commented upon by the Tenderer <strong>in</strong><br />

his quotation. Failure to adhere to anyone or all these <strong>in</strong>structions may render his<br />

offer liable to be ignored without any reference.<br />

3.4 Should a tenderer f<strong>in</strong>d discrepancies <strong>in</strong> or omission from the draw<strong>in</strong>g or any of the<br />

Tender papers or he has any doubt to their mean<strong>in</strong>g, he should at once notify the<br />

Railway who may send a written clarification to all tenderers.<br />

4. COMPLIANCE TO TENDER CONDITIONS, SPECIFICATION &<br />

DRAWINGS<br />

4.1 The tenderer shall <strong>in</strong>dicate paragraph by paragraph for each section and each clause<br />

and sub-clause of the tender document - Pre-amble, Instructions to tenderers and<br />

conditions of tender<strong>in</strong>g, Special conditions of Contract, Technical Specifications &<br />

Installation practices, that either his tender complies <strong>in</strong> every respect with the<br />

requirements of each clause and sub-clause or if not, precisely how they differ from<br />

the requirements of the tenderer. In later case, the tenderer shall enclose a separate<br />

statement as per pro-forma given, <strong>in</strong>dicat<strong>in</strong>g only the deviations for any clause or<br />

sub-clause which he proposes with "detailed justifications for deviations proposed".<br />

The purchaser, reserves the right to accept or reject these deviations and his<br />

decision thereon shall be f<strong>in</strong>al. (Form 5).<br />

4.2 The equipment & material offered shall be <strong>in</strong> accordance with the draw<strong>in</strong>gs and<br />

specifications. Details of variation from the draw<strong>in</strong>gs and specifications, if any,<br />

should be clearly <strong>in</strong>dicated and <strong>in</strong> such an event, a certificate from the users must<br />

be furnished to the effect that the product offered performs the requisite functions<br />

satisfactorily, & is an alternative acceptable <strong>in</strong> one or more other countries. The<br />

name of users <strong>in</strong> those foreign countries should also be <strong>in</strong>dicated.<br />

4.3 Firms who have not carried out the works and supplied the items tendered for <strong>in</strong><br />

this case for the Indian Railways <strong>in</strong> the past should give details of supplies and<br />

works carried out and the customers along with their performance certificates.<br />
