MAP and DuPage County<br />

Well, here we go again in Du Page County and the Du<br />

Page County Forest Preserve District.<br />

Due to the recent 2nd District Appellate court decision on<br />

the ILRB’s rules and regulations dismissing MAP’s petitions<br />

in Du Page County Sheriff ’s <strong>Police</strong> and the Forest Preserve,<br />

MAP met with both chapter representatives to discuss our<br />

next step.<br />

As you recall, the court stated that while MAP correctly followed<br />

all procedures in gathering cards and submitting the<br />

appropriate petitions for both chapters, they ruled that the<br />

ILRB’s rules and regulations were improper. This was based<br />

on the interpretation <strong>of</strong> the placement <strong>of</strong> a comma (,) and<br />

the meaning <strong>of</strong> the words “and” “otherwise” and the phrase<br />

“in lieu <strong>of</strong> ” in the ILRB regulations. It basically centered on<br />

the fact that the ILRB did not demand the filing <strong>of</strong> “dues<br />

authorization cards” from the union with 51 percent majority<br />

petition cards which the court feels the rules intended when<br />

originally implemented.<br />

The ILRB’s thinking on this matter, which we at MAP do<br />

agree with, is how can a union (MAP) request and file dues<br />

authorization cards on behalf <strong>of</strong> members where a petition is<br />

filed when these card signing <strong>of</strong>ficers are not actually a member<br />

until the ILRB examines the interest cards, finds that they<br />

were collected free <strong>of</strong> any fraud allegations, and then certifies<br />

the chapter as belonging to the union (MAP).<br />

Makes sense to me. Particularly when you realize that MAP<br />

does not ever take dues from a new chapter until a contract is<br />

signed by all parties or awarded by an arbitrator. It seems like<br />

common sense, but the court on appeal by the County and<br />

the District in Du Page appealed the ILRB’s regulations and<br />

actually got the court to go along with the plaintiff.<br />

The ILRB and the Illinois Attorney General’s <strong>of</strong>fice are appealing<br />

this issue to the Illinois Supreme Court for relief. We<br />

hope they win because we, too, feel the court erred on the<br />

strict construction <strong>of</strong> those few words and the placement <strong>of</strong> a<br />

comma. Common sense should prevail, but it sure seems lacking<br />

in many court decisions.<br />

In the interim, however, MAP met with leaders <strong>of</strong> both chapters.<br />

In Du Page Forest Preserve, members again signed 100<br />

percent <strong>of</strong> their bargaining cards for a new petition and also<br />

signed dues deduction forms. The Du Page County Sheriff ’s<br />

<strong>Police</strong> and Court Services delivered well over 75 percent <strong>of</strong><br />

new cards and dues authorization forms.<br />

This was great news in that they realized that we must not<br />

roll over. MAP vows to keep fighting to get them recognized,<br />

despite the deep pockets <strong>of</strong> the Du Page County government.<br />

They continue to shell out<br />

hundreds <strong>of</strong> thousands<br />

<strong>of</strong> dollars to fight the<br />

organizing efforts <strong>of</strong> these<br />

<strong>of</strong>ficers and MAP, even<br />

while crying that they<br />

are poor and have to cut<br />

services for the citizens <strong>of</strong><br />

Du Page County.<br />

We will be filing more<br />

Freedom <strong>of</strong> Information<br />

requests on behalf <strong>of</strong> both<br />

chapters to determine how much the Du Page County Board<br />

and District are spending and throwing away on attorneys<br />

while misleading the public and the press on how they have<br />

no money to pay for law enforcement, the courts, breast and<br />

cervical cancer screenings, health care for seniors, and other<br />

funding.<br />

It is a joke. They have contingency and revenue funds but just<br />

don’t want to tap into them. They would rather save it to fight<br />

their own <strong>of</strong>ficers and court service personnel. Who knows,<br />

maybe they are trying to scare people to agree to tax increases.<br />

Seems to be a common thing with government nowadays,<br />

doesn’t it<br />

Keep in mind that as <strong>of</strong> April 7, 2006, the Du Page County<br />

Board shelled out over $337,000 to the law firm <strong>of</strong> Seyfarth<br />

and Shaw, Jim Baird, et. al. Our new FOIs will determine<br />

how much more cash these fine lawyers have raked in from<br />

the Du Page County Board since that date. We haven’t FOI’d<br />

the Forest Preserve yet, but the same law firm was hired by<br />

the District to fight MAP. We’ll get their payouts soon, too.<br />

Check out our web site for the full text <strong>of</strong> the recent Appellate<br />

court case. We are in the later rounds <strong>of</strong> this “boxing”<br />

match and we feel that we will prevail on behalf <strong>of</strong> our<br />

members and ultimately show the hypocrisy <strong>of</strong> the Du Page<br />

County Board and Forest Preserve District leaders.<br />

We all know how this will end, don’t we Yeah, you guessed<br />

it; the lawyers for the County will get more billable hours,<br />

take more vacations, and load up their firm’s c<strong>of</strong>fers while the<br />

people <strong>of</strong> Du Page County get their services cut or taxes increased,<br />

and our members will wait a bit more before unionizing<br />

becomes a reality in Du Page County.<br />
