On behalf of the <strong>New</strong> <strong>York</strong> <strong>State</strong> <strong>Thoroughbred</strong> <strong>Breeding</strong> and Development Fund Board of<br />

Directors, I am pleased to present this annual report for 2010. This submission contains a<br />

thorough analysis of <strong>Breeding</strong> Fund activities in what was a challenging year for the breeders,<br />

racehorse owners and stallion owners served by the Fund.<br />

At the same time, it was a year when stakeholders experienced very positive developments. The<br />

underpinnings of <strong>New</strong> <strong>York</strong>'s thoroughbred industry were stabilized when state leaders<br />

embraced Genting <strong>New</strong> <strong>York</strong> as the operator of what will be one of the state's biggest<br />

Racinos. When that facility opens at Aqueduct in <strong>2011</strong>, NYRA will realize a reliable revenue<br />

stream. It will also boost the <strong>Breeding</strong> Fund's incentive program.<br />

By making these incentives more generous, we will be in better position to attract new people to<br />

this exciting sport and form of recreation.<br />

Horse racing and agriculture-related industries play a vital role in the overall state economy<br />

and helps to preserve green space and bolster tourism in our state. The work by the Fund<br />

helps assure that <strong>New</strong> <strong>York</strong> remains a preeminent racing jurisdiction.<br />

The Fund's chief challenge in 2010 was tied to the demise of <strong>New</strong> <strong>York</strong> City OTB, which<br />

historically provided roughly one-third of all Fund revenues. The corporation declared


ankruptcy in December 2009 and later stopped statutory payments owed to the Fund.<br />

However, the Racing and Wagering Board secured a directive requiring 0113 to set aside<br />

revenue for the Fund in segregated accounts. As a result, most of that set-aside money was<br />

paid to the Fund by mid-December 2010.<br />

<strong>To</strong>day, the future of <strong>New</strong> <strong>York</strong> racing appears far brighter than it did just one year ago. The<br />

Fund is strong and weathered the storm. We look forward to another year of rising to the<br />

challenges that come our way.<br />

Executive Summary<br />

<strong>To</strong> put a fresh twist on the slogan of the <strong>New</strong> <strong>York</strong> <strong>Thoroughbred</strong> <strong>Breeding</strong> and Development Fund<br />

programs, <strong>New</strong> <strong>York</strong>-breds in 2010 still started with an advantage. Chief among those advantages:<br />

approximately $7.8 million* in awards earned by breeders, stallion owners, and race horse owners in<br />

2010. These awards help program participants pay feed bills, property taxes, and employees. Thus, the<br />

Fund continues to serve as a catalyst for the preservation of the <strong>State</strong>s thoroughbred industry and the<br />

retention of an estimated 40,000 agri-business jobs in all parts of the states agricultural sector.<br />

The 2010 report details highlights of NY-bred accomplishments at home and abroad, and provides a<br />

detailed accounting of receipts and disbursements of the <strong>Breeding</strong> Funds three major incentive areas <br />

breeder awards, stallion awards, and open-company owner awards. Additionally, it contains the<br />

performance results of <strong>New</strong> <strong>York</strong>-breds at the racetrack and an analysis of the success of the <strong>New</strong> <strong>York</strong><br />

<strong>State</strong> <strong>Thoroughbred</strong> <strong>Breeding</strong> Program regarding farm count, foal production, and <strong>New</strong> <strong>York</strong>-based<br />

stallions and their progeny.<br />

Among the highlights of 2010 were the accomplishments of <strong>New</strong> <strong>York</strong>-bred A Shin Forward, who won<br />

the Grade 1 Mile Championship at Kyoto race track in Japan in late November. Horses born on <strong>New</strong><br />

<strong>York</strong> soil racked up international earnings totaling $69,289,272 in 2010. Bred by Edition Farm in<br />

Waccabuc, A Shin Forwards earnings now top $3.3 million, making him the second-highest NY-bred<br />

earner behind famed Kentucky Derby winner Funny Cide.<br />

Speaking of A Shin Forward, we would be remiss if we did not mention that the entire equine community<br />

mourns the death of Henry Harry Malloy this past fall. Harry and his wife Vivien enjoyed running<br />

Edition Farm together, and have campaigned horses on the <strong>New</strong> <strong>York</strong> circuit for nearly three decades.<br />

The couple has passed on their love of horses to their five children and eleven grandchildren and stepgrandchildren.<br />

Mrs. Malloy told friends she believes Harry had his arms around the horse when A Shin<br />

Forward crossed the finish line in stakes-record time.<br />

The Malloys serve as a shining example of the kind of love and dedication to horses that drives so many<br />

of our breeders to carry on during tough times. Add to that a devotion to their farm land that would rival<br />

that of Gone With the Winds Gerald OHara (Lands the only thing in the world worth working for,<br />

fighting for, worth dying for, because its the only thing that lasts) and the reader will understand why<br />

the states breeders stick with the program as they tighten their belts and look for signs of stability and<br />

upswing in the equine economy. For many, stewardship of their land is something they look upon as a<br />

duty, which fits perfectly with the <strong>Breeding</strong> Funds mission: to preserve, protect, and promote the<br />

green-belt sector of NYS in order to foster the growth and expansion of NY’s thoroughbred<br />

breeding industry.<br />

We can look back on the Funds more than three-and-a-half decades of impact on the thoroughbred and<br />

agri-business economies and see that the programs administered by the Fund are at the very heart of what<br />

helps sustain the breeding of thoroughbreds here in the Empire <strong>State</strong>. Over 37 years, the <strong>Breeding</strong> Fund<br />

has returned nearly $350 Million to our agricultural and equine economy.


Significantly, <strong>New</strong> <strong>York</strong>-breds have the opportunity to compete for good purse money in restricted<br />

company on what is arguably the best circuit in the nation at Aqueduct, Belmont Park, and Saratoga Race<br />

Track operated by the <strong>New</strong> <strong>York</strong> Racing Association. During last summers spa meet, NY-breds<br />

competed for an average purse of $44,849. And <strong>New</strong> <strong>York</strong>-breds also have the advantage of the<br />

opportunity to earn good money by running at Finger Lakes Gaming and Racetrack in the central part of<br />

our state. <strong>New</strong> <strong>York</strong>-sired horses win approximately 60% of all races run at the racino, and about onethird<br />

of all stakes races. In addition, a 2007 study found that with 115 trainers and 475 full-time<br />

employees, the racino has a $120 million economic impact annually on the surrounding region.<br />

Because the <strong>New</strong> <strong>York</strong> <strong>Breeding</strong> Program has become the envy of other states, several locales have<br />

pumped up their programs in an attempt to dethrone the acknowledged leader. The state of Indiana<br />

bankrolled some $200,000 worth of advertising to lure breeders to the Hoosier <strong>State</strong>. <strong>New</strong> Jersey cut back<br />

on racing dates, boosted purses, and generated an increase in total pari-mutuel handle of $123 million.<br />

Those higher purses forced NYRA to compete for horses to fill the starting gate by raising purse money<br />

for open-company races and cutting back on purses for NY-breds. Another challenge to breeders and<br />

commercial boarding operations in NYS comes from our neighboring state of Pennsylvania, where $20<br />

million annually is now disbursed through the PA program.<br />

Most readers are aware that the 2009 bankruptcy of NYC OTB, its subsequent failure to make full<br />

statutory payments to the Fund in 2010, followed by the failure of legislators to approve a settlement<br />

worked out over many months by major stakeholders had a negative impact on the industry in NYS. Add<br />

to that backdrop the fact that the Funds revenue is based solely on handle, which has been falling steadily<br />

for several years,** and it becomes apparent why the Fund had to make adjustments so that it could<br />

maintain its commitment to its core mission of preserving green space. Those adjustments included staff<br />

reductions, an extension of 2009 changes to the awards structure, and additional duties for the field<br />

inspectors who help maintain the integrity of the <strong>Breeding</strong> Fund Registry.<br />

Looking forward, its clear that NY-breds will be starting with a NEW advantage that comes with the<br />

delivery in mid-<strong>2011</strong> of the long-promised VLTs at Aqueduct. Expected to be operational by July, the<br />

handle from the VLTs will fuel purse increases at the NYRA tracks and generate additional revenue for<br />

the Fund. For budgetary planning purposes, the Fund is estimating that each machine will generate an<br />

average of $275 per day, a figure that NYRA believes to be conservative.<br />

As youll see in the pages ahead, the roster of stallions standing in the state is a smaller but arguably<br />

stronger group of studs than has been here in the past. Two major Kentucky farms have launched satellite<br />

stallion operations by teaming up with farms that had already earned good reputations among the states<br />

breeders.<br />

The leading breeder in the nation, Adena Springs, teamed up in late 2010 with McMahon <strong>Thoroughbred</strong>s<br />

in Saratoga Springs. The Vinery operation out of Kentucky is providing NY-breeders with access to the<br />

Giants Causeway, Distorted Humor, and AP Indy sire lines as they add to the strong roster of stallions at<br />

the old Empire Stud in Hudson.<br />

The reader will also find in these pages the results of the 2009 Harry M. Zweig research report from<br />

Cornell University. When the 2010 report is published, the Fund will update this annual report to reflect


the latest equine research performed at Cornell with the support of $228,000 (preliminary figure) supplied<br />

by the Fund.<br />

In 2009, 3,856 thoroughbreds bred in <strong>New</strong> <strong>York</strong> made 26,755 starts in North America,<br />

earning total purses of $70,194,634. These <strong>New</strong> <strong>York</strong>-breds finished first 2,944 times,<br />

second 3,081 times, and third 3,234 times, for a total of 9,259 top-three finishes and an<br />

overall in-the-money rate of 34.6%.<br />

In 2008, 3,851 thoroughbreds bred in <strong>New</strong> <strong>York</strong> made 27,357 starts in North America,<br />

earning total purses of $81,562,424. These <strong>New</strong> <strong>York</strong>-breds finished first 3,126 times,<br />

second 3,324 times, and third 3,306 times, for a total of 9,756 top-three finishes and an<br />

overall in-the-money rate of 35%. The total purses earned represents an increase of<br />

over 6% compared to last years figure of $76,378,645, marking the eleventh<br />

consecutive year of record earnings.<br />

In 2007, a total of 3,934 thoroughbreds bred in <strong>New</strong> <strong>York</strong> made 26,292 starts in North<br />

America, earning total purses of $76,378,645. These <strong>New</strong> <strong>York</strong>-breds finished first<br />

2,974 times, second 3,148 times, and third 3,098 times, for a total of 9,220 top-three<br />

finishes and an overall in-the-money rate of 35%. The total purses earned represents an<br />

increase of nearly 4% over last years figure of $73,535,643, marking the tenth<br />

consecutive year of record earnings. The total North American purse earnings by <strong>New</strong><br />

<strong>York</strong>-breds in 2007 represent an increase of nearly 72% over the 1997 figure of<br />

$44,456,305.<br />

In 2006, a total of 3,873 thoroughbreds bred in <strong>New</strong> <strong>York</strong> made 26,320 starts<br />

worldwide, earning total purses of $73,535,643. These <strong>New</strong> <strong>York</strong>-breds finished first<br />

2,956 times, second 3,180 times, and third 3,101 times, for a total of 9,237 top-three<br />

finishes and an overall in-the-money rate of 42.4%, an increase of over 6 percentage<br />

points compared to the figure for last year. North American earnings by <strong>New</strong> <strong>York</strong>breds<br />

increased to a total of $72,092,598 for 2006, marking the ninth consecutive year<br />

of record earnings. The total North American purse earnings by <strong>New</strong> <strong>York</strong>-breds in<br />

2006 represent an increase of over 62% compared to the 1997 figure of $44,456,305.<br />

In 2005, a total of 3,591 thoroughbreds bred in <strong>New</strong> <strong>York</strong> made 24,495 starts in North<br />

America, finishing first 2,940 times, second 2,949 times, and third 2,929 times, for a<br />

total of 8,818 top-three finishes and an overall in-the-money rate of 36%. <strong>To</strong>tal North<br />

American purse earnings by <strong>New</strong> <strong>York</strong>-breds in 2005 reached an all-time high of<br />

$71,907,213, surpassing the record set in 2004 by nearly $6.7 million. This marks the<br />

eighth consecutive year of record-setting earnings by <strong>New</strong> <strong>York</strong>-breds.<br />

In 2004, a total of 3,466 thoroughbreds bred in <strong>New</strong> <strong>York</strong> made 24,234 starts in North<br />

America, finishing first 2,658 times, second 2,656 times, and third 2,852 times, for a<br />

total of 8,166 top-three finishes and an overall in-the-money rate of 33.7%. <strong>To</strong>tal


North American purse earnings by <strong>New</strong> <strong>York</strong>-breds in 2004 reached an all-time high<br />

of $65,211,933, surpassing the record set in 2003 by over $7.5 million.<br />

In 2003, a total of 3,187 thoroughbreds bred in <strong>New</strong> <strong>York</strong> made 22,053 starts in North<br />

America, finishing first 2,550 times, second 2,634 times, and third 2,627 times, for a<br />

total of 7,811 top-three finishes and an overall in-the-money rate of 35.4%. <strong>To</strong>tal<br />

North American purse earnings by <strong>New</strong> <strong>York</strong>-breds in 2003 reached an all-time high<br />

of $57,674,759, surpassing the record set in 2002 by over $2.5 million.<br />

In 2002, a total of 2,985 thoroughbreds bred in <strong>New</strong> <strong>York</strong> made 22,079 starts in North<br />

America, finishing first 2,575 times, second 2,576 times, and third 2,617 times, for a<br />

total of 7,768 top-three finishes and an overall in-the-money rate of 35.2%. <strong>To</strong>tal<br />

North American purse earnings by <strong>New</strong> <strong>York</strong>-breds in 2002 reached $54,963,235,<br />

surpassing the record set in 2001 by over $1 million.<br />

In 2001, a total of 2,880 thoroughbreds bred in <strong>New</strong> <strong>York</strong> made 22,019 starts in North<br />

America, finishing first 2,585 times, second 2,641 times, and third 2,686 times, for a<br />

total of 7,912 top-three finishes and an overall in-the-money rate of nearly 36%. <strong>To</strong>tal<br />

North American purse earnings by <strong>New</strong> <strong>York</strong>-breds in 2001 reached $53,860,329,<br />

surpassing the record set in 2000 by nearly $1.25 million.


Performance of NY Stallions in 2010<br />

For the first time since the 2002 season, two stallions standing in <strong>New</strong> <strong>York</strong> had over<br />

$4 million in annual progeny earnings: Posse ($4,224,805) and Freud ($4,035,403).<br />

And a total of eight <strong>New</strong> <strong>York</strong> stallions (all living) topped $2 million the highest<br />

number of living annual multi-millionaire sires ever to stand in <strong>New</strong> <strong>York</strong>. A dozen<br />

<strong>New</strong> <strong>York</strong>-based stallions had more than $1.6 million in 2010 progeny earnings, and<br />

the 11 of those that are still living (one died in 2006) are all scheduled to remain in the<br />

state for the <strong>2011</strong> breeding season. Freud, who entered stud in <strong>New</strong> <strong>York</strong> in 2002,<br />

became the first stallion with more than $4 million in annual <strong>New</strong> <strong>York</strong>-conceived<br />

progeny earnings since the late Cure the Blues achieved that distinction following his<br />

death more than a decade ago.<br />

Third-leading 2010 <strong>New</strong> <strong>York</strong>-based sire Repent ($3,016,624) and fourth-leading<br />

Congaree ($2,904,673) both stood in the state in 2010, while <strong>To</strong>uch Gold ($2,894,002)<br />

and Alphabet Soup ($2,605,414) arrived later in the year as part of the Adena Springs<br />

contingent to stand at Joe and Anne McMahon's McMahon of Saratoga<br />

<strong>Thoroughbred</strong>s. Golden Missile ($2,539,814) has stood at Dr. Jonathan Davis' Milfer<br />

Farm in Unadilla since 2008, but Grade 1-winning miler Purge ($2,288,817) is another<br />

late 2010 arrival to the Empire <strong>State</strong>, standing at Vinery <strong>New</strong> <strong>York</strong> in Hudson.<br />

Catienus ($1,913,144) and <strong>New</strong> <strong>York</strong>-bred Read the Footnotes ($1,879,444) both have<br />

stood substantial stretches of their stud careers in <strong>New</strong> <strong>York</strong>.<br />

Among <strong>New</strong> <strong>York</strong>'s new stallion arrivals for <strong>2011</strong> that have not been represented by<br />

runners are two multiple Grade-1 winners of more than $2.3 million each: Tiago,<br />

whose first foals arrive in <strong>2011</strong> and who stands at Adena Springs/McMahon; and<br />

Marsh Side, who is entering stud under Questroyal Stud management. The track<br />

record-setting Tiago (Pleasant Tap Set Them Free, by Stop the Music) is scheduled<br />

to stand for $5,000 (live foal) as the property of a syndicate. Marsh Side (Gone West <br />

Colonial Play, by Pleasant Colony), a stakes winner on both turf and Polytrack, is<br />

owned by Robert Evans and stands at Silvernails Farm in Pine Plains for an<br />

introductory fee of $2,000 (live foal).<br />

Multiple Grade-2 winner Silent Name (Sunday Silence Danzigaway, by Danehill),<br />

whose first offspring are 2-year-olds of <strong>2011</strong>, is another stallion on the Adena<br />

Springs/McMahon roster and has a <strong>2011</strong> fee of $5,000 (live foal). Entering stud at<br />

McMahon are graded winners Harlem Rocker (Macho Uno Freedom Come, by Lit<br />

de Justice) and Coal Play (Mineshaft Wiscasset, by Kris S.) the former as part of<br />

the Adena Springs contingent, and the latter as the property of McMahon. Harlem<br />

Rocker, who finished first in Aqueduct's Grade 1 Hill 'n' Dale Cigar Mile in 2008 but<br />

was disqualified to second, has a <strong>2011</strong> fee of $3,500 (live foal), and Coal Play, a<br />

standout miler, has a fee of $4,000 (live foal) for <strong>2011</strong>. Entering stud at Vinery <strong>New</strong><br />

<strong>York</strong> is multiple Grade-2 winner Justenuffhumor (Distorted Humor Justenuffheart,<br />

by Broad Brush), who is a half-brother to Eclipse Champion Dreaming of Anna and<br />

stands as a Darley Stallion for $5,000 (live foal).


Impressive Lineup of <strong>New</strong> Stallions Standing in NY<br />

A review of the trimmed-down list of registered <strong>New</strong> <strong>York</strong> stallions suggests that the<br />

needs of mare owners have dictated a retreat to quality for those studs standing in the<br />

state. Looking back to the year 2000, 134 stallions were holding court for mares. Just<br />

68 owners registered stallions for 2010, and by the end of <strong>January</strong> <strong>2011</strong>, 70 stallions<br />

had fulfilled the requirements of registration to stand stud duty in <strong>New</strong> <strong>York</strong> in <strong>2011</strong>.<br />

The owners of these horses can anticipate collecting stallion awards from purses<br />

enriched by the long-awaited unveiling of Video Lottery Terminals at Aqueduct.<br />

Certainly the two major Kentucky operations Adena Springs and Vinery that sent<br />

stallions to <strong>New</strong> <strong>York</strong> in late 2010 to stand for the <strong>2011</strong> breeding season believe that<br />

<strong>New</strong> <strong>York</strong> breeders will welcome the chance to breed their mares to in-state sires when<br />

those stallions are quality performers from good families and represent desirable sire<br />

lines. As Dermot Carty, Director of Sales for Adena Springs, put it, The slots<br />

initiative in the state of <strong>New</strong> <strong>York</strong> is very compelling. The prospect of improved<br />

purses as well as stallion and breeders awards was a strong motivation for Adena<br />

Springs Farm to support the <strong>New</strong> <strong>York</strong> <strong>State</strong> program with our stallions.<br />

Adena Springs topped its roster of studs standing at McMahon <strong>Thoroughbred</strong>s in<br />

Saratoga Springs with proven sire <strong>To</strong>uch Gold. The son of Deputy Minister has<br />

already sired 10 graded stakes winners and, with a $10,000 stud fee, figures to attract<br />

some of the states top mares whose owners are looking for Northern Dancer<br />

bloodlines.<br />

Listed alphabetically, the other Adena stallions that are new to <strong>New</strong> <strong>York</strong> are<br />

Breeders Cup Classic winner Alphabet Soup; Withers S. [G3] winner Harlem<br />

Rocker, who brings the Macho Uno sire line to <strong>New</strong> <strong>York</strong>; Silent Name (JPN), a dual<br />

G2 winner by top Japanese sire Sunday Silence out of a graded stakes-winning<br />

daughter of Danehill; and Tiago, the son of Pleasant Tap who earned $2.3 million<br />

dollars while notching wins in such prestigious Grade 1s as the Santa Anita Derby,<br />

The Goodwood Stakes and the Oaklawn Handicap, and who offers an outcross<br />

pedigree free of Raise A Native/Mr. Prospector and Northern Dancer.<br />

Vinery made a seamless move into <strong>New</strong> <strong>York</strong> by taking over Empire Stud in Hudson.<br />

Having made its first foray into the NY stallion ranks in 2010 by sending popular sires<br />

Posse and Repent to the Hudson operation, Vinery took some more well-measured<br />

steps by sending three more graded stakes winners to the state for the next breeding<br />

season.<br />

First-year sire Justenuffhumor, a son of Distorted Humor, won two Grade 2s on the<br />

turf at Saratoga Race Course in 2009: the Bernard Baruch Handicap and the Fourstar<br />

Dave Handicap. Charlie Boden, head of sales at Darley, which campaigned<br />

Justenuffhumor, said, The <strong>New</strong> <strong>York</strong> breeding program is poised to become one of<br />

the most lucrative places in the country to raise a horse. We think Justenuffhumor will


e well-received by <strong>New</strong> <strong>York</strong> breeders given his race record and world-class<br />

pedigree.<br />

Purge is also making a new home in the Empire <strong>State</strong>. This A.P Indy sire-line horse<br />

also loved the Spa, as he broke his maiden here in 2003 and came back to score an<br />

impressive victory in Grade 2 Jim Dandy at three. The son of Pulpit nailed his lone<br />

Grade 1 win at four with a smart victory in the Cigar Mile at Aqueduct. Vinery<br />

President <strong>To</strong>m Ludt says, We think Purge will be well-received with <strong>New</strong> <strong>York</strong><br />

breeders. Hes in the top of his crop in every category, is a son of emerging sire of sires<br />

Pulpit, and on top of that hes a very attractive individual.<br />

Questroyal Stud looks to bring durability, a top sire line, and a quality female family as<br />

it offers the Gone West son Marsh Side to breeders. The multiple Grade 1 winner<br />

earned more than $2.3 million dollars in a <strong>31</strong>-race career that began at age 3 and drew<br />

to a close at age 7. His Grade 2-winning dam Colonial Play is by stamina influence<br />

Pleasant Colony, and she is a full sister to the dam of Eclipse Champion 2-year-old<br />

filly Pleasant Stage. Marsh Side will stand at Silvernails Farm near Pine Plains.<br />

Other newcomers included in the <strong>New</strong> <strong>York</strong> Stallion Registry, which is published by<br />

<strong>New</strong> <strong>York</strong> <strong>Thoroughbred</strong> Breeders Inc. with the financial support of the Fund, include:<br />

Coal Play: The only son of 2003 Horse of the year Mineshaft at stud in NY will stand<br />

at McMahon <strong>Thoroughbred</strong>s. Coal Plays trainer, Hall of Famer Nick Zito, says, Coal<br />

Play could carry his speed over a mile, winning wire-to-wire in four of his five wins.<br />

Coal Play has tremendous conformation, a tremendous body and brilliant speed. He<br />

has the ability to make a terrific stallion.<br />

Magical Forest: This five-year-old son of Forest Camp is out of the precocious Silken<br />

Magic. He raced 15 times and won three stakes, including the G3 Barbaro S. at<br />

Delaware Park.<br />

Malibu Moonshine: His sire, Malibu Moon, stands for $60,000 in Kentucky. This<br />

horse, owned by Joseph Forrest, will stand for $3,000 at Carlland Stables in Avon, NY.<br />

Talk about durable: Malibu Moonshine launched his race career with three wins as a<br />

two-year-old, including the St. Nick Stakes at Charlestown. He went on to race 59<br />

more times through age 8, amassing a record of 62 - 12 (7 stakes) - 5 (3) - 8 (4) with<br />

earnings of $597,370.<br />

Relato Del Gato: Another durable runner, this son of Tale of the Cat, who stands for<br />

$30,000 at Ashford Stud in Kentucky, won the Phoenix Gold Cup H. at age six and<br />

notched a second in the Grade 3 Morvich Handicap that same year. He stands for a<br />

private fee at the Cohn Farm in Ferndale, NY.<br />

Sternman: This Mr. Prospector-line stallion loaded in the starting stall 66 times,<br />

winning his final race at age 9. The son of Idabel stands for $1,250 at the Coxon-Parent<br />

Farm in Fort Ann.

NY-Breds at Auction<br />

In the sales rings, three young females in November were 2010's highest-priced <strong>New</strong><br />

<strong>York</strong>-breds: Fit Right In (in foal to Curlin), the 8-year-old dam of Rightly So, sold for<br />

$1,050,000 at Keeneland; plus 2010 Grade-1 winners Rightly So and Franny Freud,<br />

sold for $600,000 and $560,000 respectively at Fasig-Tipton Kentucky. The unraced<br />

Fit Right In, who produced Rightly So as her first offspring, was purchased by<br />

Katsumi Yoshida, who also was the buyer of Franny Freud. Rightly So, who had been<br />

a fairly pricey 2-year-old in training at the Ocala Breeders' Sales Company's 2008<br />

February select sale, going to Zayat Stables for $220,000 from Becky Thomas's Sequel<br />

Bloodstock as agent, was purchased by Patinack Farm.<br />

Among the 385 <strong>New</strong> <strong>York</strong>-bred yearlings that sold at auction in 2010 for prices<br />

totaling $9,956,500 were 19 that brought six-figure prices, headed by a Tale of the Cat<br />

colt out of Valdivia, by Pleasant Colony, that was purchased for $325,000 at<br />

Keeneland's September sale by Fox Hill Farm. That colt, named The Thinker, was bred<br />

by Empire Equines, LLC.<br />

A higher proportion of <strong>New</strong> <strong>York</strong>-bred 2-year-olds in training brought six-figure sales<br />

prices in 2010 compared to <strong>New</strong> <strong>York</strong>-bred sales yearlings, as 132 juveniles bred in<br />

the Empire <strong>State</strong> grossed $5,082,300 at auction, including 12 that went for six-figure<br />

bids. <strong>To</strong>p-priced among the dozen was a filly by Henny Hughes out of Open Window,<br />

by Trempolino, that was purchased for $275,000 by <strong>Thoroughbred</strong> Futures at Fasig-<br />

Tipton Florida's select sale at Calder. That filly, named Midnight Visit, was bred by<br />

Dr. Jerry Bilinski.<br />

<strong>New</strong> <strong>York</strong>-bred weanlings sold at auction in 2010 totaled 46 that brought aggregate<br />

final bids of $1,369,500, and the two that went for six-figure prices included a colt by<br />

Rock Hard Ten out of Regard, by Fusaichi Pegasus, purchased for $300,000 by<br />

Westrock Stables, LLC at Keeneland's November sale. Named Taken for Granite, the<br />

2010 colt was bred by Berkshire Stud.<br />

An interesting common characteristic of the top-priced yearling, 2-year-old, and<br />

weanling among <strong>New</strong> <strong>York</strong>-breds sold at auction in 2010 was that all three had<br />

unprepossessing catalogue pages. None were out of dams that had won or placed in<br />

stakes competition (two of the dams were winless), and none were out of dams that had<br />

produced stakes winners. Some other factors appearance, racing and earning<br />

opportunities available, or perhaps the under-tack workout performance by 2-year-old<br />

Midnight Visit must have enhanced their attractiveness to buyers.


2010 Registry Compliance Report<br />

The underlying theme for the registry compliance team at the <strong>New</strong> <strong>York</strong> <strong>State</strong><br />

<strong>Thoroughbred</strong> <strong>Breeding</strong> and Development Fund in 2010 is one that will sound familiar<br />

to those working under economic constraints at every level from farm to state agency:<br />

doing more with less.<br />

This was the first full year that the Funds Field representatives worked under a 2009<br />

directive from the Board of Directors to keep a watchful eye on the health and welfare<br />

of thoroughbreds. It was a duty added in the wake of the 2009 rescue of dozens of<br />

animals from the Greene County farm of breeder Ernie Paragallo.* Mr. Paragallo was<br />

subsequently convicted in March 2010 on 33 counts of animal cruelty, and was<br />

sentenced in May to 2 years in prison and fined $33,000. He was released on bail the<br />

following month to appeal his sentence. Of the 96 horses taken from his Center Brook<br />

Farm in Climax, 6 had to be euthanized and the Columbia-Greene Humane Society<br />

cared for or found responsible homes for the remainder.**<br />

<strong>To</strong> maximize the effectiveness of the Field Team (currently consisting of <strong>To</strong>m Conley<br />

and <strong>To</strong>m Reynolds), Investigator Sue McDonough (<strong>State</strong> Police, retired) was invited<br />

by Executive Director Tracy Egan to review Article 26 of the Agriculture and Markets<br />

Law. Inv. McDonough shared that in her 26 years as a trooper, and now as an animal<br />

advocate, the majority of problems she has witnessed lie in the category of negligence<br />

resulting from ignorance, a lack of interest, or financial problems. She said that the<br />

first thing she does to help a horse is to help the owner understand that theres a<br />

problem and to try to help them rectify the situation.


Regular Duties of the Field Representatives<br />

<strong>To</strong> the many people who live and work on farms across the state, the field<br />

representatives serve as the public face of the <strong>Breeding</strong> Fund. Typically, the field<br />

reps visit each of our more than 300 farms at least once per year. In the photo below,<br />

field rep <strong>To</strong>m Conley demonstrates to Executive Director Tracy Egan how he confirms<br />

the identify of a mare residing at High Cliff Farm in Delanson, Schenectady County.<br />

During farm visits, they check each mares tattoo numbers or the identifying markings<br />

written on the mares Jockey Club papers, to enable them to document an individuals<br />

status as a resident or non-resident broodmare. They not only count the number of<br />

mares at each farm, they also note whether she is in-foal and, if so, to which stallion<br />

and whether it is a <strong>New</strong> <strong>York</strong> or out-of-state stallion. The inspectors keep track of<br />

barren mares as well. In addition, if a mare (whose file travels with the inspectors such<br />

as <strong>To</strong>m Conley, as shown in the photo below) no longer resides on the farm, inspectors<br />

will mark down whether she left the state, moved to another farm in the state, or is<br />

deceased, retired, sold, or has been given away.<br />

The information gathered at the farm level is logged into spreadsheets that are used by<br />

the registrar and by the Funds central office to confirm that an individual horse is<br />

eligible to be registered as a NY-bred. This registration adds tremendous value to a<br />

horse as a sales prospect and can return award money to the hard-working breeder, so<br />

the work performed by the field team is crucially important to protecting the vast<br />

majority of breeders who understand and abide by the strict rules of the NY-bred<br />

program.


Because green space is so important to the mission of the Fund, the inspectors also take<br />

note of acreage, number of buildings, barns, stalls, and fenced paddocks. In spite of<br />

the decline in the number of farms in the state to 307, the field representatives estimate<br />

<strong>New</strong> <strong>York</strong> breeding farms still encompass some 35,000 acres.<br />

Field Reps Promote the Program<br />

The field representatives have proven time and again that they are able communicators<br />

when it comes to spreading the word about the strength of the <strong>New</strong> <strong>York</strong> <strong>State</strong><br />

<strong>Thoroughbred</strong> <strong>Breeding</strong> and Development Fund Program. They travel armed with a<br />

thorough understanding of how our program works and stay informed about challenges<br />

facing the Fund, such as the 2009 bankruptcy filing of NYC OTB (the Funds largest<br />

contributor) and its closure in late 2010. They offer to leave brochures provided by<br />

NYTB, Inc. that promote both the Fund programs and the benefits of trade-group<br />

membership, so that farms can pass along the promotional information to current or<br />

potential customers.<br />

In 2010, the Fund also provided representatives with brochures to distribute concerning<br />

the issues of unwanted horses and responsible horse ownership.<br />

Budget Crunch Hits Field Team<br />

The financial statements included in this report detail how a decline in handle hurt<br />

revenue streams to the Fund. As such, the Board of Directors furloughed the newest<br />

member of the field team from September through December. At its December<br />

meeting, the third position on that field team, held by Jim Zito, was eliminated. The<br />

Fund is grateful to Jim for his years of service to the Fund and the people we serve,<br />

and wishes him well in his future endeavors.<br />

*In 2010, the Board formally instituted a new rule that awards will be temporarily withheld from<br />

persons accused of animal abuse, and would not be paid to anyone convicted of felony animal abuse.<br />

** In the summer of 2010, the Funds Executive Director visited two farms that helped the Columbia-<br />

Greene Humane Society rehabilitate the rescued horses. All of the horses appeared to be in good health,<br />

with plenty of body weight, shiny coats, and trimmed feet.


2010 – The Odyssey of <strong>New</strong> <strong>York</strong>-Breds Enters a <strong>New</strong> Era<br />

Despite adversity on a variety of political and economic fronts away from racetracks,<br />

breeding farms, and auction pavilions, 2010 was the year when the <strong>New</strong> <strong>York</strong><br />

<strong>Breeding</strong> and Racing Program coalesced into unprecedented success in racing, sales,<br />

and acquisition of stallion talent. For the first time ever, four <strong>New</strong> <strong>York</strong>-breds won<br />

Grade/Group 1 races in a single season, as 5-year-old horse A Shin Forward, 4-yearold<br />

colt Haynesfield, 4-year-old filly Rightly So, and 3-year-old filly Franny Freud<br />

captured top-level events. Rightly So's unraced <strong>New</strong> <strong>York</strong>-bred dam was sold for<br />

$1,050,000 at Keeneland, and 563 <strong>New</strong> <strong>York</strong>-bred weanlings (46), yearlings (385), and<br />

two-year-olds in training (132) brought prices totaling more than $16.4 million during<br />

2010.<br />

Two <strong>New</strong> <strong>York</strong>-based stallions Posse and Freud had 2010 progeny earnings<br />

topping $4 million, three had offspring earnings exceeding $3 million, and eight (all<br />

scheduled to stand in the Empire <strong>State</strong> in <strong>2011</strong>) boasted progeny bankrolls of more<br />

than $2 million each in 2010.<br />

Worldwide in 2010, there were 3,781 <strong>New</strong> <strong>York</strong>-bred starters, and they earned<br />

$69,289,272. Two <strong>New</strong> <strong>York</strong>-breds Haynesfield and Monmouth turf icon Get<br />

Serious became new millionaires in 2010.<br />

The onslaught of <strong>New</strong> <strong>York</strong>-bred open stakes success in 2010, when 25 state-breds<br />

won black-type stakes in unrestricted company and nine tallied 17 times in<br />

graded/group events, began on the weekend of February 27-28. That Saturday, Jeff<br />

Fletcher's and Hamilton Hale's 3-year-old son of state-based sire Catienus, Dont Blame<br />

the Cat, won Laurel's seven-furlong Miracle Wood Stakes, and Alan Brodsky's 4-yearold<br />

filly, Don't Forget Gil, captured Tampa Bay Downs' 1 1/16-mile Wayward Lass<br />

Stakes. On Sunday, Eishindo Company's <strong>New</strong> <strong>York</strong>-bred millionaire, A Shin Forward,<br />

scored his first group-level victory in the seven-furlong Hankyu Hai on Japanese turf.<br />

The following Saturday (March 6), Chester and Mary Broman's <strong>New</strong> <strong>York</strong> homebred<br />

3-year-old filly, Khancord Kid, took Gulfstream Park's graded Herecomesthebride<br />

Stakes at 1 1/8 miles on turf. About two hours earlier, <strong>New</strong> <strong>York</strong>-bred Castaneda had<br />

romped by three lengths in a front-running effort for Team Stallion Racing Corp., John<br />

Moirano, and Harold Lerner in Aqueduct's six-furlong Fred "Cappy" Capossela Stakes<br />

for open 3-year-olds. Five days later (March 11) at Aqueduct, Blue Bison Stable's and<br />

Stewart Hoffman's <strong>New</strong> <strong>York</strong>-bred daughter of in-state sire Congaree, Shine Upon,<br />

took the Dreamy Mimi Stakes for open 3-year-old fillies going a mile and 70 yards at<br />

Aqueduct.<br />

In April, <strong>New</strong> <strong>York</strong>-breds invaded Kentucky and came away with three graded stakes<br />

victories. On April 7, the amazingly versatile Franny Freud, a semi-homebred daughter<br />

of in-state sire Freud racing for Paul Pompa Jr., Stephen Yarbrough, and breeder<br />

Anthony Grey, scored by 4 ¾ lengths in Keeneland's Grade 2 Beaumont Stakes for 3-<br />

year-old fillies going just beyond seven furlongs on Polytrack. Three days later on


Keeneland turf, Michael Dubb's and High Grade Racing Stable's 7-year-old Silver<br />

Timber registered the first of back-to-back graded grass sprint wins in April by taking<br />

the 5 ½-furlong Shakertown Stakes. On April 30, Silver Timber was on Churchill<br />

Downs' lawn, where he shouldered top weight to win the graded Churchill Downs Turf<br />

Sprint in a stakes record clocking of 55.45 for five furlongs.<br />

Another daughter of Freud, Repole Stable's 5-year-old Lights Off Annie, gained her<br />

first open-company black type on Preakness eve (May 14) with a 5 ½-length romp in<br />

Pimlico's six-furlong Skipat Stakes. She had previously won the latest two renewals of<br />

Aqueduct's Broadway Stakes for <strong>New</strong> <strong>York</strong>-bred fillies and mares. The next day at<br />

Delaware Park, owner-trainer Wesley Ward's first-out-winning (at Keeneland) juvenile<br />

<strong>New</strong> <strong>York</strong>-bred filly, Final Mesa, registered a facile 4 ¾-length triumph in the fourfurlong<br />

Polly Drummond Stakes on conventional dirt. Eight days later on May 23,<br />

Anstu Stables' 2009 <strong>New</strong> <strong>York</strong> <strong>Thoroughbred</strong> Breeders (NYTB) juvenile male<br />

champion, Ibboyee, won Monmouth's Spend a Buck Stakes at a mile and 70 yards for<br />

3-year-olds.<br />

<strong>New</strong> <strong>York</strong>-breds captured five stakes at four different tracks in <strong>New</strong> Jersey,<br />

Pennsylvania, Virginia, and Ontario (Canada) during June, beginning with Silver<br />

Timber's third consecutive stakes tally of 2010 while under top weight in Monmouth's<br />

Wolf Hill Stakes at about 5 ½ furlongs on turf on June 5. Three days later, Everything's<br />

Cricket Stable's multiple turf sprint stakes-winning 6-year-old mare, Ahvee's Destiny,<br />

got her first synthetic surface black-type victory in Presque Isle Downs' Satin and Lace<br />

Stakes at 5 ½ furlongs over the Tapeta strip. On June 12, perennial <strong>New</strong> Jersey<br />

standout Get Serious, a 6-year-old <strong>New</strong> <strong>York</strong>-bred racing for James Dinan, Jacques<br />

Moore, and Phantom House Farm, inexplicably was overlooked in the graded<br />

Monmouth Stakes at 1 1/8 miles on turf but defeated eight rivals four of them<br />

favored over him. A week later, Benchmark Racing Stable's Lady Rizzi, a 7-year-old<br />

always-improving <strong>New</strong> <strong>York</strong>-bred mare, gained her first black type by winning<br />

Colonial Downs' 5 ½-furlong Buckland Stakes on turf over 10 rivals, despite breaking<br />

from the tenth post. On the final Saturday of June, Final Mesa improved to three-forthree<br />

with a 7 ¾-length laugher in Woodbine's My Dear Stakes at five furlongs on<br />

Polytrack. (She's for real; on <strong>January</strong> 5, <strong>2011</strong>, she won Gulfstream's graded Old Hat<br />

Stakes at six furlongs on dirt for newly minted 3-year-old fillies.)<br />

Turtle Bird Stable's 2009 NYTB Horse of the Year, Haynesfield, won Belmont's<br />

historic Grade 2 Suburban Handicap at 1 1/8 miles on July 3 by 2 ¾ lengths, marking<br />

his fourth consecutive victory and second score of 2010 following an overnight mile<br />

tally at Belmont 20 days earlier. On July 4, Franny Freud took Belmont's Grade 1<br />

Prioress Stakes at six furlongs, stamping herself as arguably the best 3-year-old sprint<br />

filly in North America and becoming the only 2010 stakes winner at that time on dirt,<br />

synthetic, and turf. On the Monday, July 5 holiday of the Independence Day weekend,<br />

Zayat Stables' Rightly So, a 4-year-old daughter of in-state sire Read the Footnotes, led<br />

throughout under top weight in Belmont's graded Bed o' Roses Handicap at seven<br />

furlongs, capping probably the best three-day span ever for <strong>New</strong> <strong>York</strong>-breds.<br />

On July 17, another unbeaten <strong>New</strong> <strong>York</strong>-bred juvenile stakes winner emerged at<br />

Woodbine a la the aforementioned Final Mesa in Martha Gonzalez's Glory Game,<br />

who won the $142,215 (in U.S. funds) Colin Stakes at six furlongs on Polytrack by two


lengths over a prohibitive odds-on (and stakes-winning) favorite. On July 30,<br />

Obviously NY Stable's three-time NYTB champion of 2009 (older female, turf female,<br />

sprint female), 5-year-old Canadian Ballet, captured Penn National's six-figure Jenny<br />

Wade Handicap at five furlongs on turf in 55.64 while under top weight.<br />

Get Serious scored his second of three graded turf victories of 2010 in Monmouth's 1<br />

1/16-mile Oceanport Stakes on August 1. Six days later, Landsdowne Stables' <strong>New</strong><br />

<strong>York</strong>-bred Sharp Secretary won Woodbine's $147,118 (in U.S. funds) Duchess Stakes<br />

for 3-year-old fillies going seven furlongs. The next day, JMJ Stables' <strong>New</strong> <strong>York</strong>-bred<br />

son of Read the Footnotes, Out of Respect, won Monmouth's Select Stakes for 3-yearolds<br />

by daylight over the 1-to-2 favorite (by <strong>New</strong> <strong>York</strong>-based sire Posse) who was<br />

coming off five consecutive stakes victories. On the final Saturday of August, Rightly<br />

So became the second <strong>New</strong> <strong>York</strong>-bred Grade 1 winner of the summer with a fourlength<br />

gate-to-wire domination of Saratoga's seven-furlong Ballerina Stakes,<br />

advancing to the head of the class among 2010's female dirt sprinters.<br />

Get Serious returned to Monmouth turf for his third graded victory and fourth win (in<br />

five starts) of 2010 on Labor Day eve (Sunday, September 5), capturing the one-mile<br />

Red Bank Stakes under top weight at odds-on and bettering his own course record set<br />

in 2009 by clocking 1:32.37. That victory, registered over five foes carrying five to<br />

seven pounds less than the <strong>New</strong> <strong>York</strong>-bred winner, and coming despite his stumbling<br />

and bumpy start, boosted Get Serious' earnings to $1,000,691, making him the 23rd<br />

millionaire bred in the Empire <strong>State</strong>.<br />

Another <strong>New</strong> <strong>York</strong>-bred NYRA stakes winner outside state-bred company emerged<br />

from the <strong>New</strong> <strong>York</strong> Stallion Stakes program when Aliyu Ben J Stables' homebred<br />

Freud colt, Lubash, took Belmont's one-mile Fifth Marine Stakes for eight 3-year-olds<br />

on yielding turf while carrying co-top weight on September 17. The next day,<br />

Hillwood Stable's first-out-winning (on turf) <strong>New</strong> <strong>York</strong>-bred, Bandbox, cruised to a 9<br />

½-length triumph in the six-figure Charles <strong>To</strong>wn Juvenile Stakes at a two-turn seven<br />

furlongs on dirt for his second of three consecutive wins.<br />

In Belmont's historic Grade 1 Jockey Club Gold Cup on October 2, Haynesfield did<br />

what no other horse not even future Hall of Fame member Zenyatta could do in<br />

2010, beating eventual Eclipse Champion Blame "handily" by four lengths in that 1 ¼-<br />

mile weight-for-age event. The victory made Haynesfield the 24th <strong>New</strong> <strong>York</strong>-bred<br />

millionaire, and eight weeks later he boosted his bankroll to $1,166,981 by placing a<br />

close second beaten a head while under co-top weight among nine in Aqueduct's<br />

Grade 1 Hill 'n' Dale Cigar Mile Handicap. A week later, Silver Timber got his fourth<br />

turf stakes victory of 2010 and third graded tally of the year by beating 10 rivals in<br />

Keeneland's 5 ½-furlong Woodford Stakes while carrying top weight. On October 29,<br />

Patsy Symons' <strong>New</strong> <strong>York</strong>-bred Gitchee Goomie proved that her solid third-placing at<br />

almost 22-to-1 among seven in Belmont's grassy Grade 1 Garden City Stakes 41 days<br />

earlier was no fluke when she won Belmont's 1 1/8-mile <strong>To</strong>picount Stakes for 11 open<br />

3-year-old fillies on turf.<br />

A flurry of <strong>New</strong> <strong>York</strong>-bred open stakes successes highlighted the six-day span from<br />

November 20 through Thanksgiving. Majesty Stud's homebred Stormy's Majesty, who<br />

had won Saratoga's Albany Stakes for state-bred 3-year-olds in August, captured


Aqueduct's graded Discovery Handicap at the Albany distance of 1 1/8 miles on<br />

November 20, scoring by two lengths over six rivals. Three weeks later, that first<br />

offspring produced by <strong>New</strong> <strong>York</strong>-bred mare Raffie's Dream (by in-state stallion and<br />

NYTB champion Raffie's Majesty) faced older foes in Aqueduct's graded Queens<br />

County Stakes at 1 3/16 miles and placed second, missing by a head to a 5-year-old<br />

carrying five pounds less weight.<br />

On November 21, another standout produced by a <strong>New</strong> <strong>York</strong>-bred mare, A Shin<br />

Forward, beat 17 rivals to win the Group 1 Japan Mile Championship (1,600 meters on<br />

turf) in a stakes record 1:<strong>31</strong>.80, boosting his 2010 bankroll to $2,273,386 and<br />

surpassing Funny Cide's single-season <strong>New</strong> <strong>York</strong>-bred earnings record. Now with<br />

career earnings of $3,374,068, A Shin Forward who had been purchased for<br />

$290,000 at Fasig-Tipton Florida's 2007 select sale of 2-year-olds in training at Calder<br />

is within less than $200,000 of Funny Cide's total record earnings for a <strong>New</strong> <strong>York</strong>bred.<br />

On the same Sunday as A Shin Forward's Group 1 triumph in Japan, Lubash scored by<br />

2 ½ lengths over seven rivals in Aqueduct's Monarch's Maze Stakes for open 3-yearolds<br />

going a mile on turf, getting his fifth victory (four on turf, one on dirt) of 2010.<br />

Winning by two lengths under equal top weight of 129 pounds in Aqueduct's graded<br />

Fall Highweight Handicap on Thanksgiving (November 25) was Vincent Scuderi's and<br />

James Riccio's <strong>New</strong> <strong>York</strong>-bred 6-year-old Endless Circle, who clocked the six furlongs<br />

in 1:09.79. It was Endless Circle's 11th career victory and eighth tally of 2010 (two<br />

others in stakes for state-breds) on the NYRA circuit, punctuating an exceptional<br />

season for the durable sprinter.


2010 NYTB Champions<br />

Intriguing developments emanating from the epic 2010 season involve the dilemmas of<br />

choosing certain NYTB champions.<br />

What Grade/Group-1 winner should be Horse of the Year: Haynesfield, the only<br />

conqueror of Eclipse Champion Blame in 2010; A Shin Forward, who shattered Funny<br />

Cide's single season earnings record for a <strong>New</strong> <strong>York</strong>-bred; or Franny Freud, who won<br />

stakes on dirt, synthetic, and turf<br />

Who deserves the Champion Turf Male Title: A Shin Forward; three-time graded<br />

winner (at three different distances) Get Serious; or three-time graded winner (and<br />

four-time turf stakes winner) Silver Timber<br />

What Grade-1 winner is most deserving for Champion Female Sprinter: multiplesurface<br />

star Franny Freud, who also beat males but raced exclusively against 3-yearolds;<br />

or Rightly So, whose graded wins came against fillies and mares from all crops<br />

Does graded winner Stormy's Majesty deserve Champion 3-Year-Old Male honors<br />

over Chester and Mary Broman's homebred Friend or Foe, who beat older <strong>New</strong> <strong>York</strong>breds<br />

(as well as Stormy's Majesty) in <strong>New</strong> <strong>York</strong> Showcase Day's Empire Classic and<br />

2010 marked the first year ever in which four different NY-breds won Grade-1 or<br />

Group-1 stakes.


Promotion and Advertising<br />

In 2010, for the second year in a row, the <strong>New</strong> <strong>York</strong> <strong>State</strong> <strong>Thoroughbred</strong> <strong>Breeding</strong> and<br />

Development Fund used NYTB, Inc. as its sole source provider for promotional<br />

services. <strong>New</strong> <strong>York</strong> <strong>Thoroughbred</strong> Breeders, Inc. is a trade and lobbying group that<br />

claims hundreds of NY breeders, owners, and stallion and farm owners as members. It<br />

does direct e-mailing to more than 4,000 individuals, and hosts or co-hosts events for<br />

established members of the racing community as well as newcomers and potential<br />

participants in <strong>New</strong> <strong>York</strong> racing.<br />

During 2010, the Fund paid out a net amount of $226,500 to NYTB Inc. Please review<br />

the NYTB promotional summary below.


The bulk of NYTBs advertisements were placed in the <strong>Thoroughbred</strong> Daily <strong>New</strong>s,<br />

which bills itself as the Wall Street Journal for the <strong>Thoroughbred</strong> Industry<br />

Worldwide. TDN is emailed daily to an estimated 6,000 people who are intimately<br />

connected with horse racing and breeding. The NYTB ads were placed on Tuesdays.<br />

Advertising was light in the first half of the year, when there was still uncertainty about<br />

VLTs and the effect of NYC OTBs bankruptcy on the <strong>Breeding</strong> and Development<br />

Fund. However, if you followed the ad campaign through the remainder of the year,<br />

you saw that it trumpeted the positive news about VLTs as well as the<br />

accomplishments of <strong>New</strong> <strong>York</strong>-breds. Here, we start spreadin the news about the<br />

VLTs being a done deal.


This next ad trumpets the fact that NY-Bred Rightly Sos Grade I win at Saratoga<br />

punched her ticket to the Breeders Cup, and that yearlings of 2010 will be the first crop<br />

to race for VLT-enhanced purses in <strong>New</strong> <strong>York</strong>.<br />

The Fund would like to point out that in response to requests from some breeders to<br />

counter the magazine advertising campaign run by the Indiana program, the Fund paid<br />

half the cost (NYTB paid the other half) to place a cover tip ad in The Blood-Horse


Magazine. As luck would have it, the ad just happened to be on the Zenyatta<br />

(Breeders Cup Classic winner and eventual 2010 Horse of the Year) commemorative<br />

edition, so it is a promotion that should have a lasting effect.


There were many more ads that ran over the course of the past year, and the Fund<br />

looks forward to collaborating with NYTB, Inc. in <strong>2011</strong> as we help promote the<br />

responsible breeding and ownership of quality <strong>New</strong> <strong>York</strong>-breds.<br />

Additionally, the Fund gave its website a new, updated look and, we hope, made it<br />

more user-friendly. In early <strong>2011</strong> we will be moving back to our original web address,<br />

www.nybreds.com, where we will continue to keep members of the industry informed<br />

about the issues affecting the breeding and racing industries in <strong>New</strong> <strong>York</strong> <strong>State</strong>.


<strong>Breeding</strong> Programs in Other <strong>State</strong>s<br />

The merit of breeding programs in other states, and their ability to compete with the<br />

<strong>New</strong> <strong>York</strong> breeding program, was closely tied in 2010 to how each states breeding<br />

and racing interests fared in their interactions with their respective state lawmakers.<br />

Here, we look at some of some of the factors affecting breeding programs in other<br />

states.<br />

The state of INDIANA seemed solidly behind the efforts of ITOBA, the Indiana<br />

<strong>Thoroughbred</strong> Owners and Breeders Association, to attract more business to the<br />

state. ITOBA had a $200K advertising budget to buy cover tips on industry magazines<br />

and place commercials in which they boldly attempted to recruit breeders and owners<br />

to the state. As previously mentioned in this report (in the Promotions and Advertising<br />

section), many Empire <strong>State</strong> breeders felt that this was a direct challenge to our<br />

primacy and asked that we respond with a highly visible cover tip. While the tagline<br />

ITOBA website may make many smile, the organization is making a serious run at<br />

attracting industry dollars to their farms, training centers, and racetracks. The<br />

supportive attitude and funding of ITOBA allowed Indiana to offer a $4,000 increase<br />

in the award cap, bringing it to $14,000 for awards earned in restricted stakes races.<br />

(Note that NY awards are capped at $10k.) Prior to 2009, the minimum level to<br />

qualify for Out-of-<strong>State</strong> Breeder Awards was a claiming tag of $7,500 or higher, but<br />

that level has since been increased to $10,000. (Note that the <strong>New</strong> <strong>York</strong> program does<br />

not pay awards on any category of race run outside of NYS.)<br />

As bright as things appeared for the ITOBA programs in 2010, Blood-Horse<br />

commentator <strong>To</strong>m LaMarra suggested that there may be clouds on the Indiana horizon<br />

in one of his columns, saying that Indiana (is) poised to join Delaware, Pennsylvania,<br />

and West Virginia as states that have taken gaming revenue from racing and breeding<br />

to fund state programs.<br />

PENNSYLVANIA, which placed 62,000 slots machines across the state starting in<br />

2006, resurrected the states racing and breeding industries, but the state has since<br />

reached back in to take a share of the windfall for other state programs.<br />

Despite having to share their newfound wealth, PA horsemen and women still benefit<br />

from the lions share of the original statutory amount of 12% of slots revenue, which is<br />

directed to increased purses, improvements at racetracks, and the states breeding<br />

program. When lawmakers adopted a budget in October 2009, it included a siphoning<br />

of 17% of the breeding and racing program money over the next four years. <strong>To</strong> put it<br />

another way, the PA programs are taking a hit of $2.7 million a year through fiscal<br />

year 2012-2013.


Still, the positive impact of slots on the racing industry in PA cannot be overstated.<br />

Richard McGarvey, spokesman for the Pennsylvania Gaming Control Board, was<br />

quoted on 12/29/10 by a suburban Chicago newspaper, The Daily Herald, as saying It<br />

has certainly taken an industry that was flat on its back and revitalized it. Youre<br />

seeing more racing dates in Pennsylvania. Youre seeing more breeding in<br />

Pennsylvania, more barns opening that werent here before. That same gaming board<br />

put out a report in Nov. 2010 demonstrating that live racing helps stimulate slots<br />

gambling, and therefore revenue for the state. Gross terminal revenues go up by an<br />

average of $56,000 on race days. While many racing fans complain that some<br />

racetrack casinos make it difficult to even find the racetrack, the Pennsylvania numbers<br />

demonstrate that while slots were meant to help racing, a live racing product also<br />

helps slots revenue.<br />

The significance of <strong>New</strong> <strong>York</strong>s Southern Tier neighbor funding a $23-million<br />

campaign to turn Pennsylvania into Kentucky East is that their foal crop is climbing<br />

higher as <strong>New</strong> <strong>York</strong>s has been dropping. For example, in 2008 Pennsylvania reported<br />

1,510 PA-breds, just 378 fewer foals than were dropped on NY farms. As 2010 drew<br />

to a close, the 2009 PA registered foal crop stood at 1,277, with more registrations<br />

expected. The Fund reports 1,788 foals born on farms in <strong>New</strong> <strong>York</strong> during that same<br />

year.*<br />

Clearly, the PA program is taking a first-time Lasix, first blinkers, apprentice-jockey<br />

approach (in the form of a hipper website, YouTube videos, blogs, and a multi-media<br />

ad campaign), as they try to outpace the <strong>Breeding</strong> Program leader: the <strong>New</strong> <strong>York</strong><br />

<strong>Thoroughbred</strong> <strong>Breeding</strong> Program.<br />

LOUISIANA boasts a breeding program that began back in 1963, when just 146 foals<br />

were reported born on the states dirty dozen: a variety of 12 soil types, most of which<br />

were enriched by sediment deposits courtesy of the Mississippi, Ouachita, and Red<br />

Rivers. And LA breeders sure like raising horses: in 2008, the most recent year for<br />

which figures are available, 2,500 colts and fillies pushed their way out of their dams<br />

in the Pelican state.<br />

When it comes to mares bred in North America, Louisiana climbed to number two<br />

with a reported 3,093 mares sent to the breeding shed in 2010. Only Kentucky<br />

reported more mares bred as the decade came to a close. This prompts some to point<br />

to the Pelican state as the best program in the nation. However, sheer numbers of foals<br />

and high purses dont tell the whole story when comparing programs.<br />

According to the Louisiana <strong>Thoroughbred</strong> Breeders Association, Louisiana's racing<br />

and breeding industry plays an important role in the state's economic well-being and<br />

contributes a significant source of state revenue. The combined impact of both racing<br />

and breeding and their related industries generates nearly $930 million annually and<br />

employs nearly 9,000 people.” In contrast, the racing and breeding industries in <strong>New</strong><br />

<strong>York</strong> <strong>State</strong> add an estimated $2.4 billion to the states economy and employ roughly<br />

35,000 people.


Like Pennsylvania, the purses in Louisiana are pumped up by slots revenue. The LAbred<br />

program can brag that the average purse for races run in Louisiana in 2009 was<br />

$25,000.<br />

For example, an article in the Times-Picayune quotes the owner of Le Mesa Stallions<br />

as pointing out a flaw in his states program: We I mean the state as a whole we<br />

have rewarded mediocrity. Brett Brinkman looks at LA largess and concludes that<br />

low-quality runners compete for too much money. Bottom-level LA-bred claimers<br />

chased after $12,000 dollars in purse money when they ran at the Fair Grounds in<br />

2010. Brinkman is again quoted, saying The overproduction of the lesser breed and<br />

the lesser quality has always been an issue in Louisiana. Critics like Brinkman<br />

conclude that where purses are fueled by slots revenue, breeders should try to breed<br />

better-quality horses. The danger of having an overpopulation of lesser horses is that<br />

they wont find a buyer or make an impact at the entry box, and therefore on state<br />

handle coffers. Since most breeders cant afford to race even a few of their homebreds,<br />

buyers are an absolutely crucial element of a successful breeding program. Steelyeyed<br />

realists know they probably wont find a pot of gold at the end of the finish line,<br />

but theyd like to come close to breaking even and to have fun along the way. <strong>New</strong><br />

<strong>York</strong>, which will probably see the first slots-enriched purses in the later half of <strong>2011</strong>,<br />

would do well to listen to Mr. Brinkmans cautionary note about his own program:<br />

Weve grossly, as a racing program, catered to the cheaper horses.<br />

FLORIDA: For the past decade and a half, breeders didnt have to check with the<br />

Jockey Club to know that Florida is the perennial Avis to Kentuckys Hertz in terms of<br />

the broodmare population in North America. This was not so in 2010. As mentioned<br />

above, Florida lost its second-place status to Louisiana. The 3,076 mares covered in<br />

2010 reflects a 23.9% decline from the year before, when 4,041 bred mares resided in<br />

the Sunshine <strong>State</strong>.<br />

Industry leaders across the nation can point to the struggling economy near decades<br />

end for many of the problems in racing/breeding. In Florida, the problems have led to<br />

some finger-pointing at the group that represents the breeders and owners in the state,<br />

the Florida <strong>Thoroughbred</strong> Breeders and Owners Association. Member Gordon Reiss,<br />

who also represents other breeders who were not happy with the leadership of the<br />

FTBOA, was quoted in a Dec. 1, 2010 article at Ocala.com, saying You can only<br />

blame the economy for so much. We had the biggest drop in number of mares bred in<br />

the country since 2008. We have mares and stallions leaving the state for Louisiana<br />

and other parts of the country with better incentive programs. What happened Why<br />

are we lagging far behind<br />

For its part, FTBOA is on the record as defending its lobbying efforts on behalf of<br />

breeders in the <strong>State</strong> Capital. In fact, in 2010, the membership group was able to<br />

convince lawmakers to lower taxes on slot-machine revenue from 50% to 35%. This<br />

allowed the group to add some flexibility to its awards system. In the past, Florida<br />

only paid awards at the win level. Its expected at this writing that the state will<br />

approve a change such that awards will be offered for horses finishing first, second,<br />

and third.


Also, FTBOA expects to be able to pay out-of-state Breeders Awards for Floridabreds<br />

that win one of the most popular betting events of the winter race season, the<br />

Sunshine Million races in California.<br />

On the promotion front, the Florida breeding program joins its Department of<br />

Agriculture in paying for ads that proclaim: Floridathe Best <strong>State</strong> to do Business.<br />

Among the positives mentioned in the ads:<br />

¨ No personal state income tax<br />

¨ No individual capital gains tax<br />

¨ Florida ranked third in U.S. in number of horses and size of its horse industry<br />

¨ Floridas greenbelt exemption providing property-tax breaks for FL horse<br />

farms<br />

Perhaps the crowning achievement in 2010 for the Florida horse industry is the fact<br />

that three Florida-breds won Breeders Cup races: Dubai Majesty, Awesome Feather,<br />

and Big Drama. <strong>New</strong> <strong>York</strong>-breds did not make the winners circle this past year;<br />

however, a record five were entered. The <strong>New</strong> <strong>York</strong> <strong>Thoroughbred</strong> <strong>Breeding</strong> and<br />

Development Fund is confident that seeing the likes of Canadian Ballet, Deciphering<br />

Dreams, Haynesfield, Rightly So, and Silver Timber earning the right to compete on<br />

racings biggest stage set an example of excellence that will inspire other <strong>New</strong> <strong>York</strong><br />

breeders to dream big and adjust their breeding programs accordingly, to reach racings<br />

highest level with the Empire <strong>State</strong>s product.<br />

* In 2001, before Pennsylvania launched its effort to boost purses, gambling revenue, and agricultural<br />

income, as well as to lure tourism dollars to the Keystone <strong>State</strong>, just 901 thoroughbreds were foaled<br />

there. Thats fewer than half the number born in NY that same year, when the Fund registered 1,985<br />

foals.

The following section concerns some of the comments and insights of individuals who<br />

have invested in horse farms and horse flesh in the Empire <strong>State</strong>. Additionally, we<br />

have included a newspaper article about the Greene County District Attorney who was<br />

honored for his dogged pursuit of a now-convicted horse abuser. Some of the<br />

comments come to the Fund via email, others by mail, and some are letters scanned<br />

and sent via email attachments.<br />

Finger Lakes Racing in Farmington has a significant economic impact because their roots<br />

run deep into area towns and counties. This is a community track. We have about 115<br />

trainers here. Nearly all of them live here; they have farms here. They absorb most all the<br />

hay and straw around here for a hundred miles. There are hundreds of farms that supply<br />

goods and services to the track. That pours money into the economy. Additionally, local<br />

businesses that include service stations, farm equipment, waste management,<br />

manufacturers, and restaurants benefit from racing.<br />

A 2007 study showed Finger Lakes economic impact on the region to be $120 million<br />

annually. Thats was based on the earnings and spending of 475 track employees and the<br />

1,298 working independently in racing.<br />

Statistical information:<br />

· In 2010, we had 275 NY Bred races offered and 179 races filled for racing. That<br />

is 12.2% of our total (1,467) races held in 2010<br />

· There are approximately 162 Finger Lakes Racing Association employees and<br />

approximately 820 working independently during live racing for 2010.<br />

· The average live handle per horse per race was $15,888<br />

· Our racing tax on live and simulcast was approx. $400k in 2009<br />

In response to your newsletter dated Oct 2010, which made request for comments, I<br />

offer the following, which you may share with the Chairman's committee or anyone else:<br />

Replicating Florida's example of discontinuing stallion awards for departed stallions<br />

would be: A) ill-conceived, B) illogical, and C) counter-productive.<br />

A) Building a stallion base in the state is certainly one facet of the industry that the Fund<br />

has the ability to influence. By touting stallion awards, it has the bully pulpit to<br />

successfully argue that it would be indeed a profitable venture for any stallion owner or<br />

manager. However, by forcing any stallion owner or syndicate to remain in the state to<br />

collect awards from foals already produced is a disincentive that only sullies the<br />

credibility of the program, and hence foster skepticism. Therefore this measure would<br />

be ill-conceived.


B) It is illogical because you are punishing one group among the breeder's and<br />

rewarding another, at the formers expense. Why not stop paying breeder's awards from<br />

mares that likewise leave the state<br />

C) It is counter-productive because NY is considerably smaller than Florida and their<br />

paradigm is irrelevant (not that I would argue that they are right, on the contrary). No<br />

doubt Florida was used as a proving ground for stallions because of the vast amount of<br />

mares that professional horsemen bred, then broke, trained and raced or sold their<br />

progeny. Florida, with its 12 month training climate, and the vast amount of training<br />

tracks proved invaluable to facilitate the development of 2 yr-olds, and hence the quick<br />

boost to first and second year sires. This made the hot young stallions ripe to be<br />

relocated to Kentucky, or even now abroad, as they were given a jump-start. Mr.<br />

Prospector immediately comes to mind. Of course Florida did not have the deep<br />

pockets within the breeding community to protect a great young sire, and hence the<br />

stallions followed the market, as they should.<br />

NY's situation is not comparable, because of the relatively small population of mares,<br />

and the longer time that the average NY Bred takes to get to the races. Our gene pool is<br />

so small that it would be most beneficial to every breeder to circulate stallions through<br />

the state, not incarcerate them in it.<br />

Example: A new farm locates within our borders and brings a flashy, well-bred, newly<br />

retired G1, maybe eventually a classic winner to stand. The farm sends nearly all it's<br />

mares to support the horse in years 1 and 2. Other in-state breeder' flock to the stallion<br />

in those first two years. Then what happens Anyone with good mares and good<br />

sense breeds their mares to other stallions after that. Who will be left to support that<br />

stallion The stallion manager will be fighting for his financial survival because of the<br />

incredibly small amount of mares remaining that have not been bred to him in the first 2<br />

years, most of which would be inferior to the mares previously bred. His CI would drop<br />

precipitously. The stallion manager needs to be free to market any stallion where it is<br />

most in demand, without punitive damages assessed after the fact, for work already<br />

done, and future bonuses already earned.<br />

In fact, a case could be made that it would be more beneficial to all breeder's if<br />

additional rewards were given to any stallion that departs the state after standing for 2<br />

years (tongue-in-cheek). The breeders of the state would be much better served if we<br />

had revolving stallions, shuttling from state to state, ala Catienus, or state to other<br />

countries. If the stallion awards were predicated on stallions remaining in the state in<br />

perpetuity, it would be difficult to construct such revolving stallion deals,<br />

thereby shackling the breeders, and likewise repressing the stallion managers from<br />

attaining new stock, as they weigh the potential monetary benefits from future stallion<br />

awards against the risk of new investment.<br />

Perish the thought of regulating against horse-trading. All ships are lifted with a rising<br />

tide. Don't try to hold the tides back, as the tide waits for no man. Good business will go<br />

elsewhere if you try.<br />

Re: Tracy's letter for October<br />

Having bred and raced numerous homebred over the last 30 years, we felt we should<br />

weigh in publicly on the subjects being addressed by this committee.<br />

YES-the fund should seek as commitment from NYRA to run a minimum number of<br />

races for NY-breds.<br />

YES- the awards for open company owners should be bumped up<br />

YES-stop paying awards to stallions that have left the state<br />

NO!!-award payments on low-level claiming races should not be eliminated- ALL ny bred<br />

races should pay awards to the breeders<br />

We, as a state breeding organization, should continually look around and learn from<br />

states such as Florida, Pennsylvania, and other entities. It is financially punishing<br />

enough to breed and raise horses in <strong>New</strong> <strong>York</strong> <strong>State</strong>. Doubly punishing to race in NY.<br />

The industry is important to all of us on all levels. Getting something back from<br />

enterprises that make huge profits from our products is important.<br />

CATSKILL — In the winner’s circle at the Saratoga Race Course Friday, the county’s top<br />

prosecutor was congratulated for convicting one of the thoroughbred industry’s most<br />

dastardly.<br />

Greene County District Attorney Terry Wilhelm was presented with a plaque for professional<br />

excellence in the successful prosecution and conviction of horse breeder Ernest Paragallo.<br />

Paragallo was found to have 177 malnourished thoroughbreds at Center Brook Farm in the<br />

town of Coxsackie, which were seized by the Columbia-Greene Human Society/SPCA on April<br />

9, 2009.<br />

Following a seven-day bench trial in March, Paragallo was found guilty of 33 misdemeanor<br />

animal cruelty counts for improper sustenance. He was sentenced to two years in jail and a<br />

$1,000 fine for each charge, the maximum allowed by law.<br />

The incident — and subsequent conviction — sent shockwaves throughout the thoroughbred<br />

and horse racing industries, and continues to redefine appropriate conduct for horse breeders<br />

throughout the state.


Wilhelm was presented the award on the eve of the Travers Stakes and in the company of<br />

some of the sport’s top competitors.<br />

He expressed gratitude during a phone interview Saturday and said he felt “humbled” after<br />

being presented the award.<br />

“It was just a wonderful day and I felt honored,” said Wilhelm. “This case seems to have had<br />

an effect on the regulatory agencies to increase monitoring of this type of activity. It’s so<br />

gratifying to think that our little trial is having such a profound impact on the industry.”<br />

The award was presented by the <strong>New</strong> <strong>York</strong> <strong>State</strong> Police, who conducted an extensive<br />

investigation in the case, the <strong>New</strong> <strong>York</strong> <strong>State</strong> Racing and Wagering Board, who has stripped<br />

Paragallo of racing and owners’ privileges, the <strong>New</strong> <strong>York</strong> <strong>State</strong> Racing Association, who has<br />

banned Paragallo from racing or visiting tracks, and the Columbia-Greene Humane<br />

Society/SPCA, who cared for and facilitated the adoption of nearly all the malnourished<br />

thoroughbreds found at the farm.<br />

Wilhelm acknowledged the help of his colleagues, particularly <strong>State</strong> Police Sgt. Lisa Herdman,<br />

who provided priceless amounts of thoroughbred and animal cruelty knowledge to assist in the<br />

prosecution, and veterinarian Dr. Jerry Bilinski, who worked for hours with Wilhelm to learn<br />

about the proper care, treatment and ownership of thoroughbreds.<br />

“A lot of cases have little special twists you have to be ready for,” Wilhelm said, “so I became<br />

immersed in the feeding, care and treatment of thoroughbreds. Those guys spend hours with<br />

me on this case.”<br />

Since the Center Brook Farm incident, new regulations adopted by state <strong>Thoroughbred</strong><br />

<strong>Breeding</strong> and Development Fund have resulted in more comprehensive inspections before<br />

awarding funds to breeders and suspension or revocation of funds to anyone implicated in<br />

horse cruelty.<br />

Paragallo faces further fines by the state Racing and Wagering Board in the amount of $5,000<br />

for each of his cruelty convictions.<br />

He was released in June from serving his two year jail sentence in Greene County Jail pending<br />

appeal.


EQUINE RESEARCH<br />

The <strong>New</strong> <strong>York</strong> <strong>State</strong> <strong>Thoroughbred</strong> <strong>Breeding</strong> & Development Fund Corporation gives<br />

two percent of its total annual revenue to the Harry M. Zweig Memorial Fund at the<br />

Cornell College of Veterinary Medicine in Ithaca, <strong>New</strong> <strong>York</strong>. In 2010, the Fund remitted<br />

the sum of $228,000 (preliminary figure).<br />

The board of directors of the Harry M. Zweig Memorial Fund consists of Dean Michael<br />

Kotlikoff of Cornell and of representatives of <strong>New</strong> <strong>York</strong>s thoroughbred and harness<br />

racing industries. The <strong>New</strong> <strong>York</strong> <strong>State</strong> <strong>Thoroughbred</strong> <strong>Breeding</strong> and Development Fund<br />

is currently represented on the Zweig Board by two members of the <strong>New</strong> <strong>York</strong> <strong>State</strong><br />

<strong>Thoroughbred</strong> <strong>Breeding</strong> and Development Funds board: John Sabini, Chairperson, and<br />

Dr. William B. Wilmot.<br />

At the annual meeting of the Zweig Fund, various equine research proposals are reviewed<br />

and evaluated. The Board then decides which proposals will be funded and at what level.<br />

Investment Policy<br />

A/O 12/<strong>31</strong>/08<br />

In 1983, in accordance with the requirements of Chapter 383 of the Law of 1983 (Public<br />

Authorities Law), the Fund duly adopted the following resolution.<br />

RESOLVED that, in accordance with requirements of Chapter 838, Section 25 of the<br />

Laws of 1983, the <strong>New</strong> <strong>York</strong> <strong>State</strong> <strong>Thoroughbred</strong> <strong>Breeding</strong> & Development Fund<br />

Corporation, a public benefit corporation, hereby approves and adopts the following<br />

investment guidelines:<br />

A) All funds of the corporation available for investment shall be deposited<br />

in interest-bearing accounts or certificates of deposits with banks in<br />

<strong>New</strong> <strong>York</strong> <strong>State</strong> for the shortest possible period and at the highest<br />

available interest rate; or in United <strong>State</strong>s Treasury short-term bills or<br />

notes at the highest available rate.<br />

B) There shall be no other form of investment.<br />

C) Certificates of deposit shall be fully secured.<br />

D) The independent auditors of the corporation shall annually review and<br />

examine the corporation's investments, and shall immediately report to<br />

the directors of the corporation any variance from the foregoing<br />

requirements.

Procedures for establishing compliance with or satisfaction of such rules shall be<br />

established by the Fund and administered by its Executive Director.<br />

No horse shall be considered a <strong>New</strong> <strong>York</strong>-bred thoroughbred unless such<br />

horse is so registered by the Fund. Should the Fund be satisfied that grounds<br />

exist to cancel or void a registration, it may so determine and order any monies<br />

of the Fund due any person as a result of such questionable registration held and,<br />

if paid, to be returned to the Fund for proper disposition. In addition, pending<br />

such determination, the Fund shall be empowered to order retention of such<br />

monies as may be payable as a result of any questionable registration, for proper<br />

disposition, upon its final determination.<br />

For good cause shown, the Fund may order that any individual shall be disqualified<br />

from participating as a beneficiary of such Fund for such time as it may determine<br />

appropriate.<br />

(a) Definitions - as used in this article, the following terms shall mean:<br />

1. Fund: The <strong>New</strong> <strong>York</strong> <strong>State</strong> <strong>Thoroughbred</strong> <strong>Breeding</strong> & Development Fund<br />

2. <strong>Thoroughbred</strong>: A horse registered or qualified for registration as a thoroughbred by<br />

the Jockey Club<br />

3. Horse: Except when from the context it appears otherwise, shall mean horse,<br />

stallion, mare, gelding, ridgling, colt, or filly<br />

4. Foal: The offspring of a sire and dam, having been born<br />

5. Foaled: Born<br />

6. Sire: The male parent of a horse<br />

7. Dam: The female parent of a horse<br />

8. Breeder: The owner of the mare (dam) at the time it foals a <strong>New</strong> <strong>York</strong>-bred<br />

9. “<strong>New</strong> <strong>York</strong> Stallion”: A thoroughbred stallion standing in <strong>New</strong> <strong>York</strong> <strong>State</strong> and<br />

registered with the Fund in accordance with the law<br />

For requirements and regulations regarding your foals, please contact our offices.<br />

For foals of 1996 and beyond (1995 and subsequent breeding seasons), for a foal to qualify as a<br />

registered <strong>New</strong> <strong>York</strong>-bred, the dam of such foal must:<br />

A. Be continuously in residence in the <strong>State</strong> of <strong>New</strong> <strong>York</strong> from no later than 90 days after her<br />

last cover in the year of conception and thereafter remain in residence until foaling in <strong>New</strong><br />

<strong>York</strong> <strong>State</strong>; or<br />

B. Foal in the <strong>State</strong> of <strong>New</strong> <strong>York</strong> and be bred back to a registered <strong>New</strong> <strong>York</strong> stallion and<br />

thereafter remain in <strong>New</strong> <strong>York</strong> for a continuous period of 90 days after giving birth to such<br />

foal.<br />

These simple rules effectively create two categories of mares resident mares and transient or<br />

visiting mares and should more participation in the Fund program more attractive for prospective<br />

breeders and owners.
