RULES AND REGULATIONS<br />

SUN VALLEY WEST CONDOMINIUM ASSOCIATION<br />

INTRODUCTION: It is to the benefit of all owners and residents that <strong>rules</strong> and<br />

<strong>regulations</strong> for the common good and enjoyment of members are implemented. The<br />

protection of the owner’s investment, enhancement of property values and the<br />

improvement of the general environment are goals. These <strong>rules</strong> and <strong>regulations</strong> are<br />

implemented and adopted by the Board of Directors under the authority of Page 11,<br />

Paragraph 17 of the Covenants and Article 1V, Section 4.3 of the By-laws for Sun Valley<br />

West.<br />

These <strong>rules</strong> and <strong>regulations</strong> supersede any and all previously adopted. These were<br />

adopted unanimously by the Board of Directors.<br />

1. PETS<br />

A. No animals are allowed to be kept on any part of the Project except<br />

domesticated dogs weighing less than thirty pounds, cats, birds or fish.<br />

B. Dogs are not allowed on the Common Elements unless on a handheld<br />

leash. Dogs are not permitted to be chained or tied to fences, trees, posts, stakes,<br />

etc.<br />

C. No household pets shall be housed or maintained anywhere in the Project<br />

except inside an individual residence and not on patios or balconies or Common<br />

Elements.<br />

D. Each owner or resident who owns or is in the control of any animal within<br />

the development shall be personally liable for any damages caused by the animal<br />

to the property of another and any damage caused by the animal to the common<br />

area and grounds of the Sun Valley West development.<br />

E. No pet may be kept, bred, maintained for any commercial purposes.<br />

F. Any overly aggressive, mean, or vicious actions from a pet should be<br />

reported to the police immediately.<br />

G. Pet owners and residents are required to clean up after their pets<br />

immediately. Owners or residents are not permitted to allow their dogs to roam<br />

unattended and or off leash. This is in compliance with Lakewood City Animal<br />

Control ordinances.<br />

2. MAINTENANCE RESPONSIBILITY<br />

A. Owners or residents shall maintain, clean and keep in a neat and clean<br />

condition the area adjoining and or leading to a Unit.<br />

B. No noxious, offensive, hazardous or annoying activity shall be carried on<br />

or upon any part of the Project.<br />

C. No owner or resident shall keep or store anything on or in any of the<br />

general Common Elements <strong>inc</strong>luding stairways and entryways to a Unit.<br />

3. PARKING<br />

A. No part of the Project shall be used as a parking, storage, display or<br />

accommodation area for any type of house trailer, camping trailer, boat trailer,<br />

hauling trailer, boat, large truck or recreational vehicle except as a temporary<br />

expedience for loading, delivery, emergency, etc.<br />

B. All vehicles parked at Sun Valley must be in operable condition and<br />

display current license plates.<br />

C. No excessively noisy vehicles shall be permitted on the premises.<br />

D. There shall be no repair of vehicles on the premises except in the garages.<br />

Any damages caused to any part of the project shall be the responsibility of the<br />

owner or tenant.<br />

E. A resident shall be defined as anyone spending three (3) nights per week<br />

or more at Sun Valley West.<br />

F. Residents who use Visitor Parking spaces for their own cars or for storage<br />

of automobiles will be subject to ticketing, towing or fines.<br />

G. Visitor parking is for temporary parking for non-residents only with an<br />

eighteen hour maximum. Anyone who is defined as a resident above or parking<br />

for more than eighteen hours in visitor parking will be subject to fines and/or<br />

towing.<br />

H. Residents must keep garage doors closed and locked when not in use.<br />

I. There shall be no parking in the fire lanes.<br />

ENFORCEMENT<br />

1st Offense - WARNING (For parking violations - this can be either a written<br />

notification through the mail or a sticker placed on the vehicle).<br />

2nd Offense - $25 fine issued<br />

3rd Offense - $50 fine issued<br />

4th Offense - $75 fine issued<br />

5th Offense - $100 fine issued<br />

4. POOL RULES<br />

A. Swimming pool hours are 6 a.m. to 10 p.m. Sunday through Thursday. The<br />

poo1 will remain open until 11 p.m. on Fridays and Saturdays.<br />

B. The pool will be closed when the weather conditions deem it necessary<br />

(lightning, hailstorm or temperature below 65 degrees).<br />

C. Reckless play, running, spitting, undue splashing, excessively loud radios<br />

or cassette players are not allowed.<br />

D. Frisbees and balls are not allowed due to the small size of the pool area.<br />

Inflatable beach balls are allowed.<br />

E. Floatation devices are allowed only if they do not interfere with other<br />

swimmers.<br />

F. Guests must be accompanied by an owner/tenant. The maximum number<br />

of guests at any one time is two.<br />

G. For safety, children 14 and under must be accompanied by an adult 18<br />

years or older at all times when in the pool area.<br />

H. Diapers, whether cloth or disposable, must be covered with rubber pants.<br />

I. Proper swim attire is required; no cutoffs or jean shorts.<br />

J. The pool may be reserved by an owner or resident for parties after 7 p.m.<br />

with a limit of 20 people, and the homeowner or resident must be present. Youth<br />

(persons under 14) may attend parties only if accompanied by an adult 18 years or<br />

older.<br />

1. A $100 damage deposit is required for all pool parties. No<br />

exceptions.<br />

2. Said deposit will be refunded to the homeowner if the pool<br />

committee representative does not report any damage to the pool area.<br />

3. All reservations must be made one week in advance by contacting<br />

the Board at the Sun Valley West Phone Line at 720/562-2238 or the email<br />

at info@<strong>sun</strong><strong>valley</strong><strong>west</strong>.org.<br />

4. It is understood that even if the pool has been reserved for a party,<br />

any homeowner may use the pool at the time of the party.<br />

K. Persons with communicable or infectious diseases, open sores, cuts,<br />

bandages or recent vaccinations should refrain from using the pool while these<br />

conditions exist.<br />

L. Glassware, gum, candy or chewing tobacco are not allowed in the pool<br />

area at any time.<br />

M. Bicycles, tricycles, skateboards, roller skates, or other play equipment are<br />

not allowed in the swimming pool area.<br />

N. Pets are not allowed in the swimming pool area. They are not to be in any<br />

part of the common area around the pool, whether leashed or unleashed. The<br />

owner will be asked to leave and take his/her pet home.<br />

O. Pool furniture is on a “first come, first served” basis. However, if<br />

availability of furniture is minimal, the furniture should be reserved for use by<br />

adults first.<br />

P. Owners and residents will be financially responsible for any damage to the<br />

pool, pool area or pool furniture, due to negligence on their part or on the part of<br />

their guests.<br />

Q. Jumping the pool enclosure fence is prohibited. Violators will be<br />

prosecuted. Entry into this pool area is by unlocking the gate only. Do not prop<br />

open the pool gate.<br />

R. At no time will any owner or resident or guest attempt to readjust the pool<br />

equipment <strong>inc</strong>luding the pool heater, filter, etc. All requests for adjustments will<br />

be processed through the Board of Directors.<br />

S. It is the responsibility of each resident using the pool to clean up after<br />

themselves.<br />

T. Persons will swim at their own risk. No lifeguard will be on duty and the<br />

gate must be locked at all times.<br />

5. PROCEDURE FOR ALTERATION OF STRUCTURES<br />

A. If any owner desires to alter the structure in any manner, <strong>inc</strong>luding screen<br />

doors, window air conditioners, central air conditioners, hanging planters, wires or<br />

cords that protrude through the walls or the roof of the Project, any external<br />

modifications, he/she shall employ the following procedure prior to beginning the<br />

alteration:<br />

1. A detailed plan of the alteration, together with specifications, shall<br />

be provided in writing to the Board of Directors. Any cost or savings to the<br />

Association should be noted.<br />

2. The Board of Directors shall give written disposition of the request<br />

to the owner. Approval or denial will be given in writing mailed within 30<br />

days of receipt of the request.<br />

3. Upon receipt of written approval by the Board of Directors, the<br />

owner may implement the alteration.<br />

4. The owner must maintain the alteration in consonance with the rest<br />

of the common area. Failure to do so may require restoration of the<br />

alteration at the owner’s expense. Such action would require 30 days<br />

written notice from the Board of Directors of the Association prior to the<br />

start of the restoration.<br />

6. MISCELLANEOUS<br />

A. Any violations of the above Rules and Regulations should be reported to<br />

the Sun Valley West Phone Line at 720/562-2238 or the email:<br />

info@<strong>sun</strong><strong>valley</strong><strong>west</strong>.org<br />

B. To report parking violations, please note the license number and make of the<br />

car.<br />

C. Owners are responsible for the actions of their tenants or lessees or their<br />

guests.<br />

D. The Board may suspend any owner voting rights in the Association during<br />

any period during which any assessment against his/her Unit remains unpaid.<br />

E. The Board may impose a fine on any owner for each such violation or act<br />

of non-compliance by any owner or his tenant or lessee or their guest, after<br />

notification by placement in the U.S. Mail First Class.<br />

F. Garage door repairs will be the responsibility of the homeowner; if not<br />

repaired within 30 days, the Association will arrange for the repair and bill the<br />

homeowner.<br />

G. All leases for non-owner residents must contain a set of these Rules and<br />

Regulations as well as a copy of the Declarations. Off-site owners are required to have on<br />

file with our office a form stating that their tenants have received a copy of the Rules and<br />

Regulations as well as a copy of the Declarations of Sun Valley West Condominium<br />

Association. Please send those forms to: Sun Valley West Condos, Michele Giometti,<br />

P.O. Box 280631, Lakewood, CO 80228.<br />

H. Window coverings to show a neutral color from the exterior.<br />

Your monthly maintenance fee is due the 1st of each month and is late after the 19th, at<br />

which time a $10 late fee is added. At any time a homeowner is 60 days past due, the<br />

entire year’s assessments become due and payable.<br />

All maintenance requests and concerns should be called in to the Sun Valley West Phone<br />

Line - 720/562-2238 or email at info@<strong>sun</strong><strong>valley</strong><strong>west</strong>.org. Requests should be in writing<br />

whenever possible; however, for any emergencies during non-business hours, please call<br />

the emergency phone line at 720-562-2238, option 1 (24-hour 7-days per week).<br />

Remember: Maintenance problems inside the unit are the responsibility of the<br />

homeowner. The Association is responsible for the upkeep of the Common Area only. If<br />
