The party opposing <strong>the</strong> motion shall not later than 10 days after <strong>the</strong> service <strong>of</strong> <strong>the</strong><br />

motion upon him, file and serve responsive papers. When a motion is opposed by<br />

affidavit, <strong>the</strong> affidavit shall be served with <strong>the</strong> responsive papers. The responsive papers<br />

shall consist <strong>of</strong> ei<strong>the</strong>r (1) a memorandum <strong>of</strong> points and authorities, or (2) a written<br />

statement that he will not oppose <strong>the</strong> motion.<br />

(e) Additional Time after Service by Mail. Whenever a party has <strong>the</strong> right or is<br />

required to do some act or take some proceedings within a prescribed period after <strong>the</strong><br />

service <strong>of</strong> a notice or o<strong>the</strong>r paper upon him and <strong>the</strong> notice or paper is served upon him. by<br />

mail, 7 days shall be added to <strong>the</strong> prescribed period.<br />

Comment: This rule is based on U.S. Federal Rule 6, with <strong>the</strong>se changes: time<br />

periods for motions and responsive papers are enlarged and set forth; points and<br />

authorities must be filed, and possible sanctions are provided for failure to file; and <strong>the</strong><br />

time to be added after service by mail is increased from 3 to 7 days.<br />

Rule 6(a) has been amended to include only holidays recognized by <strong>Yap</strong> State<br />

Laws. Rule 6(d) has been amended to reflect <strong>the</strong> elimination <strong>of</strong> a mandatory motion day<br />

III. PLEADINGS AND MOTIONS<br />

Rule 7. Pleadings Allowed; <strong>For</strong>m <strong>of</strong> Motions.<br />

(a) Pleadings. There shall be a complaint and an answer; a reply to a counterclaim<br />

denominated as such; an answer to a cross-claim, if <strong>the</strong> answer contains a cross-claim; a<br />

third party complaint, if a person who was not an original party is summoned under <strong>the</strong><br />

provisions <strong>of</strong> Rule 14; and a third-party answer, if a third-party complaint is served. No<br />

o<strong>the</strong>r pleading shall be allowed, except that <strong>the</strong> court may order a reply to an answer or a<br />

third-party answer.<br />

(b) Motions and O<strong>the</strong>r Papers.<br />

(1) An application to <strong>the</strong> court for an order shall be by motion which, unless made<br />

during a hearing or trial, shall be made in writing, shall state with particularity <strong>the</strong><br />

grounds for it, and shall set forth <strong>the</strong> relief or order sought. The requirement <strong>of</strong> writing is<br />

fulfilled if <strong>the</strong> motion is stated in a written notice <strong>of</strong> <strong>the</strong> hearing <strong>of</strong> <strong>the</strong> motion.<br />

(A) Memorandum <strong>of</strong> Points and Authorities. Every motion shall be<br />

accompanied by a memorandum <strong>of</strong> points and authorities which fairly discusses <strong>the</strong><br />

issues presented by <strong>the</strong> motion. If <strong>the</strong> respondent opposes <strong>the</strong> motion, he shall file a<br />

memorandum <strong>of</strong> points and authorities which fairly discusses <strong>the</strong> issues presented and<br />

responds to <strong>the</strong> arguments <strong>of</strong> <strong>the</strong> movant.<br />

(B) Hearing and Notice. Unless a motion can be properly disposed <strong>of</strong> ex parte,<br />

<strong>the</strong> court shall hold a hearing on every motion prior to disposition <strong>the</strong>re<strong>of</strong> if a party so<br />

requests, unless o<strong>the</strong>rwise specified by <strong>Yap</strong> State Court Rules or a law <strong>of</strong> <strong>the</strong> State <strong>of</strong><br />

<strong>Yap</strong>.
