DV12.145 ADOPTION OF PROPOSED DETERMINATIONS FOR LOCAL GOVERNMENT
AND PUBLIC PROPERTY LOCAL LAW - CITY AND FLOREAT BEACHES,
GROYNES AND BOARDWALK.
PURPOSE OF REPORT:
To make determinations relating to beaches, groynes and boardwalk and in so doing,
consider public submissions on the proposed determinations.
SUMMARY:
The Town has the task of meeting the needs of all beach users. These needs are not
always compatible and it is therefore necessary to impose restrictions on when specific
users can access the beach. This is particularly the case around the two groynes, where
conditions attract the various users to the one place. In response to public submission
received to advertised restrictions, it is proposed that amendments be made in relation to
early morning board riding and night fishing at the City Beach groyne. Otherwise, the
restrictions, as advertised, are recommended to be adopted.
BACKGROUND:
In considering Report DV12.102 - Review of Beach Lifeguard Service at its meeting on 28
August 2012, the Council decided to proceed with the public consultation process required
by the Town's Local Government and Public Property Local Law to make determinations (ie
restrictions enforceable under local law). This report followed the Beach User Forum held
on 6 June 2012.
In accordance with the local law requirements, a public notice was placed in the Post
newspaper of 6 October 2012. Public notices were also placed on the Council's website and
on the Council's public notice boards on 5 October 2012 that sought submissions from the
public on the proposal to make the following determinations:-
(a) the restrictions on the north side of the City Beach groyne be amended to “No surfing
or surf appliances – 1 November to 30 April”;
(b) the fishing restriction at City Beach groyne be amended to "No Fishing, including 50
metres north to 50 metres south of City Beach groyne, at anytime";
(c) the fishing restrictions at Floreat Groyne be amended to "No fishing - 1 November to
30 April, 6am to 7pm";
(d) the restrictions on the boardwalk be "Dogs permitted on leash only' and "Bicycles,
Roller-blades and Skateboards not permitted.
DETAILS:
As a result of the public notices, 52 submissions were received by close of business on
Tuesday 30 October 2012, and 2 were received after the closing date. A schedule providing
a précis of the submissions received is attached for the Council's information.
