COUNCIL MINUTES TUESDAY 27 NOVEMBER 2012 The proposed alfresco will have little impact on access to direct sun for the adjoining neighbour. The fence will screen the alfresco from view to prevent a significant visual impact from building bulk on the adjoining lot to the south. The alfresco will remain open to the north, east and west allowing access to direct sun to be maintained and ensuring ventilation will not be significantly impacted by the structure. The proposed alfresco will assist in protecting the privacy between adjoining properties as a blank wall has been proposed on the southern side. This will prevent the outdoor living area from overlooking to the southern neighbours' lot and will also screen the active space south of the dwelling from this neighbours' property. Overall in view of the above comments, it is considered that the proposed setback of the alfresco from the rear/southern boundary is acceptable and complies with the performance criteria for the following reasons:- • provides adequate direct sun and ventilation to the building; • ensures adequate direct sun and ventilation being available to adjoining properties; • provides adequate direct sun to the building and appurtenant open spaces; and • assists in protecting privacy between adjoining properties. POLICY/STATUTORY IMPLICATIONS: There are no policy or statutory implications related to this report. The proposal was assessed against the provisions of the Residential Design Codes (R Codes), Town Planning Scheme No.1, and the Town Planning Scheme Policy Manual. FINANCIAL IMPLICATIONS: There are no financial implications related to this report. STRATEGIC DIRECTION: Consideration of this application is consistent with the Town's Strategic Plan 2009-2020 for the priority area 'Planning for our Community'. COMMUNITY CONSULTATION: This matter has been assessed under the Community Consultation Policy.
