The cross easement also provides for adequate manoeuvring for the proposed garage on Lot 4. • Site slopes steeply upwards by approximately 2 metres from front (north) to rear (south). • Proposed two storey dwelling with a skillion roof. • Boundary walls to the proposed garage on the left (east) and front (north) side boundaries in the north-east corner of the property. • Proposed height variation proposed to the top of the skillion roof which measures 7.2 metres. Applicant's justification The applicant has provided written justification for the variations to the acceptable development provisions relating to building height. Performance criteria assessment Building height Building Wall Height Proposed Acceptable development provision 4.3 metres to 7.2 metres 7.0 metres to the top of skillion, - west elevation curved or flat roof Performance criteria: Building height consistent with the desired height of buildings in the locality, and to recognise the need to protect the amenities of adjoining properties, including, where appropriate: • adequate direct sun to buildings and appurtenant open spaces; • adequate daylight to major openings to habitable rooms; and • access to views of significance. The proposed wall height variation of 0.2 metre relates to a 3 metre length of the skillion roof which occurs centrally on the lot and is not considered to have an undue impact on the adjoining landowners. The over height portion of wall on the western elevation is set back a considerable 4.5 metres from the right (west) side boundary. The wall heights on the eastern elevation meet the relevant acceptable development provisions and are considered to protect the amenity of adjoining landowner to the left (east) side. The proposed wall height variation is not considered to have an undue impact on the streetscape as the top of the skillion roof is set back approximately 32 metres from the street. This occurs due to the location of the dwelling on a rear battle axe lot. Consequently, the skillion roof is not evident from the street. The proposed skillion roof would have less of an impact on the rear adjoining properties than a pitched roof. Overall in view of the above comments, it is considered that the proposed height of the development is acceptable and satisfies the performance criteria for the following reasons:- • access of direct sun to major openings to habitable rooms of adjoining properties will be protected; • access of views of significance from adjoining properties out to Lake Monger will be protected. The proposal was assessed against the provisions of the Residential Design Codes (R Codes), Town Planning Scheme No.1, and the Town Planning Scheme Policy Manual. FINANCIAL IMPLICATIONS: There are no financial implications related to this report. STRATEGIC DIRECTION: Consideration of this application is consistent with the Town's Strategic Plan 2009-2020 for the priority area 'Planning for our Community'. COMMUNITY CONSULTATION: This matter has been assessed under the Community Consultation Policy. The requirements for consultation have been satisfied under the statutory provisions of the Town Planning Scheme. ATTACHMENTS: 1. Applicant's justification. COUNCIL DECISION: (COMMITTEE AND ADMINISTRATION RECOMMENDATION) Moved by Cr MacRae, seconded by Cr King That in accordance with Part 4 of the Town of Cambridge Town Planning Scheme No. 1, Council APPROVES the application for a two storey dwelling submitted by Residential Building WA at Lot 4 (No. 11B) Lake Monger Drive, West Leederville, as shown on the plans dated 31 October 2012, subject to the following condition:- (i) the surface finish of boundary walls facing the adjoining property to the north and east to be rendered, painted or face brickwork to the satisfaction of the Town.
