COUNCIL MINUTES TUESDAY 27 NOVEMBER 2012 The applicant has indicated a willingness to reconsider the design of this element of the buildings to address this matter. They have indicated that this can be done prior to the Council meeting next week. It was therefore agreed that this item be submitted to Council for determination. FURTHER REPORT (Post Committee Meeting 20 November 2012) At the Development Committee meeting held on 20 November 2012, issues were raised regarding the height of the front walls above the entry doors. The applicant has reconsidered the design of this element of the building and submitted a revised elevation showing the front walls reduced in height to be the same height as the rest of the walls on the front elevation. It is considered that the revised front elevation is acceptable. It is therefore recommended:- That, in accordance with Part 4 of the Town of Cambridge Town Planning Scheme No. 1, Council APPROVES the application for two, three storey dwellings submitted by Founded at Lot 2 (No. 7) Lake Monger Drive, West Leederville, as shown on the ground floor and roof plans and side and rear elevations dated 30 October 2012, the site, first floor, and loft plans dated 12 November 2012, and the amended front elevation dated 23 November 2012 subject to the following conditions:- (i) (ii) (iii) (iv) the setback of the Site 2 front balcony from the right/western side boundary to be a minimum of 1.5 metres; the Site 2 front balcony to be modified to restrict views to the guest bedroom window of the dwelling located on the neighbouring property to the west; the visual privacy screens for the Site 1 and Site 2 front balconies to be designed to restrict views to the neighbouring properties to the east and west in accordance with the acceptable development provisions of part 6.8.1 ‘Visual Privacy’ of the Residential Design Codes of Western Australia and to be installed prior to the occupation of the dwelling; the surface finish of boundary walls facing the adjoining properties to the east and west to be rendered, painted or face brickwork to the satisfaction of the Town. Council Meeting 27 November 2012 During discussion, Cr King suggested that the item be referred back to the Development Committee to enable the parking arrangement and the dominance of the garage doors to be reviewed. COUNCIL MINUTES TUESDAY 27 NOVEMBER 2012 DV12.133 LOT 2 (NO. 234B) SELBY STREET, WEMBLEY - TWO STOREY GROUPED DWELLING - REAR BATTLEAXE LOT SUMMARY: The Town has received an application for a two storey grouped dwelling at No. 234B Selby Street, Wembley. The application requires a Council determination as an assessment is required against the buildings on the boundary and buildings setback from the boundary performance criteria of the Residential Design Codes of WA (R Codes) and an objection has been received during the consultation period that cannot be resolved through a condition of planning approval. The proposal is considered to satisfy the relevant performance criteria for the following reasons:- • direct sun to major openings to habitable rooms and outdoor living areas of the adjoining property is not restricted; • makes effective use of space on the lot allowing for a sufficient vehicle turning circle; • assists in protecting the privacy between the adjoining properties; • ensures adequate direct sun and ventilation being available to adjoining property; and • assists in ameliorating the impacts of building bulk on adjoining property. Accordingly, the proposal is recommended for approval. To address some of the concerns raised by the Town’s Administration and the owners of a neighbouring property, amended plans were submitted on 2 November 2012. It is the latter set of plans that are the subject of the following report. DETAILS: Development description • Proposed two storey grouped dwelling on the rear battle axe strata lot which shares a common property accessway with the front survey strata lot. • The natural topography of the subject site slopes upwards from left (north) to right (south) by approximately 1.7 metres and also slopes upwards gently from front (west) to rear (east) by approximately 0.3 metres.
