COUNCIL MINUTES TUESDAY 27 NOVEMBER 2012 (e) (f) (g) (h) (i) (j) a Parking Management Plan being submitted detailing the operation of the car park including car parking not being accessible to the public after hours in relation to events at Subiaco Oval, the operation of staff, visitor and residential bays, reciprocal rights and general traffic flow; the operation of, and adherence to, the Parking Management Plan; any signage on site being subject to a separate development application; a maximum of twenty-six (26) practitioners operating from the premises at any one time; 1.5 metre by 1.5 metre truncations being provided at both corners of the easternmost grade level vehicular exit; the applicant to pay $4,500 to the Council for the installation of speed humps and marking of Elverd Lane; (k the rear (north) facing windows of the first and second floor consulting rooms being screened to a minimum height of 1.6 metres above the respective finished floor levels to prevent overlooking of the properties to the rear. Details to be provided at building licence stage; (l) the applicant paying a cash in lieu contribution of $162,500 to the Council, to be held in reserve for future parking improvements in the vicinity of the subject site; (m) the western section of the rear wall of the first floor to be brought back into line with the rear walls of the ground floor and second floor to the satisfaction of the Town; (ii) as an alternative to the above approval, the applicant be advised that should they revise their plans to include satisfactory provisions for motorcycles, scooters/gophers and for cyclists (which would include end of trip facilities), Council could allow a reduction of up to 15 percent in the overall parking requirement for the development and that if there is any car parking shortfall, this would be charged at a rate of $7,500 per bay. COUNCIL MINUTES TUESDAY 27 NOVEMBER 2012 DV12.131 LOT 2 (NO. 138) RAILWAY PARADE, WEST LEEDERVILLE - ROOF ADVERTISING SIGN SUMMARY: The Town has received an application for one double-sided roof sign at No. 138 Railway Parade, West Leederville. The plans show a new double-sided sign on the roof of the commercial building. It is 3.3 metres in height and 12.6 metres in length. Its position above the 7.9 metre high building will bring the sign to a height of 11.2 metres above ground level. The proposal does not satisfy the relevant development requirements for the following reasons:- • the size and scale of the sign will have a significant detrimental visual impact on the streetscape; and • the proposal is not compatible with the existing signage in the area and would create an undesirable precedent. Accordingly, the proposal is recommended for refusal. PURPOSE: To consider an application for one double-sided roof sign requiring assessment under the requirements of Town Planning Scheme No. 1 and the Town’s Policy ‘Ancillary Uses and Development - 5.2 Advertising Signs’. BACKGROUND: Application: 411DA-2012 Owner: John Harding & Marlene Harding Applicant: John Harding & Marlene Harding Zoning: Commercial Use class: Advertisement ‘AA’ – not permitted unless the Council has granted planning approval Land area: 334m² Council, at its March 2012 meeting, approved one pylon advertising sign on the adjoining site to the east, Lot 1 (No.3) Oxford Close, West Leederville. This approved sign will be 12.66 metres wide, 3.35 metres high and has an overall height of 9.75 metres above ground level. The approved sign replaces the existing sign along the western boundary of No.3 Oxford Close and abutting the eastern wall of No.138 Railway Parade. Commercial rights to the sign being replaced are the subject of dispute between the owners of the adjoining properties. In April 2012, the Town, under delegated authority refused an application for a second pylon sign (dimensions 12.66 metres x 3.35 metres with an overall height 9.75 metres) on No.3 Oxford Close on the northern side of the lot in April 2012. This application was the subject of a State Administrative Tribunal appeal. The refusal of the Council was upheld by SAT at a full hearing in October 2012.
