EBMUD TITLE AGENDA NO. MEETING DATE January 22. 2013 YUBA ACCORD - FREEPQRT POINT OF REDIVERSION PROJECT AGREEMENTS m MOTION • RESOLUTION • ORDINANCE RECOMMENDED ACTION Authorize agreements with the Yuba County Water Agency (YCWA) to (1) cost-share on environmental and technical work needed to support implementation of the Yuba Accord - Freeport Point of Rediversion Project, including a commitment for the District to reimburse YCWA up to $160,000 for consulting services and $8,000 for processing fees and (2) establish a framework under which EBMUD and YCWA would negotiate a future agreement for EBMUD to purchase transfer water from YCWA in dry years. SUMMARY This project would facilitate transfers of water from YCWA to EBMUD by adding the Freeport Regional Water Project (FRWP) intake on the lower Sacramento River as a point of rediversion to YCWA's water rights permits (see attached location map). The District would have the opportunity to become a backup buyer for transfer water released under terms of the Lower Yuba River Accord (Yuba Accord) that cannot currently be delivered to existing Yuba Accord buyers. The parties have negotiated a cost-share agreement to complete environmental and technical work to implement the project. While EBMUD and YCWA staff will each perform a substantial share of the overall work, the District will also reimburse YCWA up to $160,000 for environmental consulting services and $8,000 for processing fees. An overview of the project will be presented to the Board on January 22, 2013. YCWA is scheduled to approve the project agreements on February 12, 2013. DISCUSSION The Water Supply Management Program (WSMP) 2040 identifies water transfers as a supplemental supply option to meet the District's future dry year water supply needs. YCWA has been successfully transferring water since 1987. In 2008, the 17-party consensus based Yuba Accord established minimum instream flows on the Lower Yuba River while providing transfer water for the environment and state and federal water contractors. In 2007, when YCWA certified the Yuba Accord environmental impact report (EIR), the FRWP was still under construction.
