5. The department has thoroughly considered <strong>the</strong> comments and testimony<br />

received. A summary <strong>of</strong> <strong>the</strong> comments received and <strong>the</strong> department's responses<br />

are as follows:<br />

COMMENT #1: Virgin statement should be enough; too expensive to test bull three<br />

times.<br />

RESPONSE #1: Virgin statement affidavit is accepted for bulls 12-24 months <strong>of</strong><br />

age; older virgin bulls may be tested with one PCR ra<strong>the</strong>r than three weekly cultures.<br />

COMMENT #2: Would like to see imported bison to be Trichomoniasis tested<br />

negative as bison are prone to wandering far from <strong>the</strong>ir home range and would be a<br />

serious problem if <strong>the</strong>y transmitted <strong>the</strong> disease to cattle herds.<br />

RESPONSE #2: There is little or no evidence at this time to suggest that bison<br />

transmit Tritrichomonas foetus.<br />

COMMENT #3: Who put <strong>the</strong> educational material toge<strong>the</strong>r that is to be provided to<br />

owners in ARM 32.3.506 Can I get a sample <strong>of</strong> it Were any boarded<br />

<strong>the</strong>riogenologists consulted on this material<br />

RESPONSE #3: Educational information is available on our web site, and also from<br />

<strong>the</strong> web sites <strong>of</strong> Colorado and Washington Departments <strong>of</strong> Agriculture. Most <strong>of</strong> <strong>the</strong>ir<br />

material has been provided by Animal Scientists and Cooperative Extension.<br />

Proposed changes to ARM 32.3.501 through <strong>the</strong> New Rules were sent to three<br />

bovine reproductive specialists (<strong>the</strong>riogenologists) and to one laboratory director<br />

outside <strong>the</strong> Department <strong>of</strong> Livestock. Auburn University, Colorado <strong>State</strong> University,<br />

and <strong>the</strong> Great Plains Research Center in Clay Center, Nebraska were solicited for<br />

comments regarding <strong>the</strong> proposed rule.<br />

COMMENT #4: Does this ARM apply on reservations<br />

RESPONSE #4: No, <strong>Montana</strong> Animal Health law does not apply to sovereign Tribal<br />

Nations, only to those cattle that are moving within <strong>the</strong> state system, such as county<br />

movements or to a livestock market or to slaughter movements. However, it does<br />

apply when animals are moved into <strong>Montana</strong> from reservations.<br />

COMMENT #5: On page 1861- These prices do not include <strong>the</strong> InPouch or <strong>the</strong><br />

sampling procedure.<br />
