ELECTRONIC RECORDING DELIVERY SYSTEM (cont’d)<br />
System Background:<br />
The Electronic Recording Delivery Act of 2004 (Government Code Sections 27390 through 27399)<br />
authorizes a <strong>County</strong> <strong>Recorder</strong>, upon approval by resolution of the Board of Supervisors and System<br />
Certification by the Department of Justice (DOJ) Electronic Recording Delivery System (ERDS) program to<br />
establish an ERDS for the delivery, and when applicable, return of specified electronic records that are an<br />
instrument of real estate transactions. In 2007, DOJ issued regulations for implementing an Electronic<br />
Recording Delivery System (ERDS) program, specifying all conditions, including system certification, regulation<br />
and oversight by DOJ’s ERDS Program. These regulations require documents are secure while in transmit to<br />
the <strong>County</strong> and in the return to the submitter to prevent any possible fraud.<br />
The regulations also state that counties are authorized to join forces and provide a single portal for this<br />
process. Orange, Riverside, San Diego and Los Angeles Counties developed a multi-county electronic<br />
recording delivery system portal known as SECURE, which these counties jointly own. SECURE was certified<br />
by the DOJ September 29, 2009.<br />
October 4, 2005, The Board of Supervisors approved the <strong>Clerk</strong>/<strong>Recorder</strong>’s participation in the ERDS<br />
program. December 1, 2009, The Board also approved the <strong>Clerk</strong>/<strong>Recorder</strong> joining the multi-county electronic<br />
recording delivery system portal, SECURE. <strong>Sacramento</strong> <strong>County</strong> was certified as a partner county of SECURE<br />
by the DOJ November 18, 2010.<br />
