Sangguniang Barangay sans power
to impose sanctions on barangay
ordinance violations
Issues:
(1) What are the substantive requirements of a valid ordinance
(2) Can a barangay pass an ordinance that regulates the selling of a “anti-contraceptive substance
and devices” as well as “drug or chemical products or devices capable of provoking abortion
or preventing conception as classified by the Food and Drug Administration” (FDA)”
(Section 37 of the RA 5921 of the Pharmacy Law)
(3) Can the Sangguniang Barangay impose a PENALTY in cases of barangay violations
Pangagpas
ni Iyo Hantoy
Na-unsa na ba kini
opinion
of Prison (Bucor) sa Muntinlupa nga bisan
ang gahin sa pagkaon para sa mga pobreng
binilanggo gihilabtan.
Angayan natong panghimara-uton ang
gibuhat ni kanhi Gobernador Leviste ning
maorag pagbugal-bugal niya sa balaod ug
reglamento sa National Bilibid Prison. Sa
laing bahin tungod sa iyang gibuhat, nabisto
ang daghang kahiwi-an, abuso, ug panapi sa
mga guardiya ug ubang opisyal sa National
Bilibid Prison.
Lima. Human sa personal nga inspeksiyon nga
ilang gihimo sa bilango-an ilang nahukman
nga elisan ang tanang guardiya sa nasudnong
prisohan ug pasakaan sa tukmang sumbong ang
tanang opisyal nga nahilambigit sa kahiwian.
Hinaut nga adunay maayong resulta ang
imbistigasyon.
Hinuon, human sa pagkabulgar sa gihimo ni
Leviste, daghang mga kahiwian ang nabisto:
(1.) Espesyal nga prebilihiyo sa mga sapian
ug langyaw nga binilanggo.
(2.) Nag hitak nga drugas sulod sa prisohan.
(3.) Prostitusyon sulod sa bilibid.
way klarong nagbantay. Ang pangutana: Kinsa
may makapugong sa maong priso nga mobuhat
ug krimen samtang tua siya sa gawas sama sa
panghold-up o kaha pagpatay ug pagkahuman
sa pagbuhat sa krimen mosulod pagbalik sa
prisohan nga ma-orag way nahitabo.
Ang mga opisyal ug mga prison guards
nga nagpabaya sa ilang katungdanan ug maoy
responsable sa pagpagawas-gawas sa mga
notadong negosyante sa drugas, nga mga
langyaw, unsa may angay buhaton kanila
Sa akong paniid, dili na mahadlok ang mga
prison guards ug ubang opisyal sa nasudnang
bilango-an nga mapapha sa katungdanan
tungod kay nakapondo na man ug ubay-ubay
sa ilang mga transaksiyon ug palusot.
Busa atong pangayoon ni Pnoy nga dili
igo nga patiran sa katungdanan ang mga
nahilambigit sa binuang sa National Bilibid
Prison. Kinahanglan pasakaan ug tukmang
kaso aron mag tingkagol sa prisohan ug
mahimong panig-engnan sa uban nga ang
dautan dili gayud molungtad.
Hangtud sa sunod semana, salamat.
Ang Ormocanon is the official publication of the Local
Government Unit of Ormoc and is published weekly in
the vernacular and in English with editorial office located
at New Ormoc City Hall, Añubing St., Government
Center.
Held:
Under Section 1, Article VI of the 1987
Constitution, the legislative power shall be vested
in the Congress of the Philippines which consists
of the Senate and the House of Representatives,
except for the exercise of the initiative and
referendum which is reserved to the people.
By virtue of Section 48 of the Local
Government Code of 1991, the Congress
delegates legislative powers to local sanggunian,
but such powers are not absolute.
In its previous decision, the Supreme
Court enumerated the substantive requirements
of a valid ordinance as follows: 1) it must not
contravene the Constitution or any statute; 2) It
must not be unfair or oppressive; 3) It must not be
partial or discriminatory; 4) It must not prohibit
but may regulate trade; 5) It must be general and
consistent with public policy, and 6) It must not
be unreasonable.
Base on the foregoing, the local legislative
power delegated to an LGU is inferior since
it must conform to the limits imposed by the
delegating authority (Congress). In other words,
the national legislative (Congress) is still the
principal and therefore, LGU’s cannot go against
the statutes passed by Congress.
As to the second issue, the Board of Pharmacy
maintained that RA 5921 or the Pharmacy Law
was enacted in order to supervise control and
regulate the practice of pharmacy in the country.
It also states that the Board of Pharmacy is the
only and exclusive body authorized to regulate
and supervise pharmacists and impose penalties
on them in case they were found guilty of
violation of its provisions. There is no provision
in the Pharmacy Law allowing such power to be
delegated in a different body or agency.
On the other hand, the Food and Drug
Administration (FDA) explains that it is the
proper agency to classify drugs or chemical
products or devices that are capable of provoking
abortion or preventing conception.
With regard to the third issue, the sangguniang
barangay has no authority to impose a penalty of
fine for the violation of barangay ordinances. It is
only the Sangguniang Panlungsod/Panlalawigan
which is authorized to do so. (Source: DILG
Ormoc’s finest proves to be
by Roberto C. Dejon
The Ormoc City Police Office
and the Ormoc Public Safety
Company has been adjudged as the
Best City Police Office in the region
on the 110 th Anniversary of the
Philippine National Police during
the awarding ceremony held at the
of the PNP regional office gym
on Thursday. The two units of the
local PNP the Senior Police Non-
Commission Officer and the Junior
Police Non-Commission Officers
awardees this year also came from
the OCPO.
Chosen as the Senior Police Non-
Commission Officer was SPOIV
Tomas Serrano, the Intelligence Chief
of the Police Community Precinct 1,
while POI Lemuel Cañete, was also
awarded as the Junior Police Non-
Commission Officer of the year.
SPOIV Tomas Serrano’s
intelligence gathering was the main
reason he was bestowed the said
award. His intelligence network was
best known for the solution of many
cases in the city in the late part of
2010 and up to the early months of
this year. He was nearly killed when
he was subdued by the two suspects
behind the series of robbery in the city
who tried to get his firearm during a
follow up operation that lead to the
neutralization of both suspects.
POI Lemuel Cañete, a former
member of the Anti Illegal Drug
Special Operation Task Force
(ADISOTF) and now an intelligence
operative of the Ormoc Public Safety
Company achievement in a number
of successful drug operations in the
city also lead him to be adjudged
as the Junior PNCO for the PNP
occasion this year. A graduate of
Class 2007 of the Philippine Safety
College in Tacloban, Cañete, is best
known for his craft in intelligence
and surveillance gathering operation
that resulted to numerous arrest
the best in the region
of suspect most especially drug
peddlers.
While the Ormoc City Police
Office achievements in criminal
prevention such as low criminality
activities and high crime solutions
was also the reason for them being
adjudged as the Best City Police
Office in the entire region defeating
the Tacloban City Police Office. But
controversy arises over the choice for
the Best Public Safety Company now
under P/Supt. Neil Montaño because
of the recent incident when his men
were involved in the shooting of nine
people killing two civilians during the
serving of a warrant in Brgy. Liberty
last June 18.
It was learned that only the
Public Safety Company is vying for
the said award, Ormoc City Public
Safety Company is the only unit
which qualifies as Tacloban City
Public Safety Company is not ready
to compete yet.
SSupt Nilo D. Donayre of Ormoc City Police Office received the award
“Best City Police Office in the Region”.
Opposition blocks city hospital
construction
by Roberto C. Dejon
While Ormoc City Mayor
Eric C. Codilla is doing his best to
pursue the construction of the city
hospital, his political opponents
through their patron representing
the district is doing their best
to block the plan. This is what
Mayor Codilla disclosed during an
interview Saturday at a local radio
station. Mayor Codilla said that an
Undersecretary of the Department of
Health has given them “headache”
while the city is complying
requirements like permits and
licenses from the said agency. He
said this undersecretary has been
discouraging the city representative
who handles the processing of
these documents, questioning why
the city government sees the need
for a city hospital when Ormoc
District Hospital exists. Mayor
Codilla said that he admitted to the
undersecretary that indeed there is
already a government hospital in
the city but it is only bears the name
as hospital but inside it is different
story. The hospital, in reality is
in a poor state, lacking facilities,
medicines, doctors and hospital
staff. Once inside you could see
how terrible the condition is because
of the provincial government’s
seeming neglect of its needs. He
told the undersecretary that once
Perspective
of the proposed
Ormoc City Hospital.
a patient is admitted to the ODH
“they just lie there, and they die
there” for the lack of facilities.
Mayor Codilla disclosed that
he asked the DOH official why this
move was prevented when he is not
asking a single centavo from DOH
for its construction. He added the
he told the DOH that the city has
already put up at least P40 million
for the construction of the building
and told them, that the amount is
quite sufficient for the proposed four
storey building hospital. The mayor
said that the technical working
group tasked to complete the
clearances and permits, and other
requirements for the construction of
the hospital is nearing completion
and that construction should start
anytime soon.
Lately Mayor Codilla disclosed
that he learned from the same
official of DOH that reason why
they are blocking the plan of the city
to construct a hospital is because
an opposition leader from the city
personally spoke with a higher
official of the agency to prevent
the city from constructing the city
hospital. The reason: they feared
that once they replace Codilla they
could not find funds to sustain the
proposed hospital. They said that
this opposition leader from the
city admitted to DOH officials that
Mayor Codilla is a tough act to
follow in terms of finding resources
to fund a city hospital because the
only alternative they know, how to
raise the income of the city is to
raise the local taxes.
Maria Aragon from p. 1
Mayor Codilla informed the
family that he met with some
Ormocanons in a previous trip to
Canada and found out some of them
are their mutual friends. The mayor
gave a personalized notebook and
pencil to Maria as a souvenir.
He also gave her a copy of “Ang
Ormocanon,” the LGU’s official
newsletter. While informing the
visitors that they can log in to
Ormoc’s website www.ormoc.gov.
ph if they want to know the latest
happenings in the city.
In return, Maria Aragon sang a
portion of the Lady Gaga’s “Born
This Way,” the piece which was
uploaded in YouTube which paved
the way to her popularity. City
Hall employees flocked to the
Mayor’s office when they learned
4
Ang
Ormocanon
www.ormoc.gov.ph
that Maria was there. Everybody
wanted to have their picture taken
with the star who willingly posed
with them.
Until she left the City Mayor’s
Office she was seen hugging the
notebook and pencil that Mayor
Beboy Codilla gave her. Mayor
Codilla further told the guests that it
is part of the school supplies that are
being distributed to school children
in the city. He also informed Maria’s
family who had been in Canada
for quiet sometime now that the
local government here under his
administration has a scholarship
program for the poor but deserving
students
According to Jude Abenoja,
the visit was in response from the
invitation of the Couples for Christ
and the ANCOP. It was learned that
Maria Aragon is the ambassadress
of the ANCOP or Answering the
Cry of the Poor worldwide.
Another reason of her visit
is because her mother Menchie
Catangcatang Aragon is from
Ormoc. She grew in Brgy. Milagro
and studied in Dolores Elementary
School before she went to Manila
and finally migrated to Canada.
Her father, Mr. Veni Aragon said
that Maria and his three other
children got their singing talent
from him. The proud father said
that Maria did not have formal
voice lessons. Her brother was the
one who gave her lessons in piano.
The Aragon family was happy and
very thankful of the warm welcome
of the Ormocanons. Maria’s sisters
Linger and Rojuane and brother JV
accompanied her. Rojuane, who
uploaded the video in Youtube
said that she did not expect that it
it will gain her sister worldwide
fame. Maria expressed her thanks
in Tagalog since she could not
speak in Cebuano. “Salamat sa
inyong suporta at sana bumili kayo
ng album ko. Malapit na itong
lumabas.” She was referring
to her self-titled album soon to
be release by Star Records, the
recording arm of ABS-CBN . It
was later learned from Abenoja
that ANCOP will have a Global
Walk on August 21. It aims to raise
funds for the scholars and for their
livelihood programs.
Maria and her company also
visited some schools in the city.

4.4 million pesos for the 500 meter
concreting. There is another
1.1 million pesos for the potable
water supply to Lake Danao. Part
of the city’s P5 million budget
allocations for the development of
Lake Danao is the construction of
Barangay and DepEd work
together for students
By Josephine N. Serseña
Working for the common good
of their constituents, the barangay
officials headed by Chairman
Dionisio Aligway with the DepEd
family here under Mrs Divina
Montalban work together for the
betterment of the pupils. In a short
discussion with both Aligway and
Montalban during the culmination
activity of their Search for A-1
Child, they told Ang Ormocanon
that the school is their common
constituents.
During the celebration of
the Nutrition Month recently,
Barangay Kadaohan Council
and the Cabatoan Elementary
School faculty and staff initiated
programs that would make its
culmination a memorable one.
In the morning of July 29, pupils
from all grade levels including
those in the Day Care and Prep
up to grade six were feed with
healthy and delicious “lugaw”. In
the afternoon a second set of the
task of taking a bath and brushing
their teeth, eating right and
nutritious foods, maintaining
clean surroundings. “Nasibot kos
Butanding seen at Ormoc Bay
by Roberto C. Dejon
Local residents here do not have
to go to Donsol, Sorsogon in Bicol
to see the famous whale sharks
(rhincodon typus) also known
as butanding. This is because
personnel of CASO- Fisheries and
Marine division reported sightings
of the giant fish last Aug 10. It was
learned that four giant whale sharks
seen last Wednesday. The whale
sharks were seen sipping planktons
at the bay which amused many
observers.
In the past two days, two of
this giant fish were seen at the bay.
Two paddle power boats were seen
with people on board believed to
be visitors, go near the butanding.
Those on board the boat were seen
taking pictures while others were
seen touching the fins just like what
tourists do in Donsol.
CASO Fishery and Marine
division head Alberto Arcuino,
in an earlier interview said that
Ormoc Bay is frequently visited
by this giant fish. But this is the
first time that butanding was seen
this close to the shore. According
to observers that the three of the
four are estimated to weight more
than 2 tons while the other one is
smaller. City Councilor Jose “Pepe
Boy” Alfaro, the Chairman on the
Committee on Environment and
Natural Resources of the city council
in an earlier interview, said that the
whale sharks are now considered
“endangered species” and catching
and slaughtering of this fish is
prohibited by law. Anyone caught
catching and slaughtering the fish
will face criminal charges in court.
Mustangs nips Titans;
Olympians, Niños barge
into winning column
sports
by Joey Vincent C. Motel
In a jam-packed Friday at the
Ormoc Superdome, the Western
Leyte College Mustangs send a
serious message of contention as
they crash the AMA Computer
Learning Center Titans, 84-67, to
start their campaign in the PCCL
qualifiers OCSSO Season V 1 st
conference.
The Mustangs, champions
of the 2 nd conference of the 4 th
installation, win despite playing
without Tejay Napolitano, Christian
Sean Laude and Alfie Amarante.
The three are responsible for the 2 nd
place finish of the Mustangs in the
Fiesta Inter-Collegiate Invitationals
last June ruled by Junmar Fajardo
and the UC Webmasters.
The Mustangs struggles in the
early going as the Titans forces the
issue towards the basket, getting
fouls and converting charities.
After JR Moldez ties the score at
10 midway the first, Algin Rapas
and Federico Bejoc nail back-toback
triples to put WLC ahead.
But Alvin Bautista nails his own
version of the three to spark a
14-3 run, putting ACLC ahead,
24-19 to end the first canto. Joda
Saleres opened the second with
a split charity but WLC’s Mark
Chester Ngoho launches six of the
11-0 bomb to recover the lead. The
Titans try to trade baskets to stay
within reach, 41-37, but John Carlo
Sano fires a triple in the waning
seconds for the Mustangs to end
the half, 44-37.
Benedict Sevilla opens the third
trading baskets against the Titans
before Breboy Mascariñas hits an
open three and Rapas completes a
three-point play to a notch double
digit lead for the Mustangs, 55-
41, 6:23 in the third prompting
coach Allan Garrido to call time.
The Titans again engage in trading
baskets against WLC before Ngoho
got his 5 th personal foul, 2:30 to go
in the third. Both teams exchange
fruitless possessions before Bejoc
launches another triple to spark a
13-5 run bridging the third and
fourth canto to give WLC its
biggest lead at 20, 76-56, 2:21 on
the clock.
Rapas leads all scorers with 20,
Bejoc added 14, Jeffrey Arintok
chipped 10 while Ngoho, Drake
Flores and Sevilla combined for 21
markers. Former St. Paul’s School
Blue Knights stalwart Earvin
Palencia debuts with 2 points but
his hustle and energy fit into the
team’s defense system, giving the
Mustangs forwards quality time
at the bench. Jenic Barrientos and
Joda Saleres lead the Titans with 16
apiece, while Alvin Bautista added
15. Former secondary division
Mythical Selection favorite ace
pointguard Noel Mascariñas was
scoreless as the WLC guards
swarms all over the ball throughout
the ballgame that saw 2 technical
fouls and 3 players fouled out.
Ngoho fouled out at the third while
Bautista and Sevilla got theirs at the
crucial stretch. The win barge the
Mustangs in the winning column
together with the Sto. Niño College
Niños and the STI Olympians.
Venezer Ian Bensig and the
Sto. Niño College Niños opens
the tournament by snapping a
futile conference with a huge rally
midway the fourth quarter to stop
hotshot Ramon Nicanor and the
SPC Apostles 68-54, before STI
Olympian Val Quiapo fires 8 triples
en route to an 80-62 domination
over coach Boy Apostol and the
come-backing OCIT Sailors.
SPC, Albuera Private scores wins in
OCSSO chess
By Joey Vincent C. Motel
Aaron Villar makes short
work of SNC’s to lead St. Peter’s
College to a masterful 3-1 victory
over Sto. Niño College as Albuera
Private High School does the same
over the Niños to open their bids
for the Ormoc City Schools Sports
Organization Chess Tournament
title.
A junior student, Villar take
the reins of the top board after
Lester Dale Suico graduated. With
the pressure on his back, Villar
masterfully mustered out to outwit
his board 1 opponent in this double
round robin tournament.
Albuera Private High School
posted also a commanding 3-1
victory over SNC including an
upset by May Clarence Sanico
over in the board 2 encounter.
The win put APHS and SPC tied
atop the standings with 3 points
while SNC scores 2. SNC played
two successive games after only 3
schools were present to compete.
More schools are expected to
compete next week as Lilo-an NHS
and Dolores NHS confirm to send in
their players next week.
Meanwhile, OCSSO Chess
Season I silver medal team (Dolores
NHS) member Marvin Jandoc
helped hand-over EVSU-OCC’s
first ever gold medal in the EVSU
Inter-Campus Sportsfest held in
EVSU – Burauen Campus last
week. The sophomore Electrical
Engineering student compete on a
steady phase in the board 3 to help
EVSU-Ormoc notch its first chess
gold in this high level of chess
competition.
OCSSO product helps team wins
first-ever
gold
Jandoc, fondly called Mr. Bean
by his friends and local woodpushers,
extends his gratitude to OCSSO
and the local government unit for
helping him hones his potentials.
He said the OCSSO enables him to
be more dedicated to his game. His
preparations for the said event also
include playing in the Fiesta Chess
Tournament Executive Class where
he settled 15 th place with 3.5 points.
The gold enables Jandoc to vie for
the top board position for EVSU-
OCC next year as the board 1, 2
and 4 players will graduate come
March.
Team EVSU, coached by
Engr. Robert Navarro, is composed
of Anthony Cataros at board 1,
Allenrey Fiel on board 2, Jandoc on
board 3 and Ian Renomeron on board
4. Renomeron, unbeaten, earns the
best board 4 award and together
with Cataros gets a consideration
to play for the SCUAA EVSU
Team. The four have their stiffest
concentration during the Fiesta
Chess tourney.
The gold medal snaps nearly a
decade of drought for the runner-up
favorite EVSU Ormoc Chess team.
Four year campaigners Cataros and
Fiel added the gold to cap their two
silvers, one bronze performance
of the inter-campus competition.
Cataros and Fiel assume the top two
posts after board 1 and 2 mainstays
Rj Clemente and this author finished
their 5 years of competition with a 4
silver medal - 1 bronze medal finish.
