Ang <strong>Ormoc</strong>anon is the <strong>of</strong>ficial publication <strong>of</strong> the Local<br />

Held:<br />
Under Section 1, Article VI <strong>of</strong> the 1987<br />
Constitution, the legislative power shall be vested<br />
in the Congress <strong>of</strong> the Philippines which consists<br />
<strong>of</strong> the Senate and the House <strong>of</strong> Representatives,<br />
except for the exercise <strong>of</strong> the initiative and<br />
referendum which is reserved to the people.<br />
By virtue <strong>of</strong> Section 48 <strong>of</strong> the Local<br />
<strong>Government</strong> Code <strong>of</strong> 1991, the Congress<br />
delegates legislative powers to local sanggunian,<br />
but such powers are not absolute.<br />
In its previous decision, the Supreme<br />
Court enumerated the substantive requirements<br />
<strong>of</strong> a valid ordinance as follows: 1) it must not<br />
contravene the Constitution or any statute; 2) It<br />
must not be unfair or oppressive; 3) It must not be<br />
partial or discriminatory; 4) It must not prohibit<br />
but may regulate trade; 5) It must be general and<br />
consistent with public policy, and 6) It must not<br />
be unreasonable.<br />

power delegated to an LGU is inferior since<br />
it must conform to the limits imposed by the<br />
delegating authority (Congress). In other words,<br />
the national legislative (Congress) is still the<br />
principal and therefore, LGU’s cannot go against<br />
the statutes passed by Congress.<br />
As to the second issue, the Board <strong>of</strong> Pharmacy<br />
maintained that RA 5921 or the Pharmacy Law<br />
was enacted in order to supervise control and<br />
regulate the practice <strong>of</strong> pharmacy in the country.<br />
It also states that the Board <strong>of</strong> Pharmacy is the<br />
only and exclusive body authorized to regulate<br />
and supervise pharmacists and impose penalties<br />
on them in case they were found guilty <strong>of</strong><br />
violation <strong>of</strong> its provisions. There is no provision<br />
in the Pharmacy Law allowing such power to be<br />
delegated in a different body or agency.<br />
On the other hand, the Food and Drug<br />
Administration (FDA) explains that it is the<br />
proper agency to classify drugs or chemical<br />
products or devices that are capable <strong>of</strong> provoking<br />
abortion or preventing conception.<br />
With regard to the third issue, the sangguniang<br />
barangay has no authority to impose a penalty <strong>of</strong><br />
fine for the violation <strong>of</strong> barangay ordinances. It is<br />
only the Sangguniang Panlungsod/Panlalawigan<br />

<strong>Ormoc</strong>’s finest proves to be<br />

The <strong>Ormoc</strong> <strong>City</strong> Police Office<br />
and the <strong>Ormoc</strong> Public Safety<br />
Company has been adjudged as the<br />
Best <strong>City</strong> Police Office in the region<br />
on the 110 th Anniversary <strong>of</strong> the<br />
Philippine National Police during<br />
the awarding ceremony held at the<br />
<strong>of</strong> the PNP regional <strong>of</strong>fice gym<br />
on Thursday. The two units <strong>of</strong> the<br />
local PNP the Senior Police Non-<br />
Commission Officer and the Junior<br />
Police Non-Commission Officers<br />
awardees this year also came from<br />
the OCPO.<br />
Chosen as the Senior Police Non-<br />
Commission Officer was SPOIV<br />
Tomas Serrano, the Intelligence Chief<br />
<strong>of</strong> the Police Community Precinct 1,<br />
while POI Lemuel Cañete, was also<br />
awarded as the Junior Police Non-<br />
Commission Officer <strong>of</strong> the year.<br />
SPOIV Tomas Serrano’s<br />
intelligence gathering was the main<br />
reason he was bestowed the said<br />
award. His intelligence network was<br />
best known for the solution <strong>of</strong> many<br />
cases in the city in the late part <strong>of</strong><br />
2010 and up to the early months <strong>of</strong><br />
this year. He was nearly killed when<br />
he was subdued by the two suspects<br />
behind the series <strong>of</strong> robbery in the city<br />
who tried to get his firearm during a<br />
follow up operation that lead to the<br />
neutralization <strong>of</strong> both suspects.<br />
POI Lemuel Cañete, a former<br />
member <strong>of</strong> the Anti Illegal Drug<br />
Special Operation Task Force<br />
(ADISOTF) and now an intelligence<br />
operative <strong>of</strong> the <strong>Ormoc</strong> Public Safety<br />
Company achievement in a number<br />
<strong>of</strong> successful drug operations in the<br />
city also lead him to be adjudged<br />
as the Junior PNCO for the PNP<br />
occasion this year. A graduate <strong>of</strong><br />
Class 2007 <strong>of</strong> the Philippine Safety<br />
College in Tacloban, Cañete, is best<br />
known for his craft in intelligence<br />
and surveillance gathering operation<br />
that resulted to numerous arrest<br />
the best in the region<br />
<strong>of</strong> suspect most especially drug<br />
peddlers.<br />
While the <strong>Ormoc</strong> <strong>City</strong> Police<br />
Office achievements in criminal<br />
prevention such as low criminality<br />
activities and high crime solutions<br />
was also the reason for them being<br />
adjudged as the Best <strong>City</strong> Police<br />
Office in the entire region defeating<br />
the Tacloban <strong>City</strong> Police Office. But<br />
controversy arises over the choice for<br />
the Best Public Safety Company now<br />
under P/Supt. Neil Montaño because<br />
<strong>of</strong> the recent incident when his men<br />
were involved in the shooting <strong>of</strong> nine<br />
people killing two civilians during the<br />
serving <strong>of</strong> a warrant in Brgy. Liberty<br />
last June 18.<br />
It was learned that only the<br />
Public Safety Company is vying for<br />
the said award, <strong>Ormoc</strong> <strong>City</strong> Public<br />
Safety Company is the only unit<br />
which qualifies as Tacloban <strong>City</strong><br />
Public Safety Company is not ready<br />
to compete yet.<br />

Opposition blocks city hospital<br />
construction<br />

While <strong>Ormoc</strong> <strong>City</strong> Mayor<br />
Eric C. Codilla is doing his best to<br />
pursue the construction <strong>of</strong> the city<br />
hospital, his political opponents<br />
through their patron representing<br />
the district is doing their best<br />
to block the plan. This is what<br />
Mayor Codilla disclosed during an<br />
interview Saturday at a local radio<br />
station. Mayor Codilla said that an<br />
Undersecretary <strong>of</strong> the Department <strong>of</strong><br />
Health has given them “headache”<br />
while the city is complying<br />
requirements like permits and<br />
licenses from the said agency. He<br />
said this undersecretary has been<br />
discouraging the city representative<br />
who handles the processing <strong>of</strong><br />
these documents, questioning why<br />
the city government sees the need<br />
for a city hospital when <strong>Ormoc</strong><br />
District Hospital exists. Mayor<br />
Codilla said that he admitted to the<br />
undersecretary that indeed there is<br />
already a government hospital in<br />
the city but it is only bears the name<br />
as hospital but inside it is different<br />
story. The hospital, in reality is<br />
in a poor state, lacking facilities,<br />
medicines, doctors and hospital<br />
staff. Once inside you could see<br />
how terrible the condition is because<br />
<strong>of</strong> the provincial government’s<br />
seeming neglect <strong>of</strong> its needs. He<br />

Mayor Codilla disclosed that<br />
he asked the DOH <strong>of</strong>ficial why this<br />
move was prevented when he is not<br />
asking a single centavo from DOH<br />
for its construction. He added the<br />
he told the DOH that the city has<br />
already put up at least P40 million<br />
for the construction <strong>of</strong> the building<br />
and told them, that the amount is<br />
quite sufficient for the proposed four<br />
storey building hospital. The mayor<br />
said that the technical working<br />
group tasked to complete the<br />
clearances and permits, and other<br />
requirements for the construction <strong>of</strong><br />
the hospital is nearing completion<br />
and that construction should start<br />
anytime soon.<br />
Lately Mayor Codilla disclosed<br />
that he learned from the same<br />
<strong>of</strong>ficial <strong>of</strong> DOH that reason why<br />
they are blocking the plan <strong>of</strong> the city<br />
to construct a hospital is because<br />
an opposition leader from the city<br />
personally spoke with a higher<br />
<strong>of</strong>ficial <strong>of</strong> the agency to prevent<br />
the city from constructing the city<br />
hospital. The reason: they feared<br />
that once they replace Codilla they<br />
could not find funds to sustain the<br />
proposed hospital. They said that<br />
this opposition leader from the<br />
city admitted to DOH <strong>of</strong>ficials that<br />
Mayor Codilla is a tough act to<br />
follow in terms <strong>of</strong> finding resources<br />
to fund a city hospital because the<br />
only alternative they know, how to<br />
raise the income <strong>of</strong> the city is to<br />
raise the local taxes.<br />

family that he met with some<br />
<strong>Ormoc</strong>anons in a previous trip to<br />
Canada and found out some <strong>of</strong> them<br />
are their mutual friends. The mayor<br />
gave a personalized notebook and<br />
pencil to <strong>Maria</strong> as a souvenir.<br />
He also gave her a copy <strong>of</strong> “Ang<br />
<strong>Ormoc</strong>anon,” the LGU’s <strong>of</strong>ficial<br />
newsletter. While informing the<br />
visitors that they can log in to<br />

happenings in the city.<br />
In return, <strong>Maria</strong> Aragon sang a<br />
portion <strong>of</strong> the Lady Gaga’s “Born<br />
This Way,” the piece which was<br />
uploaded in <strong>YouTube</strong> which paved<br />
the way to her popularity. <strong>City</strong><br />
Hall employees flocked to the<br />
Mayor’s <strong>of</strong>fice when they learned<br />

that <strong>Maria</strong> was there. Everybody<br />
wanted to have their picture taken<br />
with the star who willingly posed<br />
with them.<br />
Until she left the <strong>City</strong> Mayor’s<br />
Office she was seen hugging the<br />
notebook and pencil that Mayor<br />
Beboy Codilla gave her. Mayor<br />
Codilla further told the guests that it<br />
is part <strong>of</strong> the school supplies that are<br />
being distributed to school children<br />
in the city. He also informed <strong>Maria</strong>’s<br />
family who had been in Canada<br />
for quiet sometime now that the<br />
local government here under his<br />
administration has a scholarship<br />
program for the poor but deserving<br />
students<br />
According to Jude Abenoja,<br />
the visit was in response from the<br />
invitation <strong>of</strong> the Couples for Christ<br />
and the ANCOP. It was learned that<br />
<strong>Maria</strong> Aragon is the ambassadress<br />
<strong>of</strong> the ANCOP or Answering the<br />
Cry <strong>of</strong> the Poor worldwide.<br />
Another reason <strong>of</strong> her visit<br />
is because her mother Menchie<br />
Catangcatang Aragon is from<br />
<strong>Ormoc</strong>. She grew in Brgy. Milagro<br />
and studied in Dolores Elementary<br />
School before she went to Manila<br />
and finally migrated to Canada.<br />
Her father, Mr. Veni Aragon said<br />
that <strong>Maria</strong> and his three other<br />
children got their singing talent<br />
from him. The proud father said<br />
that <strong>Maria</strong> did not have formal<br />
voice lessons. Her brother was the<br />
one who gave her lessons in piano.<br />
The Aragon family was happy and<br />
very thankful <strong>of</strong> the warm welcome<br />
<strong>of</strong> the <strong>Ormoc</strong>anons. <strong>Maria</strong>’s sisters<br />
Linger and Rojuane and brother JV<br />
accompanied her. Rojuane, who<br />
uploaded the video in Youtube<br />
said that she did not expect that it<br />
it will gain her sister worldwide<br />
fame. <strong>Maria</strong> expressed her thanks<br />
in Tagalog since she could not<br />
speak in Cebuano. “Salamat sa<br />
inyong suporta at sana bumili kayo<br />
ng album ko. Malapit na itong<br />
lumabas.” She was referring<br />
to her self-titled album soon to<br />
be release by Star Records, the<br />
recording arm <strong>of</strong> ABS-CBN . It<br />
was later learned from Abenoja<br />
that ANCOP will have a Global<br />
Walk on August 21. It aims to raise<br />
funds for the scholars and for their<br />
livelihood programs.<br />

visited some schools in the city.
<strong>City</strong> plans for tourism month<br />

The <strong>Ormoc</strong> <strong>City</strong> Tourism<br />
Council met last Thursday, August<br />
4 at the conference room <strong>of</strong> the <strong>City</strong><br />
Mayor’s Office, New <strong>Ormoc</strong> <strong>City</strong><br />
Hall.<br />
<strong>City</strong> Councilor Lea Doris Villar,<br />
12 th Sangguniang Panlungsod<br />
Tourism Committee chairman and<br />
vice chairman <strong>of</strong> <strong>City</strong> Tourism<br />
Council presided the meeting where<br />
she laid the plans for the upcoming<br />
tourism month celebration on<br />
September.<br />
Some <strong>of</strong> prospected activities<br />
are Kalachuchi (frangipani)<br />
tree planting on September 8,<br />
International coastal cleanup on<br />
the 17 th and World Tourism Day<br />
on the 27 th . The Kalachuchi tree<br />
planting will be done alongside the<br />
city quadrangle, any open areas <strong>of</strong><br />
the respective barangays and each<br />
school premises. Kalachuchi was<br />
chosen since it is the <strong>of</strong>ficial city<br />
flower <strong>of</strong> <strong>Ormoc</strong>. Another tree<br />
planting activity is tentatively set<br />
on September 10 at Brgy. Mahayag.<br />
<strong>Ormoc</strong> Hotels and Restaurants<br />
Association (OHRA), Liga ng mga<br />
Barangay, Civic Organizations<br />
and NULOC are in cohorts for<br />
the international coastal cleanup<br />
tagged as Beachurero Activity at<br />
<strong>Ormoc</strong> beaches. A night is set<br />
for cultural presentation <strong>of</strong> folk<br />
songs and dances where <strong>Ormoc</strong><br />
Choreographers Guild, EVSU<br />
Dance troupe, DepEd, tourism<br />
stakeholders and partners will show<br />
their talents. The PNP and tricycle<br />
drivers also showed interest to show<br />
their talents.<br />

Agreement in creating a tourism<br />

tourists be it a foreign or local<br />
and for promotion <strong>of</strong> a secured<br />

soon. Together with this, is the<br />

floor <strong>of</strong> this is the souvenir shop.<br />
They will also construct handrails<br />
on the stairs with simulated<br />
wood design. And maintain the<br />
cleanliness <strong>of</strong> the circumferential<br />
foot trail with interpretive sign<br />

together for students<br />

Working for the common good<br />
<strong>of</strong> their constituents, the barangay<br />
<strong>of</strong>ficials headed by Chairman<br />
Dionisio Aligway with the DepEd<br />
family here under Mrs Divina<br />
Montalban work together for the<br />
betterment <strong>of</strong> the pupils. In a short<br />
discussion with both Aligway and<br />
Montalban during the culmination<br />
activity <strong>of</strong> their Search for A-1<br />
Child, they told Ang <strong>Ormoc</strong>anon<br />
that the school is their common<br />
constituents.<br />
During the celebration <strong>of</strong><br />
the Nutrition Month recently,<br />
Barangay Kadaohan Council<br />
and the Cabatoan Elementary<br />
School faculty and staff initiated<br />
programs that would make its<br />
culmination a memorable one.<br />
In the morning <strong>of</strong> July 29, pupils<br />
from all grade levels including<br />
those in the Day Care and Prep<br />
up to grade six were feed with<br />
healthy and delicious “lugaw”. In<br />
the afternoon a second set <strong>of</strong> the<br />
program was held which is the<br />
health and brain contest so called<br />
Search for A-1 Child which kicked<br />
<strong>of</strong>f with a parade participated by<br />
the contestants and their parents,<br />
teachers, barangay <strong>of</strong>ficials and<br />
the residents as well.<br />
Part <strong>of</strong> the contest proper<br />
includes production number,<br />
display <strong>of</strong> talents and the question<br />
and answer where the seven<br />
contenders give their best idea<br />
about “nutrition”. In his message<br />
Brgy. Captain Dionisio Aligway<br />
admired how these young boys<br />
and girls answered the questions<br />
given them. Like having a daily<br />
good and healthy habit-even the<br />
simplest but <strong>of</strong>ten times neglected<br />
task <strong>of</strong> taking a bath and brushing<br />
their teeth, eating right and<br />
nutritious foods, maintaining<br />

Butanding seen at <strong>Ormoc</strong> Bay<br />

Local residents here do not have<br />
to go to Donsol, Sorsogon in Bicol<br />
to see the famous whale sharks<br />
(rhincodon typus) also known<br />
as butanding. This is because<br />
personnel <strong>of</strong> CASO- Fisheries and<br />
Marine division reported sightings<br />
<strong>of</strong> the giant fish last Aug 10. It was<br />
learned that four giant whale sharks<br />
seen last Wednesday. The whale<br />
sharks were seen sipping planktons<br />
at the bay which amused many<br />
observers.<br />
In the past two days, two <strong>of</strong><br />
this giant fish were seen at the bay.<br />
Two paddle power boats were seen<br />
with people on board believed to<br />
be visitors, go near the butanding.<br />
Those on board the boat were seen<br />
taking pictures while others were<br />
seen touching the fins just like what<br />
tourists do in Donsol.<br />
CASO Fishery and Marine<br />
division head Alberto Arcuino,<br />
in an earlier interview said that<br />
<strong>Ormoc</strong> Bay is frequently visited<br />
by this giant fish. But this is the<br />
first time that butanding was seen<br />
this close to the shore. According<br />
to observers that the three <strong>of</strong> the<br />
four are estimated to weight more<br />
than 2 tons while the other one is<br />
smaller. <strong>City</strong> Councilor Jose “Pepe<br />
Boy” Alfaro, the Chairman on the<br />
Committee on Environment and<br />
Natural Resources <strong>of</strong> the city council<br />
in an earlier interview, said that the<br />
whale sharks are now considered<br />
“endangered species” and catching<br />
and slaughtering <strong>of</strong> this fish is<br />
prohibited by law. Anyone caught<br />
catching and slaughtering the fish<br />
will face criminal charges in court.<br />

Leyte College Mustangs send a<br />
serious message <strong>of</strong> contention as<br />
they crash the AMA Computer<br />
Learning Center Titans, 84-67, to<br />
start their campaign in the PCCL<br />
qualifiers OCSSO Season V 1 st<br />
conference.<br />
The Mustangs, champions<br />
<strong>of</strong> the 2 nd conference <strong>of</strong> the 4 th<br />
installation, win despite playing<br />
without Tejay Napolitano, Christian<br />
Sean Laude and Alfie Amarante.<br />
The three are responsible for the 2 nd<br />
place finish <strong>of</strong> the Mustangs in the<br />
Fiesta Inter-Collegiate Invitationals<br />

A junior student, Villar take<br />
the reins <strong>of</strong> the top board after<br />
Lester Dale Suico graduated. With<br />
the pressure on his back, Villar<br />
masterfully mustered out to outwit<br />
his board 1 opponent in this double<br />
round robin tournament.<br />
Albuera Private High School<br />
posted also a commanding 3-1<br />
victory over SNC including an<br />
upset by May Clarence Sanico<br />
over in the board 2 encounter.<br />
The win put APHS and SPC tied<br />
atop the standings with 3 points<br />
while SNC scores 2. SNC played<br />
