to public policy). 136 Nevertheless, there would appear even today to rema<strong>in</strong><br />

some judicial debate concern<strong>in</strong>g the extent to which conditions that discrim<strong>in</strong>ate<br />

aga<strong>in</strong>st persons on the basis <strong>of</strong> religious beliefs are <strong>in</strong> violation <strong>of</strong> public<br />

policy.'" In light <strong>of</strong> the judicial obligation to develop the common law <strong>in</strong><br />

accordance with the values conta<strong>in</strong>ed <strong>in</strong> the Charter, it is likely that the prohibition<br />

upon discrim<strong>in</strong>atory contracts will gather <strong>in</strong>creas<strong>in</strong>g force <strong>in</strong> the future.'"<br />

5. <strong>Contract</strong>s Affect<strong>in</strong>g Marriage<br />

<strong>The</strong> category <strong>of</strong> public policy which seeks to preserve the <strong>in</strong>stitution <strong>of</strong><br />

marriage is currently undergo<strong>in</strong>g a significant evolution, and it is submitted that<br />

<strong>of</strong> its three heads, two will eventually be abandoned by the judiciary <strong>in</strong> response<br />

to chang<strong>in</strong>g social conditions.<br />

<strong>The</strong> first such head is concerned with contracts to "broker," or procure a<br />

marriage.'39 Although the rule aga<strong>in</strong>st marriage brokerage has yet to be overturned,<br />

it must be acknowledged that "[t]here is now a substantial and pr<strong>of</strong>itable<br />

<strong>in</strong>dustry devoted to the f<strong>in</strong>d<strong>in</strong>g <strong>of</strong> spouses or other life-partners and those who<br />

take advantage <strong>of</strong> its services."'4° Further, the old jurisprudence is based on a<br />

theory <strong>of</strong> marriage as a "holy union" which should not be "defiled" by secular<br />

considerations. It is therefore grounded upon religious and ethical precepts that<br />

run counter to the current legal <strong>in</strong>terpretation <strong>of</strong> marriage as a civil <strong>in</strong>stitution. 141<br />

Were the question to arise before a modern court, it would probably be found<br />

that this head <strong>of</strong> public policy is no longer controll<strong>in</strong>g. 142<br />

<strong>The</strong> other class <strong>of</strong> contracts affect<strong>in</strong>g marriage whose cont<strong>in</strong>ued authority<br />

is questionable concerns an agreement by a married <strong>in</strong>dividual to wed a person<br />
