improvements by Declarant shall not be considered a nuisance

completed and conveyed to third parties.
All rights afforded
Declarant under this Article shall inure to the benefit of
any mortgage holder acquiring title to any Unit hereunder.
ARTICLE XIII.
AMENDMENTS
13.1: Upon the expiration of the Declarant Control
Period or upon the earlier written relinquishment of the
Declarant's authority duly recorded, the Unit Owners may
modify and amend this Declaration and Bylaws by satisfying
section 448.2-117 of the Act.
The president, treasurer,
secretary or assistant secretary may prepare, execute, certify
and record amendments to this Declaration on behalf of
the Association.
Each such modification and amendment must
be duly recorded in the Office of the Recorder of Deeds in
St. Louis County , Missouri, provided, however, that
