DRINKING WATER BRANCH-WATER DIVISION<br />

ALABAMA DEPARTMENT OF ENVIRONMENTAL MANAGEMENT<br />

Program Management and Administration<br />

The Drinking Water Branch currently has 20 employees; including 8 environmental engineers, 5<br />

environmental scientists, 4 administrative assistants, and 3 supervisors.<br />

ADEM’s Drinking Water Branch regulates “public <strong>water</strong> systems.” There are two categories of<br />

public <strong>water</strong> systems regulated by the Drinking Water Branch. The first category is community<br />

<strong>water</strong> systems, and the second category is non-community <strong>water</strong> systems.<br />

Community <strong>water</strong> systems are <strong>water</strong> systems that serve the same people year-round. Examples<br />

of community <strong>water</strong> systems include <strong>water</strong> systems owned and operated by cities, towns,<br />

counties, and mobile home parks. At the end of FY2011 there were 527 community <strong>water</strong><br />

systems in <strong>Alabama</strong>.<br />

Non-community <strong>water</strong> systems are <strong>water</strong> systems that serve the public but do not serve the same<br />

people year-round. There are two types of non-community <strong>water</strong> systems: non-transient and<br />

transient. A non-transient non-community <strong>water</strong> system serves the same people more than six<br />

months per year, but not year-round. Examples of non-transient non-community <strong>water</strong> systems<br />

include schools and industries that have their own <strong>water</strong> supply system. At the end of FY2011<br />

there were 22 non-transient non-community <strong>water</strong> systems in <strong>Alabama</strong>. A transient noncommunity<br />

<strong>water</strong> system serves the public, but not the same individuals, at least sixty days per<br />

year. Examples of transient non-community <strong>water</strong> systems include rest areas and campgrounds<br />

that have their own <strong>water</strong> supply system. At the end of FY2011 there were 57 transient noncommunity<br />

<strong>water</strong> systems in <strong>Alabama</strong>.<br />

The Drinking Water Branch conducted 644 site visits (i.e., <strong>water</strong> system inspections) during<br />

FY2011, and the number of permits issued or renewed was 209. There were 12 Notices of<br />

Violation (NOV) and 10 Administrative Orders (AO) issued in FY2011.<br />

Public Participation<br />

Branch staff continued to be very active in numerous <strong>water</strong> industry organizations, including<br />

making presentations and attending the following:<br />

Permitting Activities<br />

In order to operate a public <strong>water</strong> system is required to have a valid permit issued by the<br />

<strong>Department</strong>. Community <strong>water</strong> system permits are valid for six years and non-community<br />

permits are valid for ten years. Before a permit can be considered for renewal, an application<br />

package (application, fee, and any additional information required by the <strong>Department</strong>) must be<br />

submitted to ADEM for review and processing. The district inspector responsible for ensuring a<br />

<strong>water</strong> system complies with <strong>Department</strong> regulations reviews the information on the application<br />

and in the system files before issuing the renewal permit. Special conditions are included in<br />

some permits to correct system deficiencies, to address areas of non-compliance or to place<br />

requirements on a system that are not specifically addressed in the permit general conditions.<br />

For <strong>water</strong> purchased from other public <strong>water</strong> systems copies of the purchase contracts are<br />

required as a part of the application process to ensure that each purchase system has a legal<br />

contract for an adequate <strong>water</strong> supply.<br />

In FY2011 permit renewal applications were issued for 49 <strong>water</strong> systems, and 26 permit<br />

modifications were issued for changes in ownership, consolidation of <strong>water</strong> systems, facility<br />

name changes, or other changes. Table 1 contains the breakdown of Operating Permit activity.<br />

Public <strong>water</strong> systems must obtain a permit prior to the start of construction on any major addition<br />

(e.g. storage tanks, booster pump stations, new sources, and significant <strong>water</strong> main additions). A<br />

satisfactory application package (permit application, fee, and plans/specifications stamped by a<br />

professional engineer) must be received before the <strong>Department</strong> will issue a construction permit.<br />

Upon issuance of the permit the project information is logged into a database and its progress is<br />

tracked through monthly <strong>report</strong>s submitted by the consulting engineer for the project. Staff<br />

engineers reviewed and issued 93 construction permits in FY2011.<br />

Approval to place the permitted project into service is given after submittal of the required<br />

information. This information includes a project completion form with material quantities and<br />

final costs, satisfactory bacteriological results and pressure test results. An on-site final<br />

inspection of the new facilities is generally not required. Record drawings must be provided to<br />

ADEM within 30 days of the final inspection on the project. A new <strong>water</strong> system becomes a<br />

regulated public <strong>water</strong> system when a compliance activation date is set and monitoring<br />

requirements are established. Table 2 lists public <strong>water</strong> system construction permit activities.<br />

Water System Inspection Activities<br />

The Branch staff inspects all community and non-community systems on an <strong>annual</strong> basis. Every<br />

third year a sanitary survey is conducted on each <strong>water</strong> system in lieu of an <strong>annual</strong> inspection.<br />

The goal of these inspections is to review the required documentation maintained at the<br />

<strong>Department</strong> and <strong>water</strong> system office, discuss system operation and maintenance policies, check<br />

chlorine residuals, pH, and iron content, and visually inspect the system facilities to confirm<br />

proper operation and maintenance. During these inspections, the Branch staff offers technical<br />

assistance to <strong>water</strong> system personnel to improve system operation. Issues such as deteriorating<br />

equipment, inadequate <strong>water</strong> storage tank maintenance, proposed or new regulations, public<br />

relations, operator certification, <strong>water</strong> conservation plans, bacteriological/chemical monitoring<br />

plans, monitoring/<strong>report</strong>ing violations, and proposed or ongoing construction projects are<br />

frequently discussed. Additional visits to <strong>water</strong> systems are performed to finalize construction<br />

projects, address customer complaints and monitoring violations, conduct susceptibility analysis<br />

of sources and attend board/council meetings. <strong>Department</strong> inspectors use the USEPA Sanitary<br />

Survey form and guidance documents when conducting <strong>annual</strong> inspections and sanitary surveys.<br />

A total of 603 inspections (327 sanitary surveys and 276 other inspections), were conducted in<br />

FY2011. Appendix A lists <strong>water</strong> system inspection activities.<br />

SDWIS/State Activities<br />

In FY2011, the Drinking Water Branch maintained its database of record, SDWIS/STATE Web<br />

Release 3.01. CDS continued to be utilized for automated compliance determination and sample<br />

tracking. A Drinking Water Branch representative attended the 2011 ASDWA/EPA Data<br />

Management Users Conference in Boise, Idaho during May, 2011 to receive continuing<br />

education regarding the SDWIS/STATE program. The Branch continued to <strong>report</strong> Drinking<br />

Water Branch Data to EPA using FedRep, which is part of the Modernized Data Flow System<br />

implemented by EPA. Data was <strong>report</strong>ed via XML format using FedRep.<br />

At this time, the Branch is continuing to study the possibility of using other SDWIS/STATE<br />

software to allow electronic <strong>report</strong>ing of monitoring results from the laboratories to the<br />

<strong>Department</strong>. Any electronic result submissions would have to comply with the Cross-Media<br />

Electronic Reporting Rule (CROMERR) promulgated by EPA during FY2006. The SDWIS Labto-State<br />

software allows labs to submit XML files of chemical and bacteriological results using<br />

the eDWR schema to the <strong>Department</strong>. The XML files can then be directly uploaded into<br />

SDWIS/STATE. SDWIS Lab-to-State has been approved as CROMERR compliant and may be<br />

used.<br />

The Information Systems <strong>branch</strong> is continuing to work on an electronic data <strong>report</strong>ing product<br />

(eDWR) for the Drinking Water Branch to use to receive <strong>report</strong>s and monitoring results<br />

electronically. This product would receive the results and automatically migrate the data into<br />

SDWIS/STATE. The Drinking Water Branch and Information Systems Branch are prepared to<br />

test the electronic monitoring results submission with participating labs. This software must also<br />

be CROMERR compliant.<br />

Drinking Water Security Program<br />

The protection of public infrastructure is a cornerstone of <strong>Alabama</strong>’s Homeland Security<br />

program, especially public <strong>drinking</strong> <strong>water</strong> supplies; therefore the Drinking Water Branch has<br />

ongoing efforts to ensure the safety of <strong>Alabama</strong>’s <strong>drinking</strong> <strong>water</strong> supply. The Branch has<br />

successfully addressed and will continue to address bioterrorism, natural disasters, and other<br />

intentional acts that could disrupt or compromise the safety and reliability of <strong>drinking</strong> <strong>water</strong><br />

supplies.<br />

In efforts to ensure the safety of <strong>Alabama</strong>’s <strong>drinking</strong> <strong>water</strong> supply, the Drinking Water Branch<br />

continues to conduct security inspections and assist <strong>drinking</strong> <strong>water</strong> utilities with emergency<br />

response, as well as provide technical assistance and information to utilities, consultants, ADEM<br />

staff, and the general public.<br />

The Drinking Water Branch maintains a list of Standard Operating Procedures (SOPs) designed<br />

to ensure prompt and efficient responses between the utility, public health personnel, law<br />

enforcement, medical, and other emergency responders in the event of an intentional, natural, or<br />

terrorist act involving public <strong>water</strong> systems.<br />

To more efficiently communicate security updates to the <strong>drinking</strong> <strong>water</strong> utilities in the State, the<br />

Drinking Water Branch is constantly updating and maintaining the Drinking Water Utility e-mail<br />

distribution list. In addition, periodic reviews of The Water ISAC (Information Sharing &<br />

Analysis Center) are performed to glean security information that can be passed along to the<br />

utilities by e-mail.<br />

The Drinking Water Branch is presently working with The <strong>Alabama</strong> Rural Water Association<br />

with training classes and presentations on security topics.<br />

Capacity Development Program<br />

The Safe Drinking Water Act requires states to develop a Water System Capacity Development<br />

Strategy and Implementation Plan. The basis of <strong>Alabama</strong>’s plan is to limit the development of<br />

non-viable systems. Procedures established by this plan were incorporated into a Capacity<br />

Development Strategy which has been utilized to reduce the number of systems that do not have<br />

the technical, financial or managerial ability to operate in accordance with state and federal<br />

requirements. An aspect of this plan involves partnering with the <strong>Alabama</strong> Rural Water<br />

Association (ARWA).<br />

In FY2011, the <strong>Department</strong> contracted with the ARWA for the ARWA to provide a capacity<br />

development <strong>report</strong> for three <strong>water</strong> systems which were having difficulty complying with<br />

regulations. The Drinking Water Branch is working with these systems to correct the<br />

deficiencies noted during the Capacity Development Studies.<br />

Also for FY2011, the <strong>Department</strong> prepared the Annual Capacity Development Implementation<br />

Report and submitted it to EPA. This <strong>report</strong> profiled ADEM’s work with public <strong>drinking</strong> <strong>water</strong><br />

systems to improve their technical, financial, and managerial abilities.<br />

Consumer Confidence Report Program<br />

The 1996 amendments to the Safe Drinking Water Act (SDWA) require community <strong>water</strong><br />

systems to provide an <strong>annual</strong> Consumer Confidence Report (CCR) to their customers. The<br />

content of the CCR and delivery method are specified in the <strong>Department</strong>’s Drinking Water<br />

regulations. The CCR is to include information for each calendar year and is to be delivered to<br />

customers and the Drinking Water Branch no later than July 1 of the following year. In addition<br />

to the copy of the CCR supplied to the Branch, a <strong>water</strong> system must also submit by July 1 a<br />

Certification Form stating the CCR delivery method met Division 7 regulations. This Annual<br />

Report covers the calendar year from July 2010 through June 2011. Of the 529 <strong>water</strong> systems<br />

required to complete a CCR and Certification Form, the <strong>Department</strong> received 100% compliance<br />

to meet the July 1 deadline.<br />

Potability Certificate Program<br />

There is an agreement with the US <strong>Department</strong> of Agriculture (USDA) and the <strong>Alabama</strong><br />

<strong>Department</strong> of Public Health (ADPH) for ADEM to issue <strong>water</strong> potability certificates to meat<br />

processing facilities, ice producing facilities and dairies. These facilities are required to submit<br />

monthly bacteriological results and maintain a free chlorine residual of one part per million<br />

(ppm). Based on the review of twelve monthly bacteriological results, renewal of the certificate<br />

is either granted or denied. In FY2011, a total of four potability certificates were issued. They<br />

were all renewals.<br />

Bottled Water Program<br />

The Drinking Water Branch is responsible for approving bottled <strong>water</strong> sources and maintains a<br />

database of approved sources in the state. An informational package is mailed to persons<br />

interested in the development of a bottled <strong>water</strong> source. This package lists the steps needed for<br />

approval of a bottled <strong>water</strong> source. Treatment of the source is based on its raw <strong>water</strong> quality. A<br />

Branch representative conducts an on-site inspection of the source and its treatment facility and<br />

issues an initial approval or non-approval of the bottled <strong>water</strong> source. After approval of a source,<br />

the Food and Drug Administration, through an agreement with the <strong>Alabama</strong> <strong>Department</strong> of<br />

Public Health (ADPH), is responsible for the regulation of all bottled <strong>water</strong> facilities.<br />

One inquiry was received from individuals planning to develop a bottled <strong>water</strong> source in<br />

FY2011. Currently, there are eighteen approved sources of bottled <strong>water</strong> in <strong>Alabama</strong>. The<br />

eighteen sources include the use of raw <strong>water</strong> from an approved public <strong>water</strong> supply source, and<br />

several private well and spring sources.<br />

Water Well Driller Licensing Program<br />

In FY2011, 138 well driller licenses were issued. Of the total number of licenses issued, 38 were<br />

new licensees. The <strong>Department</strong> received $27,600 for license fees. There is a $500.00 fine for<br />

drilling a well without a license.<br />

Applicants may apply to take the <strong>Alabama</strong> Water Well Driller’s License exam with LaserGrade<br />

Computer Based Testing at www.lasergrade.com or call 1-800-211-2754. The exams can be<br />

taken any time during business hours and are administered at approved locations.<br />

Source Water Assessment Program (SWAP) – Surface Water Sources<br />

A surface <strong>water</strong> SWAP is required for “traditional” surface sources (rivers, creeks, lakes) and<br />

other sources designated as Ground<strong>water</strong> Under the Direct Influence of surface <strong>water</strong> (GUDI).<br />

As required by the 1996 amendments to the Safe Drinking Water Act, <strong>Alabama</strong> has conducted<br />

the SWAPs for all active surface sources and intakes as of the beginning of FY2011. In FY2011<br />

there were 72 <strong>water</strong> systems utilizing 94 surface <strong>water</strong> sources.<br />

A surface <strong>water</strong> SWAP must be completed prior to issuing a permit to construct the intake at the<br />

source. During FY2011, one surface source SWAP was approved; however, the <strong>water</strong> system<br />

has decided not to utilize this intake. The assessments are to be reviewed and updated, if<br />

necessary, when the system applies to renew its operating permit (every six years). A completed<br />

SWAP for a surface <strong>water</strong> source must include the following:<br />

• Delineation of the <strong>water</strong>shed,<br />

• Contaminant source inventory,<br />

• Susceptibility analysis of each possible contaminant source in the inventory,<br />

• Contingency plan, and<br />

• A public awareness requirement<br />

The majority of potential contaminant sites within the source <strong>water</strong> assessment areas have been<br />

given a “low susceptibility” ranking. The main reason for these low rankings is that many of the<br />

raw <strong>water</strong> sources were designated for <strong>drinking</strong> <strong>water</strong> at the time of construction, and therefore,<br />

use by the public has been controlled. The majority of potential contaminants stem from highway<br />

bridge crossings where vehicular traffic is high but the potential for a “contamination event” is<br />

low.<br />

Source Water Assessment (SWAP) – Ground<strong>water</strong> Sources<br />

All public <strong>water</strong> supply systems with ground <strong>water</strong> sources have completed a SWAP for each of<br />

their existing sources. All <strong>water</strong> systems are required to update their SWAPs when applying for<br />

reissuance of their permits-to-furnish <strong>water</strong>. All new ground<strong>water</strong> sources must have a<br />

completed SWAP, prior to using the source for potable <strong>water</strong>. A completed SWAP for a<br />

ground<strong>water</strong> source must include the following:<br />

• Delineation of the source <strong>water</strong> assessment area (SWAA),<br />

• An inventory of the possible contaminant sources within the SWAA,<br />

• A susceptibility analysis of each possible contaminant source in the inventory, and<br />

• A public awareness requirement<br />

When the SWAP requirements were initially promulgated, <strong>Alabama</strong> had a total of 414 public<br />

<strong>water</strong> supply systems that utilized one or more ground<strong>water</strong> sources. These systems were<br />

required to complete a SWAP for their ground<strong>water</strong> sources. The public <strong>water</strong> supply systems<br />

were categorized as follows:<br />

• 310 Community Ground<strong>water</strong> Systems<br />

• 75 Non-Community Transient Ground<strong>water</strong> Systems, and<br />

• 29 Non-Community Non-Transient Ground<strong>water</strong> Systems<br />

<strong>Alabama</strong> has received fifteen SWAPs for thirteen new or expanded ground<strong>water</strong> sources in<br />

FY2011. Eleven of these <strong>report</strong>s were submitted from existing public <strong>water</strong> systems and one<br />

<strong>report</strong> was submitted from a new public <strong>water</strong> system. SWAPs have been finalized for eight of<br />

the new well sources. For the remaining ground<strong>water</strong> source, the SWAP is currently in the<br />

process of being reviewed and finalized.<br />

Wellhead Protection Program<br />

The wellhead protection program is regulated through the Drinking Water regulations, but is<br />

administered by a staff member in ADEM’s Ground<strong>water</strong> Branch.<br />

Underground storage tanks (UST) are the greatest source of chemical contaminants in ground<br />

<strong>water</strong> in <strong>Alabama</strong>. Approximately 335 UST compliance inspections were completed within<br />

wellhead protection areas. Approximately 175 corrective action sites are located within<br />

wellhead protection areas.<br />

The 2011 <strong>Alabama</strong> Ground<strong>water</strong> Conference was held on June 9. There were approximately 135<br />

registered attendees.<br />

ADEM continues to support and be part of the Ground<strong>water</strong> Guardian Program. ADEM was<br />

designated a Ground<strong>water</strong> Guardian Affiliate for the fifteenth year. In addition, nine<br />

communities in <strong>Alabama</strong> were designated by the National Ground<strong>water</strong> Foundation as<br />

Ground<strong>water</strong> Guardians. The communities include Covington County, Etowah County-Middle<br />

Coosa Watershed, City of Eufaula, Madison County, New Brockton/Coffee County, Shelby<br />

County, St. Clair County-Middle Coosa Watershed, Sumter and Marengo Counties, and the City<br />

of Tuscumbia.<br />

The Ground<strong>water</strong> Festival Program continues to be a part of the Wellhead Protection Program by<br />

providing a structured outreach and education event. It provides an avenue for utilities to<br />

become involved in and initiate <strong>drinking</strong> <strong>water</strong> education programs in their service<br />

area. ARWA, with input from ADEM, continues to maintain the Water Festival website.<br />

Ground<strong>water</strong> Festivals were held in 27 counties in the State and hosted 22,000 students. ADEM<br />

continues to offer the Festival grant, which provides a maximum of $1,000 to each county. All<br />

27 counties that applied were awarded the grant. ADEM continues to actively recruit counties to<br />

participate in Ground<strong>water</strong> Festivals.<br />

Area Wide Optimization Program (AWOP) Participation<br />

ADEM continued to be an active participant in the EPA Region 4 Area Wide Optimization<br />

Multi-State Pilot Program. The AWOP-MSPP is a cooperative effort to optimize performance of<br />

existing surface <strong>water</strong> treatment plants. The main goal of the program is to maximize public<br />

health protection from microbial contaminants and disinfection byproducts by coordinating<br />

existing system resources with proven performance improvement tools. Other states<br />

participating in the program include Georgia, Kentucky, South Carolina, North Carolina, and<br />

Florida. Several members of the Drinking Water Branch’s Surface Water Section participated in<br />

and conducted activities associated with AWOP-MSPP. These activities included the following:<br />

• ADEM staff attended the three AWOP planning meetings and workshops during<br />

FY2011. These meetings were held December 2010 in Rock Hill, SC; March 2011 in<br />

Decatur, GA; and July 2011 in Cincinnati, OH.<br />

• ADEM participated in developmental activities for the Distribution System<br />

Comprehensive Performance Evaluation with the EPA Technical Support Center during<br />

FY2011. ADEM concluded the Comprehensive Technical Assistance program with the<br />

• Presentations regarding AWOP topics were made at the AWPCA and ARWA<br />

conferences.<br />

• Each Surface Water Engineer has made AWOP a priority for the systems in their district<br />

and incorporates AWOP into their daily activities.<br />

Enforcement Activities<br />

Drinking Water Branch enforcement activities are shown in Table 3. 75 violation letters (e.g. –<br />

Maximum Contaminant Level exceedances, Monitoring and Reporting violations, etc.) were<br />

mailed to <strong>water</strong> systems during FY2011. Because of the seriousness of MCL violations,<br />

Drinking Water staff attempt to perform as many follow-up inspections as possible for this type<br />

of violation. These follow-up inspections were conducted as either separate inspections or in<br />

conjunction with the <strong>annual</strong> inspection or sanitary survey. Circumstances surrounding the<br />

violation were discussed with system personnel and, if necessary, procedural changes were<br />

implemented by the system to prevent recurrence of the violation. Drinking Water Branch staff<br />

conducted a total of eight of these follow-up visits.<br />

Twelve Notices of Violation (NOVs) were issued for systems incurring multiple violations,<br />

having multiple deficiencies at one time, or having an issue needing increased attention from the<br />

<strong>water</strong> system. The majority of the ten consent orders were issued for <strong>water</strong> systems that became<br />

disinfection byproducts Significant Non-Compliers (SNC). Prior to finalizing a consent order, a<br />

<strong>water</strong> system is afforded the opportunity to meet with Branch staff and “show cause” why the<br />

order should be modified or withdrawn. No show cause hearings were held during the fiscal<br />

year. The <strong>Department</strong> did not enter into any court cases during FY2011.<br />

Bacteriological Monitoring and Compliance<br />

A total of 530 community <strong>water</strong> systems were required to monitor for bacteriological<br />

contaminants. Thirteen systems incurred monitoring violations, and fifteen systems incurred<br />

MCL violations. A complete list of all <strong>water</strong> systems with bacteriological violations can be<br />

found in Appendices B and C.<br />

97.5% of the community <strong>water</strong> systems were in compliance with monitoring and <strong>report</strong>ing<br />

requirements for the Coliform Standard and 98.4% were in compliance with MCL standards.<br />

Bacteriological compliance rates were higher for both monitoring and <strong>report</strong>ing requirements<br />

and the same for maximum contaminant levels as the previous fiscal year.<br />

23 Non-Transient Non-Community (NTNC) Water Systems were required to monitor for<br />

bacteriological contaminants. One NTNC <strong>water</strong> system incurred monitoring violations. No<br />

NTNC <strong>water</strong> system incurred an MCL violation.<br />

61 Transient Non-Community (TNC) Water Systems were required to monitor for<br />

bacteriological contaminants. Eight systems incurred twelve monitoring violations, and three<br />

systems incurred MCL violations. 80% of the systems were in compliance with monitoring and<br />

<strong>report</strong>ing requirements and 95% of the systems were in compliance with MCL standards.<br />

Bacteriological compliance rates were higher for monitoring and <strong>report</strong>ing requirements and the<br />

same for MCL violations as the previous fiscal year.<br />

Chemical Monitoring and Compliance<br />

Chemical monitoring is scheduled based on the calendar year. Therefore, only a summary of the<br />

results for the present fiscal year will be included in this <strong>annual</strong> <strong>report</strong>. A complete <strong>report</strong> of<br />

chemical compliance data for calendar year 2011 will be included in the 2011 <strong>annual</strong> violations<br />

<strong>report</strong> which will be produced in May or June 2012.<br />

129 <strong>water</strong> systems monitored 186 different sources for inorganic contaminants. All <strong>water</strong><br />

systems with sources were required to monitor for nitrates, with no system incurring an MCL<br />

violation for any inorganic contaminant.<br />

267 <strong>water</strong> systems monitored for volatile organic chemicals (VOCs). Of the 550 ground and<br />

surface sources analyzed during the fiscal year, 60 sources contained eleven different regulated<br />

VOCs. Appendix D lists the organic chemical contaminant detections by <strong>water</strong> source.<br />

217 <strong>water</strong> systems monitored for synthetic organic chemicals (SOCs). Of the 462 ground and<br />

surface sources analyzed for SOCs, 55 sources contained nine different regulated SOCs.<br />

73 surface and 53 ground <strong>water</strong> systems were required to monitor for turbidity. Although several<br />

systems were late in <strong>report</strong>ing turbidity data during the year, no systems incurred treatment<br />

technique violations or monitoring violations.<br />

Lead and Copper Monitoring Program<br />

Lead and Copper regulation changes in 2009 required <strong>water</strong> systems that conduct monitoring to<br />

<strong>report</strong> the level of lead and copper to the customer that was sampled. The notice must also<br />

include the action levels, health effects of lead, and steps a consumer can take to reduce the lead<br />

level in their <strong>drinking</strong> <strong>water</strong>. Water systems also must submit a <strong>report</strong> to the <strong>Department</strong><br />

anytime a new source or treatment is added or a major modification to an existing treatment is<br />

made. This <strong>report</strong> must detail any affect of this treatment change on lead and copper levels and<br />

must be approved by the <strong>Department</strong> before the source or treatment is added or changed.<br />

268 systems monitored for Lead and Copper in FY2011. Two <strong>water</strong> systems exceeded the<br />

copper action level and two <strong>water</strong> systems exceeded the lead action level in FY2011. Water<br />

systems that exceed an action level must submit a corrosion control plan, conduct source <strong>water</strong><br />

and <strong>water</strong> quality parameter monitoring, and return to six month monitoring. In addition,<br />

systems that exceed the lead action level must also provide their customers with lead education<br />

materials. Approximately half of these <strong>water</strong> systems had provided the required proof that they<br />

notified their customers of the sample results by the end of FY2011. A complete <strong>report</strong> of lead<br />

and copper compliance data for calendar year 2011 will be included in the 2011 <strong>annual</strong><br />

violations <strong>report</strong> which will be produced in May or June 2012.<br />

Disinfection Byproduct Monitoring and Compliance<br />

367 community and NTNC <strong>water</strong> systems were required to monitor for disinfection byproducts.<br />

DBPs include total trihalomethanes (TTHM) and haloacetic acids (HAA5). Listed below are the<br />

systems that incurred MCL violations.<br />

The <strong>Department</strong> has issued orders against three of the above systems. These three systems<br />

received more than one violation and were not able return to compliance, necessitating an order.<br />

These orders require the system to return to compliance within a specified amount of time. No<br />

<strong>water</strong> systems incurred monitoring violations for disinfection byproducts during FY2011.<br />

All systems with a surface source or a source that is classified as ground<strong>water</strong> under the<br />

influence of surface <strong>water</strong> (GWUDI) are required to monitor for total organic carbon (TOC).<br />

These systems were required to collect raw <strong>water</strong> and a combined filtered <strong>water</strong> sample each<br />

month. TOC results from each plant are evaluated to determine if the plant is meeting TOC<br />

removal requirements or to determine if monitoring could be reduced to quarterly for TOCs. No<br />

<strong>water</strong> systems incurred treatment technique violations for failure to meet TOC removal<br />

requirements.<br />

Laboratory Certification Program<br />

<strong>Department</strong> regulations require an <strong>annual</strong> fee for recertification of <strong>drinking</strong> <strong>water</strong> laboratories.<br />

The fee for certification varied from $170.00 for bacteriological certification to a maximum of<br />

$680.00 for chemical laboratory certification. All chemical and bacteriological analyses of <strong>water</strong><br />

samples required by the State must be analyzed at a laboratory certified by ADEM.<br />

40 bacteriological laboratories were certified during the fiscal year. In FY2011, there was one<br />

new certified bacteriological laboratory. The certified bacteriological laboratories consisted of<br />

two State Health <strong>Department</strong> laboratories, 27 <strong>water</strong> system laboratories, nine commercial<br />

laboratories, one county laboratory, and one state college laboratory.<br />

36 (17 in-state and 19 out-of-state) chemical laboratories were certified during the fiscal year.<br />

Two new out-of-state chemical laboratories and three new in-state laboratories were certified by<br />

in FY2011. One in-state chemical laboratory closed down and seven out-of-state laboratories<br />

chose not to renew their certification in FY2011. Appendices E and F contain a list of certified<br />

chemical and bacteriological laboratories.<br />

The <strong>Department</strong> allowed certified chemical laboratories to choose their own supplier of<br />

performance evaluation (PE) samples. Laboratories are allowed one retest for any contaminant<br />

they failed during the first PE study.<br />

EPA conducted an onsite audit of the laboratory certification program during FY2011. The audit<br />

findings led the <strong>Department</strong> to greatly enlarge and expand its coordination meetings with the<br />

Health <strong>Department</strong>. In addition, the <strong>Department</strong> developed a written program plan and revised<br />

its standard operating procedures.<br />

Drinking Water State Revolving Fund Activities<br />

The Drinking Water State Revolving Fund Annual Report is incorporated by reference and has<br />

been submitted to the SRF & Surface Water Grants Section of EPA Region IV under separate<br />

cover.<br />

Operator Certification Program<br />

The FY2011 <strong>Alabama</strong> Operator Certification Annual Report is incorporated by reference and has<br />

been submitted to the EPA Region IV Operator Certification Coordinator under separate cover.<br />

Response to Natural/Man-Made Disasters<br />

Based on experience gained from past emergencies and natural disasters, the <strong>Department</strong> is<br />

working to ensure that all emergency responders are NIMS (National Incident Management<br />

Systems) compliant in order to assist <strong>water</strong> utilities, if needed, during emergencies or natural<br />

disasters. This will also ensure responders are prepared to implement standardized procedures<br />

when responding to a large scale incident as part of a national response team. The <strong>Department</strong> is<br />

also continuing its efforts, by working with AWWA, NRWA, and other <strong>water</strong> associations and<br />

agencies to maintain ALWarn (<strong>Alabama</strong>’s Water/Waste<strong>water</strong> Agency-Utility Response<br />

Network). This is a network of utilities offering assistance to other utilities during natural<br />

disasters and emergencies. The network is not a corporation or a governmental unit, but rather<br />

consists of <strong>Alabama</strong> utilities who agree to help each other with personnel and resources during<br />

emergencies and disasters, especially during hurricanes and winter freezes.<br />

The <strong>Department</strong> assisted with the response to severe storms, flooding and tornadoes that began<br />

in the early morning hours of April 27, 2011 and lasted throughout the day. The National<br />

Weather Service confirmed that 20 of the 62 tornadoes that struck the state from April 15 th<br />

through April 27 th were EF1 to EF5. <strong>Department</strong> personnel were located at the state emergency<br />

operation center (EOC) and several incident command posts throughout the state. Drinking<br />

Water Branch personnel kept track of the status of <strong>water</strong> systems and assisted with the<br />

coordination of assistance to <strong>water</strong> systems through ARWA, ALWarn and the State EOC.<br />

Damage to <strong>drinking</strong> <strong>water</strong> systems varied from minor damage and loss of power to major<br />

damage to <strong>water</strong> treatment facilities.<br />
