Under chapter 5: commercial <strong>and</strong> other use of <strong>forest</strong> resources<br />

Section 5.1 – Basic Prohibitions <strong>and</strong> Regulatory Powers<br />

f. The Authority shall, by regulation or otherwise, undertake measures to institutionalize<br />

the participation of communities in <strong>forest</strong> management. Such measures may include,<br />

but are not limited to:<br />

(i) Recognition <strong>and</strong> protection of community l<strong>and</strong> tenure rights;<br />

(ii) Formulation of a code of conduct to govern relationships between holders <strong>and</strong><br />

communities;<br />

(iii) Requirement to complete a social agreement between holders <strong>and</strong> communities<br />

that defines the parties’ respective rights, roles, obligations <strong>and</strong> benefits with<br />

respect to one another;<br />

(iv) Provision for security of access by communities to non-timber <strong>forest</strong> products <strong>and</strong><br />

other <strong>forest</strong> resources; <strong>and</strong><br />

(v) Provision of technical assistance to community <strong>forest</strong>ers.<br />

Section 5.3 – Forest Management Contracts<br />

b. Forest Management Contracts must meet all of the following requirements:<br />

(ii) The l<strong>and</strong> involved must not include private l<strong>and</strong>.<br />

(vi) The contract must require the holder to establish a social agreement with local<br />

<strong>forest</strong>-dependent communities, approved by the Authority that defines these communities’<br />

benefits <strong>and</strong> access rights.<br />

Section 5.4 – Timber Sale Contracts<br />

b. Timber Sale Contracts must meet all of the following requirements:<br />

(ii) The l<strong>and</strong> involved must not include private l<strong>and</strong>.<br />

(i) … The Authority may award Timber Sale Contracts for the purpose of allowing<br />

<strong>forest</strong> l<strong>and</strong> to be cleared for agriculture or for the establishment of plantations.
