Case VI<br />
Rent Arrears and Non-Vacating of<br />
Dwelling<br />
In <strong>the</strong> matter of A. J. (Applicant and<br />
Respondent Tenant) and D. H.<br />
(Applicant and Respondent Landlord)<br />
<strong>the</strong> Private <strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong><br />
Board, in accordance with section 121<br />
of <strong>the</strong> <strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong> <strong>Act</strong> <strong>2004</strong>,<br />
determines as follows:<br />
1. The Notice of Termination of<br />
Tenancy served by <strong>the</strong> Landlord on<br />
<strong>the</strong> Tenant does not comply with<br />
section 62(1)(g) of <strong>the</strong> <strong>Residential</strong><br />
<strong>Tenanc<strong>ie</strong>s</strong> <strong>Act</strong> <strong>2004</strong> and as such was<br />
not valid.<br />
2. The Tenant must pay <strong>the</strong> Landlord,<br />
within 7 days of <strong>the</strong> date of issuing this<br />
Order, <strong>the</strong> sum of €2,625 being<br />
arrears of rent owing in respect of <strong>the</strong><br />
dwelling at _________________ for<br />
<strong>the</strong> period 9 December <strong>2004</strong> <strong>to</strong> 3 May<br />
2005.<br />
3. The Tenant must pay <strong>the</strong> Landlord,<br />
rent at <strong>the</strong> rate of €550 per month or<br />
part <strong>the</strong>reof from <strong>the</strong> 4th May 2005<br />
until <strong>the</strong> tenancy is validly terminated<br />
by <strong>the</strong> Landlord or Tenant.<br />
This Order was made by <strong>the</strong> Private<br />
<strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong> Board on 19th<br />
August 2005.<br />
Case VII<br />
Deposit Retention<br />
In <strong>the</strong> matter of T.Y. (Applicant<br />
Tenant) and P.D. (Respondent<br />
Landlord) <strong>the</strong> Private <strong>Residential</strong><br />
<strong>Tenanc<strong>ie</strong>s</strong> Board, in accordance with<br />
section 121 of <strong>the</strong> <strong>Residential</strong><br />
<strong>Tenanc<strong>ie</strong>s</strong> <strong>Act</strong> <strong>2004</strong> and pursuant <strong>to</strong> a<br />
declaration under section 97(4)(b) of<br />
that <strong>Act</strong> relating <strong>to</strong> a decision reached<br />
by <strong>the</strong> part<strong>ie</strong>s <strong>the</strong>mselves, determines<br />
as follows:<br />
1. The Respondent must pay <strong>to</strong> <strong>the</strong><br />
Applicant, <strong>the</strong> sum of €1,034.33 being<br />
<strong>the</strong> deposit less deductions for<br />
refuse/bin charges and carpet cleaning<br />
in respect of <strong>the</strong> dwelling at<br />
___________________________.<br />
2. The Respondent and Applicant<br />
agree and accept that <strong>the</strong> deposit has<br />
been returned <strong>to</strong> <strong>the</strong> Applicant. This<br />

<strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong> Board on 19th<br />
August 2005.<br />
Case VIII<br />
Rent Arrears<br />
In <strong>the</strong> matter of C.K. (Applicant<br />
Landlord) and P.S. and J.R.<br />
(Respondent Tenants) <strong>the</strong> Private<br />
<strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong> Board, in<br />
accordance with section 121 of <strong>the</strong><br />
<strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong> <strong>Act</strong> <strong>2004</strong>,<br />
determines as follows:<br />
1. The Respondent, P.S. must pay <strong>to</strong><br />
<strong>the</strong> Applicant, within 14 days of <strong>the</strong><br />
date of issuing this Order, <strong>the</strong> sum of<br />
€2,565 being arrears of rent owning in<br />
respect of <strong>the</strong> dwelling at<br />
_______________________.<br />
2. The Applicant shall retain <strong>the</strong><br />
security deposit of €500.<br />
This Order was made by <strong>the</strong> Private<br />
<strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong> Board on 19th<br />
August 2005.<br />
